ID [redacted] Consumer: [redacted] March 2, 2015Dear [redacted] :In answer to the complaint filed by [redacted] , T & T Inc of New York offers the following:T & T has been in the towing and recovery business for over yearsOur team of professionallytrained drivers provide service to the motoring public often at the request of the New York State Police,the local police and/or fire departmentsEmployees at T & T are trained in Traffic IncidentManagement (TIM) and Quick Clearance (QC)New York State Police, as well as standard industrypractices require that we employ these principles in all of our recoveriesTIM and QC require that weminimize the impact to the motoring public while providing for the safety of those on sceneClosing atravel lane should be avoided when possibleClosing a traffic lane on an interstate results in delays,economic loss and contributes to secondary crashes.The towing industry has developed rotating boom wreckers which allow for no or minimal lane closurewhile performing recovery workA rotating boom wrecker can be set up on the shoulder of the road toperform a recovely.of a vehicle over the guard railA conventional straight stick wrecker would have toset up perpendicular to the guard rail and would require closure of travellane(s)Rotating boomwreckers cost approximately three times more than a conventional wreckerTherefore, the cost to theconsumer is about three times more alsoWhile straight stick wreckers have the ability to set up on theshoulder parallel to the guard rail the recovery procedure would be to just pull the casualty along addingsignificant additional damageCurrent NYS laws hold towers financially responsible for this additionaldamage.This particular recovery could not be safely accomplished following TIM/QC guidelines with aconventional wreckerA rotating wrecker was necessary and dispatched for the reasons discussedabove.Our standard rate for the rotator is $per hour with a two hour minimum chargeThe firstresponding straight stick wrecker remained on scene for traffic controlA conventional wrecker bills outto $per hourTraffic control vehicles are billed at $per hourOur rates for flatbed towsare registered with the NYSPDRates and charges pertaining to various towing scenarios are posted inour reception area and are standard for local tow and recovery businesses.Ms [redacted] 's insurance carrier, [redacted] , reviewed our invoices and initially paid all charges in fullfor $ [redacted] handles thousands of towing invoices for collisions every yearHad [redacted] foundour charges to be out of line, they would have disputed the invoice charges immediately and before theadjuster left our facilityThey day after we received the check, [redacted] notified us that the customer'sinsurance coverage would only cover $The charges for the recovery were fair and reasonable.With only $limit on the insured's policy, the remainder of the fee's involved in the recoverywould be the responsibility of the vehicle ownerThis was discussed with the owners and they agreedwith T & T to pay the balance left on the billWe recognized the fact the vehicle owner wasunderinsured and the financial impact to her would create a hardship on her financesAs a good willgesture, we discounted the bill to $leaving the balance due after insurance $1457.00.Any further questions, please do not hesitate to contact meMy email address is***@aol.comtheoffice phone number is ###-###-#### .Thank you.Sincerely, [redacted]

Had [redacted] foundour charges to be out of line, they would have disputed the invoice charges immediately and before theadjuster left our facility. They day after we received the check, [redacted] notified us that the customer'sinsurance coverage would only cover $1000.00. The charges for the recovery were fair and reasonable.With only $1000.00 limit on the insured's policy, the remainder of the fee's involved in the recoverywould be the responsibility of the vehicle owner.
