We hired Mission's Roofing, owner and contact person ***, replaced our roof on September of 2016. According to our contract, roofing felt 30 pound should be installed between the roof deck and the roofing shingles. The company violates the contract and failed follow Industry Installation Standard Practices to put it down under the shingles as required by the Agreement.

The roof has leaked and has damaged ceilings and wall throughout our home. We contacted the company XXX-XXX-XXXX via phone/text and email numerous times regarding these damages. Finally they sent someone out to fix the problem, and that person did some work around a chimney. Thereafter, the roof leaked persists, and they again sent someone to fix the leak. That person worked on a different portion of the roof, and that seemed to fix the leak.

Our ceiling is stained and the drywall is crumbling. Mr. promised to fix the interior, but only after we paid for the first person they sent out, who incorrectly attempted to fix the roof. This condition is totally unacceptable. They claim they are the expert in this field and they are the ones in control of the worker who came to fix the roof. To expect us to pay their worker who incorrectly diagnosed the problem is ridiculous.

Desired Outcome

I require that Mission's Roofing return my money so that I can hire another roofing contractor to redo the job. In arbitration I will be seeking payment for property damage and recovery of legal fees.

Our warranty does not cover the chimney and this customers chimney was the cause of the leak into her home. Even though this issue was not under warranty I offered to repair damage to the interior of her home at no charge to her. I only asked that she pay the repair cost to the chimney which she had authorized) and which she verbally stated that she wanted to repair. (the chimney repair stopped the leak. There was no leak at the roof). I certainly would like to make this right with this customer.

Thanks for the response. However, Mission's Roof company violated the contract and failed to follow Industry Installation Standard Practices by not putting roofing felt down under the shingles as required by the Agreement. The improper installation was the cause of the leak. The fact is that the first representative of your company who came out to the residence calked the chimney but the roof leak persisted. That is why the second representative of your company was sent over only after numerous requests by us.

Per the warranty/contract, Mission's Roof company is responsible for the damages caused by the improper work.

I would like to state that roofing felt was put down over the entire home at time of the the roof installation. Anywhere that you test her home for a sample of felt you will find that we installed 30# felt. This roof was installed 2 and a half years ago and has never leaked. If there was no roofing felt installed the house would be leaking everywhere. Many homes in this area of Plano have chimney problems due to the building contractor using press board siding.I have offered to pay for the damage to her interior even though her leaky chimney was the problem and not an issue with our warranty. We repaired the chimney at her request and she refused to pay for the repair to her chimney. I would like to offer her $2500 and forgive the chimney invoice to make this right. Using insurance standards for sheet rock repair and paint this is 4 times more than an insurance company would pay to repair the damage to her home. I have pictures of the damage to her chimney as well as witnesses who will testify that the chimney leak was the cause of the leak to her home. We pray for relief.

Here are the facts:
On 9/15/2016, Mr. sent a crew to install our roof but he did not come as he promised. During the sales process, he told me that they did not use subcontractors and he will come to confirm the proper installation. I called Mr. numerals times because 1. One of the crew told me that he is not Mr. employee 2. Mr. supposed to come to ensure proper installation 3. The old felt was not removed and also new felt was only placed on top of the old felt in a few spots on the roof. Regardless, I called him and requested that he correct this failure. He showed up and collected the money after the workers left. However, he sincerely apologized for faulty workmanship and promised "the warranty will repair the leak and sheetrock damage for free".
On 9/16/2016, He emailed me "Here is your warranty card and receipt of payment from us. I want to apologize for the problem with the felt and hope that we have resolved your questions with this warranty."
On Oct 7, 2016, I contacted Mr. and reported leak. He responded back on 1/24/2017, " I would need to have the leak present itself on your ceiling or wall to be able to pin point the leak entry point." It continued leaking and continues leaking to this day every time we encounter significant rain. Our ceilings are stained and the drywall is crumbling. The wall was so wet that mirrors on the wall fell off.
On 10/23/2018, after countless call/text regarding these leaks he finally sent someone out to fix the problem and that person did some work on the chimney. Thereafter, the roof continued to leak.
On 10/27/2018, again after countless calls, he sent someone to fix the leak. That person worked on a different portion of the roof, and that seemed to fix the leak. Apparently, there was no need for the 2nd person to come if the chimney was the cause of the leak. Therefore, the roof IS the cause of the leak and he is responsible for the damage done to the interior of our home.
We have solid evidence and witnesses to prove the facts. This also can be verified by removing a few shingles if Mr. wants to arrange this inspection.
