Business owner is a contractor who offered a warranty on a construction project for a period of one year (warranty to end mid December 2019). The construction project included a home renovation and new construction. The contractor indicated they would reach out to schedule time the first two weeks of December 2019 for a final walkthrough of items requiring repair. When the contractor did not schedule time, we reached out to schedule. it was at this time they indicated they would send someone to complete repairs, which involved only sending a painter. The painter completed some of what they could, but there were required repairs beyond what the painter could fix and he lacked materials to complete other portions. The contractor was not available for final walk through and when we reached out to schedule the time and coordinate further work, they responded that we were beyond our warranty period and they would not be covering any further repairs. The contractor did not return any calls to discuss or resolve the issue and only responded via e-mail that they were not performing any further work. They have not come to the home to inspect anything as they indicated they would.

Work was completed for this customer in a two-phase project. Both phases of construction were completed, a final walk-through conducted, and a written project close-out report was provided to the Owner on December 19, 2018. The contractual warranty for this work was as follows:
4. Warranty and Disclaimer: If, within one (1) year after the Completion Date, the Work is found to be defective or not In accordance with this Proposal, MKG shall correct It promptly after receipt of written notice from the owner. ALL OTHER WARRANTIES (O(PRESS, IMPLIED, OR ORAL) INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, WORKMANSHIP, AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED. All material is guaranteed to be as specified. All Work Is to be done In a workmanlike manner according to standard practices. An alteration or deviation from above specifications involving extra costs will become an extra charge over and above the Proposal.
During the one-year warranty time period of December 20, 2018 — December 19, 2019, there were four notifications from the Owner for warranty work which were addressed. In addition to sending sub-contractors to the house seven times to conduct warranty work, I personally went to the site five times. As of December 19, 2019 there was only one outstanding item that the Owner had brought to our attention that they wanted done. That item was caulking. When contacted by the Owner on December 28, 2019 (9 days after warranty expiration), MKG Renovations sent a qualified craftsperson to caulk. The craftsperson went to the home on December 31, 2019 to perform the work and was sent away by the Owner without the work being completed.
The complaint filed contains false statements:
1. False Claim: contractor indicated that they would reach out to schedule time the first two weeks of December 2019 for a final walk through of items requiring repair.
o There is no clause in our contract, nor any communication between the Owner and MKG Renovations, to provide a walk-through of the project one-year past project completion. The final project walk-through was conducted on December 19, 2018, documented in a written report, and signed off by the Owner.
o There was no communication between the Owner and MKG Renovations indicating that MKG would reach out and schedule time the first two weeks of December 2019 for a final walk through of items requiring repair. The only communication between the two parties regarding this time period was an email sent from MKG Renovations in response to the homeowner on 8/22/19. The homeowner inquired about the best timing to caulk. MKG Renovations responded to the homeowner's request regarding caulking that we would "coordinate" with the home owner in the first two weeks of December to caulk unless they wanted it done before that time, and that there would be only one pass. As a project manager, "coordinate" means that when contacted by the homeowner, the appropriate crafts are scheduled to perform the work.
As of December 19, 2019, the only outstanding warranty item that the Owner had requested that had not been addressed was caulking. While the Owner failed to contact MKG Renovations prior to the warranty expiration to coordinatethe work, a qualified craftsperson was promptly sent to complete the work when notified.
1. False Claim: Contractor indicated they would send someone to complete the repairs, which only involved sending a painter.
o The only outstanding item that was brought to MKG Renovations' attention during the warranty period that was not addressed was caulking.
o The craftsperson sent to perform the work has over 10 years experience in caulking, drywall, and painting.
2. False Claim: Contractor has not come to the home to inspect anything as they indicated they would.
o MKG Renovations did not commit to any inspections of the property beyond the final construction inspection which occurred on December 19, 2018.
o MKG Renovations has inspected warranty work performed on four separate occasions during the warranty period.
In summary, MKG Renovations has provided services in accordance with the written contract, and acted in good faith to coordinate caulking work when notified outside of the one-year warranty period.

I have reviewed the response made by the business in reference to complaint ID 14130056, and have determined the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

MKG has indicated that as of December 19, 2019 there was only one item that was brought to attention related to caulking. This was due to the fact that MKG's instructions to homeowner (included in attached e-mail from 8/22/19) were specifically "I will coordinate with you the first of second week of December to address any issues that are covered by your warranty and not due to your foundation problems." Therefore, we did not communicate the list of items that are covered under the warranty as we were waiting for her initial contact. This did not occur. It was when she failed to perform that we reached out and MKG indicated via e-mail, after caulking was only partially complete, she would do no further work as we were past the warranty period. She has failed to respond to any voice messages outside of e-mail and is unwilling to discuss what items are actually covered under the warranty which include, but not limited to 1) nail pops in new space 2) gap in flooring requiring trim (picture included) and 3) completion of caulking around counter-tops (picture included). In regards to comments about the painter who was sent away, he only completed part of the caulking work. He left for additional materials but came back with incorrect caulk (required sanded caulk which he did not buy although was told the specific materials needed). At this point, it was the end of the work day and the work could not be completed without additional materials purchased.
