Tokos Contracting LLC [redacted] *** [redacted] October 27, Revdex.com Re: ID # [redacted] , First of all we would like to thank you for giving us the opportunity to respond to the complaint filed against usWith that being said We at Tokos Contracting take pride in our business, our jobs and our reputation as an excellent contractor in the areaWe are taken aback by the complaints brought against us by [redacted] due to the fact that while on the job and after we were complimented by him, his neighbors and his family members as to the outstanding job we did and how happy they were with itThe issues that they are having are not related to the work that we did at the residence and our workmanship shows that to be factWe did respond a time or two and went to the house, checked our work on the exterior and found no reason why our job would be of any cause to the damp, mold and mildew that they were dealing withWe were also told by [redacted] that a few other contractors who had been working on his house for other projects had no explanation as to why this was happeningPrior to us starting this project they were in the process of renovating their entire house i.ea new roof tear off that could have definitely had a much higher risk of asbestos exposure than anything we removedThey have done a front porch, a deck, a concrete pad, concrete walkway and a kitchenWe were under the impression when we started the project that he had an ongoing permit due to all the other projects he had going on or had just completed previous to our jobWhen we requested that he call for an inspection he declined because he did not want a higher assessment to his propertyHe felt comfortable with everything because his brother was the architect who designed the projectsEverything we did was done above and beyond all code and we will be happy to go through the work we performed with any inspector or code enforcementWe have offered to bring in code and we will remove any piece of materials we installed for a full inspectionThe room we did is anywhere from 1-feet above grade to prevent water issuesTheir deck, patio and entrance way are below grade with no proper drainageThe homeowner was out of work the entire time that we were on the job and was there all day everyday watching and inspecting everything we did; we answered all his questions and took care of anything he wanted changedWe were contracted to do the rough frame only, any and all finish work was to be done by the homeownerHe wanted to watch and learn so that he could be able to do things on his ownWe left ladders and scaffolding for him to use to help make his work easierWe have gone there twice now since this complaint was received and we have double and triple checked everything and anything that we did, we have pulled the carpet back in separate areas and found nothingThere is no moisture in the sheetrock, the walls, the ceiling, the closets or the carpetThe attic ventilation on the room we did is open and functioning properly, soffits and ridge vents were properly doneWe completed our part of the project in May (months ago) the room we added was properly wrapped and flashing installed, the homeowners intentions were to install siding when we were doneStill to this date the room is not sidedHis intentions were to have the gutters on right after we finished and he just had them done within the last couple of monthsThe grading around the entire house is incorrectly done, the house is at the base of a large hill, the deck and concrete pad installed by them that adjoins the room we built is at or below ground level, built totally wrong and improperly flashed to prevent water damage to the houseThe gaps in the deck are not properly spaced to allow water seepage so it can’t escape and is directed towards the houseSee photo #1,&There is very obvious evidence of bowed plywood and water damage on the exterior wall of the kitchenSee photo # There are two dehumidifiers and a sump pit in the basement that the homeowner said he has to run continuouslyThere is a tremendous amount of humidity in the entire house; the room we built is tighter than the rest of the house which causes the humidity to stay in that room, the homeowner does not want to run a dehumidifier in there because he feels it is too loudI truly believe that that he needs to concentrate their efforts on the basement and other areas of the house that are damp and show signs of mold and mildewThere are obvious signs of mold on the siding (see photo #4) and other areas of the house that have nothing to do with the room we constructed instead of trying to blame us for the issuesThe roof they did previous to our project was improperly done and vented incorrectlyThe house wrap we used on the room still remains in good shape after months of being exposed to weather (see all photos)At the homeowners request and our cost we have agreed to install a second layer of house wrapThey feel it is part of the problem, which I do not agree but we will do it for them anywaysThe reason that the foundation is exposed on the one side is At their request, we used their existing foundation and poured a new concrete pad over it for a suitable foundationBeing that the house is not built very square or plum it was necessary for part of the old foundation to stick out to be exposed slightly but we properly wrapped, flashed and covered it to maintain its water tight integrity and it would not be a visual issue once it was sided which the homeowner agreed with me and was fully aware ofSee photo #This particular job is normally several thousand dollars more than he paid but we agreed to give him a lower cost because his brother is an architect that we work with occasionally and he has arraigned for us to get many other jobsWe discussed their claim of thousands of dollars in damaged purses, belts and shoes with them and they said that it was nothing that they could not wipe off and that there was no loss!! In closing we at Tokos Contracting feel that our job was done properly, it will and has met all codes with materials and workmanshipWe went above and beyond to please the homeowners and do the job we were hired forWe were lead to believe that we did an outstanding job and we constructed a very nice master bedroom for themThank you for your time, Please feel free to contact me should you have any further questionsRespectively, [redacted] Tokos Contracting, LLC ###-###-#### We also wanted to add a couple thingsThere was mention of asbestos and that we may have put the homeowners in jeopardy with the chance of it when I removed wood siding, however the homeowners tore off a roof from his house and buried the shingles in the back yardThat is a definite violation and I am sure that the DEC would find a major problem with thatWe were advised from a flooring company to do a moisture check to be sure that there is no moisture in the room that we added on, We pulled the carpet back and placed a piece of clear poly plastic between the floor and the carpet yesterday, We left it there for hours as advised and when we went back there today there was not a drop of water or any sign of moisture on the plastic or carpetThat definitely means that the moisture is not coming from the room we added onto the housePlease feel free to call [redacted] should you have any further questions
