I would not have left happy if they had actually informed us about their policy with electricity Then saying we were informed of this is a complete falsehood Nick told us that the application fees were waived when we signed up, and we put a $deposit down only to hold the apartment only to have them lease it to someone else two days later Nick said when we paid that he'd have to take the payment for the application separately because they needed to run it to get us started in their system, but that he'd deduct it from the deposit so the cost would be the same either way I have reciepts for the transaction that are attached to this claim showing that the application fee was $and the deposit was $100, showing that the $they are claiming for application fees is a complete fabrication The application was also only put in with the understanding that there was actually an apartment there to move into They didn't hold the apartment as they were supposed to, but then said we still owe money for applying They didn't hold up their end of the bargain and now they want me to pay as though they had

[redacted]' complaint. Please be advised that Mr. [redacted] and his girlfriend visited our office on Thursday, November 5, 2015 and not on November 6, 2016 as his complaint states. They indicated that they were interested in a one bedroom apartment and as per our normal practice we showed them three apartments. We are required to give the same tour to each prospect and including the same instructions on our policies and procedures. During the tour we discuss and show the amenities that our property includes. During Mr. [redacted]' tour on November 5, 2015, Mr. [redacted] and his girlfriend were told that the units include all utilities and it was mentioned at that time that the electric was paid up to $110.00 per month. After the tour, while in the office, the leasing agent also explained what our fees and our specials were. The couple seemed happy and were willing to fill out the application at that time. Application Fee: Our standard application fee is $50.00 per person regardless of whether they are the applicant or just an occupant as we also run background checks on all persons residing on our property. As I was still processing your application, as per your request. another application came in for the same apartment along with the full deposit. Unlike yours, that application came back with no exceptions, and since they had paid the deposit in full we are able to take the property off the market. Since that apartment is no longer available I was going to suggest two other units that are both similar in square footage and price. One rents for $1169.00 the other for $1179.00. You can go to our website and see floor plans for both units 1815-112 and 1806-206. As I'm sure you remember when filling out the application, application fees are non-refundable. This is because we incur costs once the process begins. Any admin fees or deposit you pay would be refundable if your application is not approved or you don't enter a lease agreement. The overage that you paid above the costs of the app fees was $49.00 which we are more than happy to refund to you by mailing a check to you at your current address. If you decide you would like to view the other one bedroom units, please let me know. Review: On 11/6, I visited this leasing office and was told that we wouldn't have to worry about an electric bill because the apartment was all inclusive and electricity was included in the monthly cost. This heavily affected our decision to move there based on how much electricity costs have risen over the last few years. We paid an application fee and a deposit totaling 152.57 to start the application process and hold the apartment, and left very happy. Later on in the day, we looked at some reviews of the apartment complex and found some complaints that tenants were being charged overage charges on their electric bills, so we called the complex to find out how this could occur. They told us that electric was only included to the first $110 dollars, and after that, it was the tenant's responsibility, which stood at odds with what we had been told earlier.They said that complex had never gone over the $110, so we had nothing to worry about provided we used our electricity responsibly, and I asked for them to provide numeric data to prove this claim. They provided this information on 11/9, and the information showed that the bill had gone over three times in the last two years. They also informed me at this point that my application had been denied due to my bad rental history - a few calls and questions on that revealed my current rental office had provided them with incorrect information. I called my rental office and had them fax the correct information over on the same day.Today on 11/10, I got another call from 18th Street saying that they had leased the apartment to another tenant that wasn't as problematic (the problems in question were the fact that my rental office had sent the wrong information and my aforementioned dissatisfaction about the initial misinformation regarding the electric bill) despite the fact that we had a hold on it, and would only be willing to refund $49.00 of the fee.Desired Settlement: I would like the fees returned to me, as they were charged under fraudulent terms - they misrepresented the costs associated with the property before the fees were paid, and did not hold the apartment, which was part of the cost associated with the fees.
