Review: The Sporting Club has an unfair membership cancellation policy. Although this is written up in their contract, its one that can easily be missed and not thought about until its too late. On April 24th I contacted the Sporting Club to cancel my membership, i've been a member for a few months now but unfortunately have not been able to make the time to use the facility. After a couple of emails exchanged, the Sporting Club agreed to cancel my membership but told me that it would not take effect until the end of May and I would be charged on May 6th even tho I do not plan on using the facility. I contacted them to try and figure out why this would be the case as I am canceling weeks ahead of the next billing cycle and they said this is their policy. If someone calls to cancel a policy weeks ahead of the next billing cycle, and does not plan on taking advantage of the facility, why should that person have to pay for the entire next month?Desired Settlement: Refund of my membership fee of $180 for the time period in which I will not be using the club that is after my cancellation date.

We're sorry that this member feels necessary to state our policy as unfair. We do not, like most health clubs, bind members into a year or longer contract. Rather, we allow members to cancel their memberships at any time, and we ask only that notice be made by the 15th of a given month, in order that the cancellation effect at the end of that month. This policy is clearly outlined and even specifically initialled upon by each new member in our membership agreement, is posted on our webiste and posted in multiple locations around the club. The members agreement was cancelled in accordance with our policy. This member was offered items to allay the disappointment, but still chose to follow this extreme measure.

Review: I received a letter via USPS mail informing you of a so-called "Member Enhancement Initiative" for $40 that will be charged in September, but it is not in my contract! I have a copy of the original contact I signed, which makes no mention of this fee. And when I contacted the General Manager, [redacted], he sent me a photocopied version of a different contract that states this fee, but it is not the one I signed. The gym is adding in this charge without authorization from club members, and they are taking it out of their bank accounts without permission.Desired Settlement: The general manager said he will not charge me this fee because I complained, but I do not want a membership at a gym that feels it can just indulge in its members bank accounts any time it wants to without permission. So I am canceling my membership and do not want to pay any fees whatsoever to cancel and will not pay the monthly fee for September as [redacted] said he would charge me

The members of management and the staff here at The Sporting Club stand behind the General Manager’s decision in his attempt to resolve the complaint filed by this former member. This member signed a contract that explicitly states the rules, regulations and financial obligations included in a membership at The Sporting Club. This includes our one-time annual assessment fee billed to every member. The Sporting Club has never unlawfully or randomly pulled funds from our member’s accounts without notice and written permission. This member has posted personal attacks on Yelp directed at the General Manager and the club. These comments were vulgar and fictitious and subsequently flagged, then removed. The Sporting Club is considered one of the premier health clubs in San Diego, because of our unwavering professional dedication to our members in helping them achieve their health, wellness and fitness goals.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[The one time annual fee is NOT stated in the contract I signed. I have the original copy of it, and this extra fee is not stated anywhere. I have left this scandalous gym to avoid the ripoffs and scams like this initiated by the general manager.]

Review: The showers in the womens locker room in both the main gym and the annex have a very serious mold issue. The grout is riddled with black mold up to waist level in some stalls and along the floor. The carpet in the annex smells like mildew, so there is definitely a mold issue there as well. I have left several complaints for the management and housekeeping to no avail.Desired Settlement: This needs to be rectified immediately. Members pay up to $130 per month for a spa-worthy locker room and hotel guests come from all over the world for their spa treatments at the club. Mold is a serious health issue and the stalls must be shut down and the mold completely eradicated before they are reopened.
