Review: On 5/14/2013 1st Choice installed new gutters, gutter apron and downspout. I paid $2100.00 for the work (w/a 3 yr guarantee)& charged on Capital One credit card. First rain after install 5/22/2013. The gutter length over front of house (cement porch) was sagging and water was pouring from behind the gutter and cascading/splashing onto my cement front porch. The gutter length on the back side of the garage (over deck) water pouring from opposite end of gutter-not where down spout was. I emailed ([email protected]) that day. After several emails back and forth requesting fix, the major gutter issues were mostly resolved by end of July 2013. However, water was now streaming between gutter and house onto kitchen window and the master bedroom window. More emails and promises of repair. Lost patience & initiated dispute w/ Capital 1 8/29/2013. Capital 1 requested a second opinion. After inspection from other PA gutter contractor, they wrote a letter indicating that due to "improper gutter apron installation, my roof shingles were compromised by contractor when nails were driven through the shingles exposing the roof and wood decking to water, which would cause permanent damage over time". Cost to repair/replace 3.5 square shingles, felt paper and ice shield (apron)= $1683.36. Dispute remains pending with Capital 1. Issues: Very poor install/workmanship. 2. Very poor response time to correct issues. 3. permanent roof damage. 4. 3 year contract would have expired by the time roof damage would have become evident. Photos and all emails communications available.Desired Settlement: $2100.00 permanently credited to my credit card account so I can use the money to have my gutters re-installed correctly and an additional $1393.00 from 1st Choice Building Co to have my roof damage repaired by a licensed roof installer. See attachment with total cost (3493.00).

Thank you for the opportunity to respond to complaint ID [redacted]. Before we address the specifics of this issue, I would like to say that we have been in the construction and home improvement business for 29 years. In that time we have performed nearly 2000 projects and have never had a complaint filed with the Revdex.com....until now. No company or individual is perfect, and construction issues are not always as they appear. We strive to deliver the best solution to our customers’ needs at an affordable price, and guarantee all work, and always back up our guarantee. In other words, if something goes wrong; we come back and take care of it... .if given the opportunity. If we are not informed of the issue, or we are barred from the property, it is impossible to take care of it. I. We performed the work (May 2013) as proposed and agreed to by homeowner. We installed 4 gutter sections. 2 upper and 2 lower sections. We actually reduced our initial price to homeowner to stay within her budget. 2. All work was guaranteed in writing for 3 years. 3. Homeowner called after work was complete (May 2013) to report problem with front gutter and downspout. We responded and took care of the issue, thereby assuring customer we service our work 4. Homeowner emailed us (June 2013) saying all was good with the repair, but the back low gutter was dripping from behind the gutter, at end, over kitchen window, and that the issue was “not_maior”(email correspondence available), and to stop by,” the next time we were in her town.” 5. Homeowner sent email (July 292013) asking when we would be out, as she was still waiting. 6. We responded (same day) saying we would indeed be out shortly, but we had not been in her town yet. 7. I placed a call to customer (Mid-August 2013) informing her we would be out soon to take care of “minor issue” 8. We went out 13 days later, ( August28 2013) and found a hole in her roof 12 inches above where back lower gutter was having problem. This had nothing to do with our work, and looked to be the most obvious cause of problem; we repaired it at no cost to homeowner. 9. We did not hear from homeowner again, so we assumed problem was fixed. 10. Next (Early September 2013) we were informed that customers credit card company had deducted $2100.00, (total price of entire job) taken out of our checking account, with no prior notice, until a dispute was resolved. II. When I contacted customer to tell her she should have let us know if there was still a problem, and we would have investigated it further. She let us know me that she did not want us to do any more work on her house for the following reasons: I. She sun we drove nails through roofto attach our work and the roofwould be conwroniised over time. - I informed her that these attachment points were not done hi’ us. They were already there from the previous gutter installation. We simply reused them to attach our work and sealed them up, as they were previously unsealed. If there was not a problem, with the roof, after all the years the attachment points were there....unsealed, there would not be a problem after we sealed them up. The only other way to do it would have been to remove a large portion of her roof and replace it Considering we had to reduce our initial price to meet her budget, we did not want to ask her for well over a thousand dollars more to do this work. What we did was the most cost effective solution to her problem, considering existing conditions, and we guaranteed it This is an acceptable practice, routinely done, in situations where there is an existing condition in place. Since we did not make the holes, her contention here is invalid. Her and her contractor’s assumption that this would cause a problem after our 3 year warranty expired is not true, and has no basis in fact II. She said the back lower sutter was still drlppinp behind after our rwair. The hole we repaired was the most logical fix for this problem, and needed done anyway. There was no way for us to know it was still an issue, as she never called back. I later found out that another contractor told her the gutter was twisted causing the issue. We disagree. I informed customer, that if she would have notified us, we would have replaced entire gutter section if need be. The most likely cause of the overflow is a clog where the downspout goes underground (unrelated to our work). The condition warranted further investigation, which we were prepared to do,,,,, if we were not barred from the property. The Revdex.com is requesting our co-operation to make a good faith effort to resolve the dispute with this customer, to avoid any legal dispute. Our good faith efforts are as follows: -Performed the work as proposed and issued guarantee of the work -Responded with service call both times customer requested. -Made a repair that was outside the scope of our work for free. -Offered to replace entire lower back gutter if need be. -Offered to investigate further if gutter was not the problem. The homeowner’s actions were as follows; -Had $2100.00 deducted from our checking account within days of our last service call. -Did not give us any notice that she was still having a problem. -Blamed us for a pre-existing condition on her roof. -Demands we pay for her to get new roof shingles. -Barred us from performing any work on her property. I feel we have operated in good faith here, even though we are out the entire $2100.00 for the job. If the homeowner would have simply contacted us to let us know there was still an issue, we would have repaired it, and all work would still be guaranteed. So in conclusion, since we have no pay for the job, and we are not allowed on the property, I am not sure what more we can do at this point If the Revdex.com has any recommendation’s we would be happy to listen. Poor workmanship and lack of timely response prompted me to file a dispute with Capital One 7 days (August 29, 2013) after mVlast email to Tht Choice Building Went unanswered. 