Thank you for the chance to respond to this issue. We have been providing the complimentary and regular maintenance services for Mr*** since delivery of the vehicle in Though we have not had the pleasure of doing all the maintenance Mr*** has built a history of services
We first learned that he had a complaint which related to vibration on November 29, when the truck already had 45,miles ** no longer warranties simple vibrations unless they are found to be related to larger issues Diagnosis needs to take place to determine the issue The extended warranty Mr*** possesses also could potentially cover defects in the event there are larger issues Diagnosis would need to be performed prior to determination In either event Mr*** did not feel as though he wanted to pay diagnosis and felt a warranty should guarantee repair.Knowing all this, we were unable to duplicate the concerns voiced at our service desk while simply test driving We performed a road force balance to insure the vehicle was not out of balance with regard to rims and tires We did not charge Mr*** the associated with that balance and we did not get paid by any warranty for that balance We performed that service at our own expense for customer goodwill.When Mr*** came back in January 31, for the second time mentioning the vibration at 49,miles now we once again drove the truck with him and were unable to duplicate the issue upon demand We spoke about the diagnosis that would have to be performed and he became adamant that it should be covered under warranty and mentioned all the calls he had made The bottom line is that we are more than willing and able to look into and address the issue if there ultimately is one We cannot however guarantee the fix without knowing the problem We need Mr***'s understanding that diagnosis is his responsibility We have not acknowledged or experienced the issue We have not been given appropriate opportunity to take care of the concern. I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***In response to ***, they do not like to work on major things and that is why it was brought to a *** dealerThe owner was notified that the vehicle was and is not working correctly numerous times and his comment was that they don't do free servicesAs expected they would blame something else and not their workIt is a clear violation of Chapter 93aIn addition to this complaint, a complaint has also been filed with the Attorney General consumer protection division and the Attorney General Criminal Investigation unit regarding this dealing.As far as the brakes are concerned, the story reported by the dealer is no where what was reported to meI was told the technician blew a brake line during the test drive and they reported brake fluid gushing out, and when picked up they said there was fluid draining out and I had about pumps of the brakes before I had no brakesThat is why the vehicle sat at my house all weekend and brought back to *** to get checked and there reported condition did not existThat is also why I requested during the meeting with the owner that the technician be brought into the meetingThat is when the real story came outAfter they tried to commit FRAUD for $dollarsIn addition to the Attorney General Criminal Investigation there will also be a criminal complaint filed with the *** Police DepartmentAny services provided for my vehicle will be overseen by the Attorney Generals officeThe story reported by the dealer is no where what happened and is being criminally investigated for the FRAUD it was

In response to your October 19, letter, which I believe fails to comply with the requirements of Mass General Laws Chapter 93A, I submit the following: The facts as alleged by you are disputed based on the following statement of the facts relative to our dealingOn August 30, you brought
your *** *** to the dealership complaining of mechanical troublesThe vehicle had 94, miles on the odometer at the time that it was checked inYou informed me in later discussions that you had previously brought the car to *** *** Station where you normally had it serviced but the service people were either unable to determine what the problem was or, for some other unknown reason, they chose not to fix the problemI was unable to get a definitive statement on this point as your story changedNotwithstanding, *** apparently suggested that you have us determine what the problem wasWe not only assessed the problem correctly but it was fixed at no cost to youThere was an engine code stored in the diagnostic history which referred the technician to Special Coverage Repair #***A free timing chain was installed which would have cost you over $had you been chargedThe repair resulted in the engine running smoothly and the engine light turned offAt the time, the technician , who is the shop foreman an ASE Certified Technician, noticed seeping/leaking brake lineThe service writer noticed the low brake pedal and noted it as a blown line on the repair orderIt was suggested that further repairs should be doneThis was made clear to you in conversation with the service people but since the leak was so small and since you indicated that wanted to check the car yourself, it was released to you and no caution was made on the repair orderA week later, you returned to and met with me about what you termed an alleged fraudYou indicated that you brought the car back to Levi's and that the repair person told you nothing was wrong with the brake lineYou were then shown by my service people where the lines were weepingYou were also informed that in the event of an emergency braking situation, the line could rupture and it could cause an accidentAt all times, the choice to repair it or not was yoursI did reach out to let you know that the repair that we did do on your vehicle was warranted for twelve months or 12,milesAnd I also explained that we would be glad to look at your automobile again but you declinedTracy Motors stands behind all of its repairs and we continue to offer to inspect and, if need be, repair any defects found in the work that was performed on the timing chainHowever, nothing that was done by our service technicians, service writer or myself rises to the level of a claim of fraudulent practiceAll Future contacts with Tracy Motors must be done in writingVery Truly yours, Jeff

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***as far as the repair being done on the timing chains, that service was completed and the vehicle returned to me is not running correctly and is worse then when it was brought in for service as stated numerous times over the phone and in writingA complaint has been filed with the Attorney Generals office Consumer Protection division and they will instruct and oversee getting this situation resolved.As far as the FRAUD issue, the owner only picks a small portion of the whole storyThey committed FRAUD by saying they blew a brake line, as evidenced on their own service receipt, and it was $dollars to repairThe condition did not happen or existThat is FRAUDA complaint has been filed with the Attorney Generals office Criminal Investigation unitAfter they review the complaint they will let me know if they are prosecuting or if they want me to file the complaint for prosecution with the *** Police Department, per their instructionsThe criminal investigation will uncover the whole true story they refuse to acknowledge yet it is very documented with evidenceThey are not going to be happy when there employees are arrested and the dealership ends up on the newsI will make sure the news crews are presentAttorney Generals office will oversee all actions

The assertions that made by  Mr. [redacted] are simply not true. No Employee of Tracy Motors, Inc committed any fraud. We repaired his engine light concern for "Free" and No further work was done. We made him aware of a leaking brake line and he had chosen to drive without repair. He certainly has that right, but I would still submit that the line is excessively corroded and leaking. He has driven the [redacted] with the engine light never coming back on since repair, as stated to me on the phone. I am unclear what blame I am passing on to anyone. As far as we are concerned the engine must be running properly or he would have needed more repairs in the last thousands of miles driven. Any related work is under warranty in the event the timing chain repair caused any issues. Tracy VW, Inc Tracy Motors, Inc have not had unresolved Revdex.com matters or Attorney General issues in over 47 years. The allegations are baseless. I stand ready to be helpful with any necessary repirs needed on Mr. [redacted] that we have only made "Free" repairs on.
