We contracted with servpro from a water damage claim covered under insurance. We were not notified by servpro of a clerical error on insurance check.
We endorsed the check, as did our lender Wells Fargo. No one noted the error that a second signature was required from the insurer. We sent the he check to servpro thinking case closed. Instead of contacting us the servpro collector called the insurance company a few times with no response. He then filed a lien on our property as he was "quite irate" that he had not received response from insurance. He also verbally told me he intentionally filed the claim to get the insured on the insurance company to respond without giving us the courtesy of knowing the issue to resolve in advance. He said the only reason it was filed is because the insurer did not respond to him and we did nothing wrong. There was no valid reason for a lien as he had already seen the check, it just needed. an additional signature. A lien on our property could negatively impact our credit for years to come and we demand it be removed from the county records immediately. Since learning of the error, we have worked with other our insurer and had the correct check sent to servpro within 3 days of notification

We try our best but, particularly since Hurricane Michael, we have had some confusion. The check from the insurance company which was missing the additional signature has been received as of today with all signatures required and the lien will be released today and proof sent to the homeowner.

Quite ironic. Servpro has used the excuse of Hurricane Michael to explain their mishandling of this situation, yet their employee was COMPLETELY intolerant of lack of response from insurance folks who are equally busy in the aftermath of the hurricane. He filed the lien ONLY because he was so "irate" he did not get a response from them!
We requested that the lien be completely removed from public records so we do not have any issues in the future. This has not been done.

We are also escalating an executive complaint to ServPro Corporate to have this done
I personally went and had the lien removed from this property yesterday. I have addressed the employee concerning proper procedures of handling a situation like this. I apologize on my behalf and just know that this issue is being addressed.
