Initial Business Response /* (1000, 5, 2015/11/02) */
*** *** purchased this vehicle from us on Monday October His wife called me a week later on Monday October and stated that over the weekend the check engine light came on and the vehicle cut offShe stated that car cranked back
and she drove it home and that she was coming to get her money backI told her that we would not refund the money but we would check the vehicle outShe told me that she did not want us to check it out that she just wanted her money backI explained to her that NC was a state that did not have a resending period on vehicle purchases but again explained that we could check the vehicle outShe said she would call her attorney and news ** She came in around lunch time and I ask her had she decided to let us check the vehicle and she said again that she was there to get her money backI explained again that we were not going to do that but we would check the vehicle outShe called her husband on the phone and stated that I would not check out the vehicle which was a total lie and we had other people in the lobby that was witness to the conversationI ask her could I speak with her husband so that I could tell him what I had really saidWhen I told Mr*** that we had agreed to check the vehicle his response was well it sounds to me that she should let you check itShe again left with the vehicle without getting it checkedLater that afternoon she came back and stated that she went and had it checked and that it showed cyl misfire and also that her mechanic stated that the vehicle should have never passed inspection without a check engine bulbI reminded her that she already told me earlier that the check engine light had come onI explained to her that if it did not have a bulb the light could not come onI walked her out to the car at that time and showed her that when you crank any car all the lights come on and then go back offIn this case the check engine light worked properly it came on and went back off as it was suppose toI ask her who the mechanic was that told her that and she refused to tell meShe did finally agree to let us check the vehicleWe do have the factory *** computer here at our facility and when it was hooked up it showed no current codes and as I stated above the check engine light was not onIt did have a history code for cyl misfire which means that at some point the light had been onPossibly the previous owner could have replaced plugs or wires or something of that nature but nothing showed currentWe drove the vehicle miles because she stated that we needed to drive it at least miles and no lights ever came onVehicle drove fine
I called *** and let her know that we did not find anything and that *** would have to come and pick up vehicle because he would have to sign a Good Will Repair acknowledgement which just states that we checked the vehicle free of charge for them and that by doing so that we are not implying any warrantyI have checked with the Department of Motor Vehicles and ask them what happens if they do not sign the form and they said it implies I am giving warranty so if they do not want to sign paper showing we were doing it for free then the other choice was to charge themThey refused to do either so they left the vehicle hereWe have held our end the agreementThe car is his upon signing Good Will formWe strive to maintain a business with a good name and we understand that you can not please everyone but we feel we have tried
Initial Consumer Rebuttal /* (3000, 7, 2015/11/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We only want to talk about facts!! We put down on car on 10-12-2015.Did not pay car in full until Thursday 10-15-2015.Car engine light came on Saturday 10-17-would not go off and car cut off took a while to start back, then after started back wife drove homeMonday wife called and talk to owner Kim B***.Kim said it's your car your problem.Wife still took car to her.kim said she was not going to do anythingIn lobby kim was loud and refussed to do anything! and Wife called me because she ran outside afraid.Wife said she had a big tall man standing beside her and four of her employees on her side.Wife took car to another shop. The owner of that shop said car would not pass inpection.Wife took car back to Kim at that point wife showed light was on to kim. Then kim said she would check it out.Tuesday Kim called said nothing was wrong with car. When we went to pick car up they had two papers for me to sign.I refused. The salesman who sold us the car was in it,when we refused to sign the papers they said we could not get the car back. The salesman drove car back in fence that's locked. They have had car sense 10-20-2015.They told my wife she could not call or come because it's not her car. This has been stressful on me and my family. We just want our money or car with warrities days back!
Final Business Response /* (4000, 9, 2015/11/13) */
Again the facts are that Mr *** purchased the vehicle on 10-which I have a copy from *** of the deposit slip where the certified check was on our 10/deposit which cleared the bank on 10/As far as the man who was in the Lobby with Mrs *** and I he was not an employee he was here making a sales call for the Insurance Company that he works for and he is 5'and weighs pounds and has offered a written letter confirming my actions of telling Mrs*** that we would check her vehicle out
Also as far as Mrs *** being afraid of me this is as far from the truthI walked outside and had a pleasant conversation with her and she even apologized for her behaviorWe even talked about her blood disorder that she told me she hasShe explained to me how it came from Africa and that both her parents had it and I told her I was sorry to here about that and that I hope all went well with herDoes that sound like someone who was afraid of me to share all that information with me
If you will reread the complaints that have been filed you will see that they are contradictingHow can the light be on and stay on and at the same time not have a bulb in it as they stated that should not have passed inspection due to thisMr and Mrs *** went to visit with the NC DMV inspector and he explained to them what the Goodwill repair acknowledgement letter was and that the choices were to sign it or pay us to check the vehicleThey chose to come by and pay us for checking the vehicle and picked the car up on 11/They came back again on 11/and dropped papers off stating that the check engine light was back on and left me a hand written letter that stated they wanted vehicle fixed
I called and left them a message to call me backI was not in when they called back but they spoke to Denise and they were suppose to drop vehicle off that afternoonMrs *** also ask about the in house warranty that would expire on 11/and Denise told her that since the vehicle would already be here before the 12th that it would still be covered even if the vehicle were not ready on the 12th
They did not drop off vehicleMrs *** called back on 11/and stated that she didn't bring vehicle back because she read the warranty and didn't think we would cover it even thou we had already told her that if she brought it in on 11/we would go 50/on it
Again I feel as thou we have been more than fair in trying to help the *** even thou this was not something that would have been covered under their warranty
