This is not correct. We were not involved in the discussion of what Mr. [redacted] wanted to do with his house after abatement, i.e rebuild or tare it down. We were asked to provide an estimate for Mr. [redacted], which he  signed and agreed to do the work somewhere in the $12,000.00 range. Furthermore, I...

want to address that we were not pushy on any procedures on the abatement of what he wanted to do with his house.  We did not rush into anything. He actually signed our contract, and started to work as per usual. He then called and told us to leave the property because he didn't have to clean up the asbestos and lead. Due to the fact that we can not leave a property with exposed asbestos or lead, we had to clean up the job site for the work done thus far. We agreed to not charge Mr. [redacted] the original amount of the contract for $12.000.00 since that work had not begun. In good faith we agreed to not enforce the contract, but we did have to finish the work we had started. So, we charged him $6137.29, and he singed a new agreement for this amount.  Mr. [redacted] then sent us a payment for $5605.23, even though we did all of the work indicated on the new agreement, which Mr. [redacted] signed. When he was questioned about it he firmly stated that he felt that was what he owed. He pointed to line items on the estimate that he stated we did not do, when in fact we did.  Mr. [redacted] simply did not want to hear these facts. Our company was courteous and polite through the entire process, and when the President tried to contact Mr. [redacted] regarding this matter, Mr. [redacted] failed to communicate back. Since, he still owes our company roughly about $500.00 he will not be issued a refund all work was performed according to contract. We would also like to add that for this particular job, Mr. [redacted] could have gotten the report for the lead and asbestos from the testing company.  That report does not come from us.

I am rejecting this response because:Its the same old runaround, and rhetoric !!

Review: This group of shady practice, fast talking, distorters of true facts, attempted to rush we older folks to jump into a contract to fix the alledged lead and asbestos problems in our burned house!!The original contract had the wrong address!Four hours after they started work I realized there was no dire need to rush into this job and called [redacted] the supervisor,he was not at the job! This took place at about 12:00.He stated that his supervisor told him they had to work thru the following day also!!We never received the 'secret report on where the lead & asbestos were located'.I deducted dollars that we did not see used on this broken job.The 'lady'who called today was less than civil with threats of lawsuits and retribution for withholding $ from their bill!!!Desired Settlement: Disappear from our city and lives!

Review: rep promised to arrange plumbing services after floor removal, failed to do so, left me without functional toilet and hot water.

7/8/13 At site visit sales rep [redacted] initially stated job would be much higher than estimate provided by phone, then written estimate included more cost that his verbal statement re # of workers required. I got the distinct impression he was elevating the cost to compensate for the 10 % discount promised by advertising on Angie's list. He stated company does not reinstall anything, just removes, but agreed to arrange for plumber to reinstall hot water heater and toilets. Contract 7/16/13 did not clearly specify what fixtures would be removed in process of floor removal. [redacted] verbally said he could and would arrange plumber to reinstall toilets and hot water heater, Confirmed by text message 7/17/13 the afternoon before job completed. Came home at 4pm 7/18/13 to find no functional toilet or water heater and a text message to call [redacted] Emergency Services (XXX)XXX-XXXX. I had clearly and repeatedly told [redacted] that I don't get cell reception where I work so I didn't get the message til I got home. I called [redacted] but he had no plumber to send out. It took me 2 hours to locate a plumber to come out after hours at premium cost. If [redacted] had been honest with me even as late as Wed afternoon when I texted request for confirmation that he would arrange for plumber I could have arranged my own plumber ahead of time.

Also this company is absolute when they include clause saying they are not responsible for any damage. They damaged a door jamb, flexible plumbing tubing for toilet connection, and left adhesive on counters and walls. Payment $2774.22 made by check issued directly from USBank made per contract and invoice #2125.

Literally and legally I have no basis for claiming breach of contract, but the circumstances of an uninhabitable dwelling due to lack of a functional toilet that I was left in resulted from exceptionally bad customer service, including frank dishonesty. [redacted]'s conduct was reprehensible.Desired Settlement: I want company to pay me the $300.71 it cost for the emergency plumber who reinstalled one toilet. I am not asking to be compensated for duress related of left without a functional toilet or hot water and having to make arrangements for a plumber on an emergency basis because I had nowhere else to stay.

To protect future customers I would like the company to be much more clear about exactly what they will remove in the process of the job. They did not tell me they would remove baseboards, doors, and rip up adjacent carpets. They should be explicit when advising a customer what the customer must arrange and be honest about it. Don't leave the customer in the situation I encountered.

Business' Initial Response

We regret the inconvenience this situation has caused Ms. [redacted]. There was miscommunication about the re installation of the toilet, on our end, and we refunded her the amount requested. We also addressed the issue of Ms [redacted] perceiving that the estimate was inflated to cover the 10% discount we were offering and that issue has been settled to her satisfaction as well. We were bid against other companies, therefore we have to assume our pricing was competitive and fair, as the estimate did not change after the initial agreement was made. We have made adjustments internally on how we communicate the abatement process to the client to ensure this doesn't happen again.

Consumer's Final Response

The business owner called me Monday 7/29, arranged to meet with me today 7/20 and provided reimbursement for the after hours plumbing bill and apology for the poor communication from an inexperienced customer service representative. This customer is satisfied with outcome.

Thank you for the appropriate venue to get this issue resolved.
