I have read the complaint...

by Mr. [redacted] and had previously talked with him about the circumstances on 8-18-14. I offer the following rebuttal and statement of facts.
Mr. [redacted] cosigned on this loan (account [redacted]) for [redacted] on 3-19-13. The first payment was due on 5-2-13. The first payment was not made by the due date and we started collection calls on 5-9-13 to [redacted], the primary borrower on 5-9-13, seven days after the due date. We first made contact with her on 5-14-13 and she promised to make the payment on 5-16-13. When she did not make the payment as she promised, we called her again on 5-20-13 and she told us she would bring in the payment on 5-30-13. We called her on 5-30-13 and she said she would bring in the payment on 5-31-13, which she did not do.
On 6-3-13, we called [redacted] and Mr. [redacted] and left a voice mail for each of them. We called each of them again on 6-4-13 and talked to Mr. [redacted] and left a voice mail for Ms. [redacted]. When we talked to Mr. [redacted], he promised to bring in the past due payment on 6-7-13. At this time there were two payments contractually past due, 5-2-13 and 6-2-13. Mr. [redacted] did not bring in the payment as promised on 6-7-13. Ms. [redacted] returned our voice mail on 6-4-13 and said she would bring in a payment on 6-13-13. Ms. [redacted] paid $160.00 of the $283.10 that was contractually past due on 6-13-13. Mr. [redacted] still had not brought in the payment that he promised to bring in on 6-7-13. When Ms. [redacted] paid on 6-13, she promised to return with another payment on 6-28-13.
The account continued to run past due and on 8-23-13, Mr. [redacted] came, to the office to make a payment. On that date the account was past due for the 7-2-13 and 8-2-13, each of $130 for a total of $260. Mr. [redacted] only paid $43.00 on 8-23-13 to pay the past due interest for the 7-2-13. On that date, he said
I know she is having a hard time and will tell her to call us to make future arrangements for the August payment”. The account continued to run past due in September and October and we again talked to Mr. [redacted] on Thursday, 10-24-13. When we called Mr. [redacted] about the past due payments he said “he would talk to [redacted]’s Mom that weekend and see that it got paid". We again called Mr. [redacted] on Monday 10-28-13 and left a voice mail for him which he did not return. We again called Mr. [redacted] on Tuesday 10-29-13 and he advised he would be in later that afternoon to pay. He did not bring in the payment personally but [redacted]’s Mom brought in $130 to pay for the past due payment for 9-2-13 and told us that [redacted] would bring in the October payment the following day. These notes are documented in the electronic history of the account, time and date stamped, and prove that Mr. [redacted] was aware that the account was past due and that he was not interested in making good on his pledge to make the payments as promised per the loan agreement but rather he considered it "her" obligation.
Furthermore when Mr. [redacted] first made these complaints to our company by e-mailing us on Saturday 8-16-14, I called him to discuss them on Monday 8-18-14. When I asked him about his signature on the loan agreement with 18 payments of $130 and how that could be only a $500 loan, he said "well, I guess I was in a hurry and didn’t pay attention” and "I guess that I could pay it off but then I would be in the same boat as you all and not be able to get my money back".
To conclude, Mr. [redacted] signed a loan agreement of which he is not disputing, that clearly shows the loan terms including renewal balance, cash advance, due dates, payment amounts and the number of payments. Mr. [redacted] has been aware that this account has been past due since the very first payment came due back in June 2013. I can only guess as to why it has become important to him now that the account has been past due and would affect his credit as he had previously show obvious disregard for these matters. Please note that our collection efforts are electronically recorded and have time/date stamps associated with each contact that is written in the history record for the account. If any of this is questioned, a representative from the Revdex.com/or Mr. [redacted] are welcome to come to our office at 200 Sycamore St Elizabethtown, KY to view and validate them as well as on the loan agreement, of which he is not disputing is indeed his signature.
