Re: Complaint # [redacted] This correspondence is intended to address the issues raised and alleged facts asserted in the above-referenced complaint.? Please understand that we at the [redacted] Rathskeller Tavern want all of our customers to have a pleasant experience when dining and visiting here.? We were therefore disturbed and upset to receive the referenced Complaint, which alleges poor treatment by our staff towards a patron.? As you are aware, this complaint centers around the request by our staff for identification in an attempt to comply with RI laws regarding the serving of alcohol.? Due to the youthful appearance of these two patrons and the concerns regarding the id’s which were presented, our staff logged the customer’s information in accordance with RI General Laws 3-8-6, et seq., and Department of Business Regulation RulesFirst, the customer/complainant alleges that the waitress “grabbed my ID right out of my hand” and then grabbed her “personal property”.? She further describes that “the entire restaurant looked over at our table” and that the restaurant now has a “file” of both her and her brother’s information.? The complainant also makes reference to having been “assaulted”.? Please be advised that our facility is equipped with a substantial number of cameras, one of which was positioned approximately feet from the table where the complainant and her brother were seated.? The video of the entire incident has been viewed and quite clearly, 1) there is no evidence of any assault and no ‘grabbing’ of anything, by anyone, including the waitress; 2) the individual who assisted the waitress was an onsite manager (not an owner) who was called over by the waitress in accordance with restaurant protocol, Rhode Island General Laws as well as DBR Rules (regarding proper ID’s and the mandatory recording of ID information in a Log Book - Class B license holders); 3) not one person in the vicinity of this table can be seen so much as glancing in the direction of this very brief encounter; 4) there is no animated behavior or gestures and no sudden movements in the video on anyone’s part, including the complainant, her brother or the staff; and, 5) no licenses or ID’s were retained by our staffIn answer to the complainant’s desired settlement, we respond as follows:? There are no documents in our possession which belong to the complainant or her brother and neither the waitress nor the manager will be reprimanded as they were following restaurant policy and RI Law.? It is unfortunate that this young lady’s recollection of the events during this brief encounter seem to be so at odds with the video recording of the event.? ? It is also unfortunate that this young lady has chosen to post her recollection on social media prior to our response to the allegations.? We are not accusing her of misrepresenting her perception or recall of the events, but at this time, we see no justification for ordering our employees to issue personal apologies.? We are sorry that any customer left our restaurant feeling less than satisfied with their experience, but there are procedures dictated by the state government which we must follow with respect to serving alcohol and we demand strict compliance by our staff with all rules, especially those relating to alcoholWe hope we have provided you with sufficient information to resolve this matter.? I am years of age, my brother is about to turn We started our dinner off by ordering two waters, I ordered a down east cider and he ordered a lagunitas little sumpin' aleThe waitress rolled her eyes at us then walked awayWe were unable to order an appetizer and before we knew it the owner came to our table and demanded that he see our IDs for a second time which is understandable though this has never happened to me before there is no denying that we are youngHe then requested that we fill out a document with our drivers license informationWe filled out the documents with our names and birth dates etcthen as I was looking over to write down my drivers license number the waitress yelled at me "NO LOOKING" and grabbed my ID right out of my handI was insulted to begin withThen she grabbed for my personal propertyMy drivers licenseThe entire restaurant looked over at our table as we were being falsely accused of having fake IDsObviously, like any paying customer,
