March 30, RE: Case ID *** Ms*** As you can see by the attached documentation Mr*** has felt the need to recant his story to not only your office but to the Office of the Attorney General and from what he told the owner his bank as wellWe stand firm in our
actions and that there has been open communication with Mr*** surrounding this matter; attached you will find documentation to support this opinion Please allow me again to place events in chronological order for you and Mr.***He Is correct in that he has belonged to the facility since September 2014; as you can see by the attached contractBased on that contract you can see that dues are processed the first day of each monthOn July 1, Mr. ***'s credit card expired, we carried a balance due for his members the next three monthsThe owner approached Mr*** about this matter and received a new card to process these membership feesThat transaction occurred on October 27, for $119.91, three months at $please see attached transaction On October 4, Mr*** did indeed file a cancellation of his membership with notification that he would be moving to a Prime Card; a benefit offered by *** *** which we participated in at the timeHowever, between this time and October 25,we were forced to remove the Prime Card benefit from our facility due to lack of member complianceMr*** was informed of this change by the owner and as you can see by the attached email approved us to "just re-instate me" which was completed on October 27, 2016, at his original membership feeAt no time was the Prime Card program billed for any fees under Mr***'s name On January 21, Mr*** notified the owner that he had lost his position with *** *** and needed to cancel his membership for financial reasonsAt that time the sixty day cancellation was activatedHe was charge a membership fee for February and a prorated amount of $for March to comply with the day termination stipulation within the contractBased on the actions taken, documentation provided, and on various emails exchanged we do not feel there is a need for further action on our partWe appreciate your prompt attention to this matterRegards, Jania G*** Office Manager
