On April 16, I spoke with *** in reference to
the water back up. ***
explained to me
in detail what had occurred in the situation
I did explain to *** that Thompson’s Waterproofing,
as per the contract which was signed by both he and his wife, does not cover
any damage which is incurred while installing the drain tile system.
With that being said, I requested that *** email me
pictures and a copy of the estimate which he received from the plumber, which
he did. I discussed the situation with
**Thompson and although our company is not liable we agreed to refund the
***’s half the cost of new water back up.
The plumber estimate was for $so we will be issuing a check to the **
*** in the amount of $
Customer service is an integral aspect of our business and
Thompson’s Waterproofing tries their best to satisfy the customer to the best
of our ability. *** stated to
me on the phone that he felt the offer was fair and hopefully this will end any
further issues

This correspondence will acknowledge receipt of your letter dated June 29, in the abovecaptioned matterPlease be advise that I can not help you in this matter as I am the Chapter Trustee for sameTherefore, I have no business, records or anything else that I have indicated
whether any of the allegations contained are true and correct.Accordingly, the only thing I can suggest at this point in time is if the consumer feels they have been damaged, they shall file a Proof of Claim with the United States Bankruptcy CourtA copy of the form is attached.Thank you for your consideration of this matter.Very sincerely yours,

Thompson’s Waterproofing did install a system in the home of
the complainant on June 2014. On
June
4th, 2014, Jeff J***, the service manager received a call from
the homeowners father in law regarding an issue involving a cracked sewer line. MrJ*** explained to the father in law
that as per our contract, Thompson’s Waterproofing is not liable for any damage
to sewer lines regardless as to the cause.
Jeff J*** did make an offer to the father in law;
although Thompson’s Waterproofing holds no liability our company would come in
and cover the concrete after a plumber repaired the sewer line. The complainant’s father in law at that point
became very aggressive with MrJ*** and told him to just forget about it,
he would take care of it himself.
Thompson’s Waterproofing did receive a call from the
complainants spouse and was asked to submit pictures. These pictures were reviewed and MrJ***
did attempt to contact the complainant however, both of them were out of the
country which made contact a little difficult dealing with connections and time
differences.
When MrJ*** did speak with the complainant’s spouse,
the problem had already been corrected by a licensed plumber and she wanted
Thompson’s Waterproofing to cover the cost.
This is something that our contract clearly states we are not liable to
do.
At no time did the owner’s son contact the complainant; the
owner does not have a son. At no time
did anyone with Thompson’s Waterproofing threaten anyone, our lines are
recorded and again I state that there was no need due to the fact that Thompson’s
Waterproofing was not liable. At no time
did anyone employed by Thompson’s Waterproofing make reference to lawsuits
being a substantial cost or threaten legal action if things were reported to
the Revdex.com. Our company has no desire to
incur legal cost on a complaint that fails to comply with our contractual
agreement
I do apologize if the complainant has suffered an inconvenience
based on damage that occurred to an older sewer line. Thompson’s Waterproofing, as I stated
earlier, was willing to defer the cost by re-cementing the floor after the
plumber completed however, we do not have licensed plumbers on staff nor are we
liable, as per the signed contract. The
offer to re-cement was turned down by the complainants’ representative and as a
company we will not pay someone a fee for work that We perform on a regular
basis, We are not legally liable to cover.

The system was explained, sold and installed to flow around the bathroom because it was the clients request to not rip up the bathroom to install the system
At this point in time, Thompsons Waterproofing has service scheduled with the client and more details will follow afterwards. Thompsons Waterproofing
makes every effort to resolve all issues to the customers satisfaction

Attached please find a copy of the contract, the completion certificate and I have also enclosed a blown up copy of the center of the contract for easier reading. Our contracts our listed on legal sized documents and therefore must be shrunken to scan and this can distract from the clarity and make it more difficult to read which is why we always have the customer sign the original and leave them with a copy of that. As I stated in the previous response, Thompson's Waterproofing did offer to re-cement the area where a problem was listed at no charge to the *** family however, they chose to have another company do this work and we at Thompsons' will not pay a third party to do work that we do ourselves. Thank you

I am rejecting this response because:
The following statement is not correct: "The system was explained, sold and installed to flow around the bathroom because it was the clients request to not rip up the bathroom to install the system." Sales rep from Thompson's (Woody) was the one who sold the serviceHe was presented with the task of waterproofing the section of my basement and this is what he initially proposedThere was no other offer/way presented/suggested that I presumably declinedIn fact one of Woody's selling points was that their (Thompson's) system is better than what their competitors use and therefore it doesn't have to be installed wall to wallAccording to him going around the bathroom was the most efficient wayPlease also note that the water is not leaking from the bathroom side as there is a crawl area on the other side and the bathroom wall is not an exterior wallIt's leaking from the other side, where Thompson's worked This statement is not true as well: "At this point in time, Thompsons Waterproofing has service scheduled with the client and more details will follow afterwards." 1) This statement appeared even before return visit scheduled with me 2) I've called Jeff Johnson yesterday (after he spoke with my attorney, which happened after they send out statement to Revdex.com stating service was scheduled)He scheduled for someone to come in this morning between and am (only after speaking with me)It's 3:pm right now and no one showed up yetI've called the office to verify this but seemed they (the office) had not clue of the service call
Not true again: "Thompsons Waterproofing makes every effort to resolve all issues to the customers satisfaction." No evidence of them trying to resolve itThey (the management) almost never pick up when I call, they don't return phone calls, they don't show up when scheduled, and when/if they do, then they always come up with an excuse not to fixI guess this is how they run business

No contract was ever signed or provided by Thompson's. I would encourage Thompsons to provide the recording of the two conversations my wife had with their representative on June 10th. During those conversations my wife also asked to be provided a copy of the contract. We still haven't received the contract days later. As they have repeatedly stated their contract removes any liability for their employees damaging and iron pipe. We took the step to have the damage repaired on our own due Thompsons' requiring pictures then insisting several people review them. My parents and year old daughter were living in a house where they weren't able to use bathrooms and with my pregnant wife and returning from out fo the country adults and one child would have only been able to use our master bathroom.
Contract or no contract a company must stand behind it's work. In this case their employees entered a clients home and damaged a pipe. We are not asking for anything more than for Thompsons' to stand by their work and take responsability for correcting an error by one or more of their employeesRegards,*** ***