71~thoice claims in response to Revdex.com that he was on my ? property August28, 2013 to fix a hole. This was done without my knowledge and without my permission.) In any case, it did not fix the problem. Capital One responded to the dispute directing that I get a second opinion. In the meantime, the credit card company provided a temporary credit for the cost of the install, $2100.00. I obtained a second opinion from another licensed PA contractor, [redacted] Contracting. Please see attached. It was then I discovered that my roofing shingles had been compromised when the gutter apron was installed by l~ Choice. It was now more than a poor gutter install issue. (1fl Choice claims in response to the Revdex.com that there were already holes in my shingles made by the previous installer). This is not true. I had a new architectural asphalt shingle 30 year roof installed in May 2000. In July of 2003, Home Depot installed soffit, fascia and gutters installed. There was no gutter apron installed at that time. The roof was not involved. (See attached copy of Home Depot contract). Furthermore, if indeed there were holes in the shingles as 1g Choice claims, it was the contractor’s responsibility to have advised me of this and allow me to decide the next course of action. Also, it is logical to think that if indeed the shingles had holes per previous installer as l~ Choice claims — the roof decking would have suffered damage after 10 years of rain and snow. Nothing of damage was mentioned by 1St Choice nor was there a note added to the contract disclosing of this damage nor my acceptance of it. The issue with the shingle holes was first mentioned in defense after I initiated dispute with Capital One. In addition, ~ Choice also claims to know my budget I never discussed my budget with l~ Choice I simply negotiated from the original quote of $2300.00 down to $2100.00 which was accepted, plain and simple. I do not trust l~ Choice’s workmanship nor dot trust the business practices with regard to this install, therefore remedy by this company would not be acceptable. Effective 1/23/2013, I received notification from Capital One that they have issued me a permanent credit of $2100.00 based on information provided. I am now seeking $1393.00 from 1g Choice to repair the damage to my roof

The homeowner continues to contend that we nailed through her shingles to attach our gutters. This is untrue information. As I stated previously, the holes were already there and we simply reused them. To be more specific, the previous gutters (installed in 2003) were installed using a strap type gutter hangers that attach to the gutter, and extended up on the roof, and were nailed through the existing shingles. These were the very same holes we used to attach our apron, which we slid under the shingles. As I stated previously, these holes, for the gutter straps, were there for 10 years, unsealed, and there was no problems with the roof. When we re-used the holes we sealed them up. If the holes were there 10 years unsealed, with no problems, there would not be any problems after we sealed them up. The homeowners, presumption based on misguided advice, that this will cause problems in the future has no basis in fact, based on the actual 10 year history of the original gutter installation. We did all the work as per contract, and guaranteed all work. We responded both times the homeowner called for service, and would have continued to do so. The Homeowner says we did not respond, the record clearly shows we did. She proceeded to have her credit card company deduct the $2100.00 from our checking account so she has been refunded the entire job amount. We were in the process of servicing her project when this was done, and were given no notice. Although we do not think it is right, there is very little we can do about it. At this point, the homeowner has been refunded the entire job amount and does not want us on her property, so there is nothing more we can do her. She has new gutters installed on her house at no cost. If there would have been any problems, with any of the work we did, we would have fixed it, period. As I stated in my last letter, I have been in this business (home improvement) since 1985 and have done nearly 2000 jobs, and have never had a complaint with the Revdex.com...Until now. I am truly sorry this homeowner is not happy, but she is relying on untrue information, misguided advice and presumptions about what is going to happen in the future. 2/25/2013 1st Choice continues to contend that they did not nail through my shingles to attach the gutters, that “the holes were already there and we simply reused them”. Gutters are attached to the facia/house not through the shingles. Gutter aprons are installed under the gutters not through the shingles. If “the holes were already there”, that would have been the time to advise me. Mr. [redacted] did not advise me. Unless 1st Choice can provide proof of the previous "holes", 1st Choice is responsible for the damage to my roof. Furthermore, the water continues to run in between the gutter and the house along the full length on the backside of the house (second story and first story). During this freeze, I have taken pictures of icicles hanging from between gutter and the house and icicles clinging to my screens and windows. The water streams between the gutter and the house heads toward my foundation. The entire gutter install/gutter apron has had problems from the start and will have to be redone correctly. 1st Choice blames the previous gutter installer and alleges that I received “misguided advice” from the other PA contractor (on Revdex.com record). Mr. [redacted]’s opinion contradicts the written consultation. Mr. [redacted] also states that he has been in business for 20 years without a complaint. I have lived in SW Butler county for over 23 years and have hired different contractors to work on my two homes. I have never filed a complaint against any of these contractors as the work was done correctly and to my satisfaction. At this point, I want $1,300.00 from 1st Choice to fix my roof.
