not at any time, provide for fire, theft or damage insurance or any other insurance
concerning Tenant's property
6.) Tenant agrees that Landlord shall not be held responsible or liable for any damage to
Tenant or Tenant's property arising from any actions, negligence or suits of Tenants, any
Tenant of the building of which the premises are a part, or due to any other causes
whatsoever Tenant agrees to hold Landlord harmless from any and all claims for any
damage to or theft of any properties and for any product liability claims
The Kraft Shak is not responsible for any missing / damaged items, *** *** was
informed that the items were in the store for her to pick up or be shipped if postage was
paid, seeing as how she owes to the Kraft Shak an outstanding balance of: $Items
are being held at the location until balances are owed or Mrs*** picks up any and all
remaining inventory I would like to note NO notice was given upon her leaving the store
front Rent was increased to $upon agreement for the month of January due to an
additional line and space being occupied of American Girl Doll Clothes Mrs***
showed up during hours and collected her items in a hastily manner and then left, she did
not inform The owners or The Kraft Shak that she was leaving the store as required in the
days notice Please advise if you have any further questions
The Kraft Shak will waive all fees owed by *** *** if she agrees to withdraw her
"complaint" at this time if not it will seek penalties and damages in a small claims court

Please note the following Facebook message in reference to the business owner's response She confirmed in the first message that she was not charging any rent for the remaining time in the contract In addition it shows my attempts to contact her about having my items returned which she failed to respond to In addition, her comment about theft does not apply since in the first message she also admits to still having my merchandise I either want my items returned or she can purchase them Also she still owes me for the sales she has not paid to date Please also note, that the below facebook messages are the only way in which the owner has contracted me and at no point has she even quoted me an amount owed, or postage estimate I have repeated asked to know when items could be shipped or reimbursed and she failed to respond
I found while rearranging the shop for Spring a few of your items that were left, Gourd Bird Hangers, Puzzle Blocks, and a Spoon that was hereI also closed out your month for you as well you can find it on the spread sheet, I am not going to charge you for the time that was left in the contract nor the amount that was owed at the time, I hope this finds you welland just need to know what to do with the left over items

*** Thank you for contacting me, I checked the items against my inventory and I am still missing the following items wooden pens (ea), Jam spoons (ea), spreaders (ea), ornaments (ea) a total product value of The items that are the most concern and are the wooden pens since they are much higher in value and they were keep at the register to prevent theftPlease ship all missing items and the ones you list you have already found to my home at *** *** *** *** ** ***.and you can submit any unpaid sales to my paypal account at *** *** ***

If I do not receive the missing sales plus merchandise cost credited to my paypal account by April 2, or the missing merchandise shipped to me and the credit for sales by the same date I will have no other option but to notify the appropriate business authorities and proceed with legal actionIt has been almost months since I collected my other items and two weeks since I contacted you lastI just want this resolved and to move on but I feel that you are purposely avoiding returning my items and the unpaid sales at this point

Correction to Previous Message: You have until May 2, to pay sales and either return the missing items or reimburse me the cost of all missing items and the unpaid salesIf you fail to do so I will have no choice to seek legal action

In relation to the amount she claims is due for work days Per the contract if you live more than miles from the store you are not required to work and will not be charged for not working Please see the mapquest.com directions below proving my home is more than miles for her shop

This behavior is typical of the owner based on my experience with her and the experience many others have had I recommend that she review her correspondence with me as well and re-read her contracts I still hold that my original demands and requested have not been satisfied I am already meeting her my attorney about this matter I will be filing civil charges against her if this matter is not completely resolved by the end of June I am proceeding in this fashion not only to reimburse the expenses I have lost due to her actions and inaction but as an attempt to make her behavior part of public record in an effort to warn other vendors to avoid her for their own financial safety
