1st Quality Construction of Ellenboro, WV I would like to cover some background information and dates that pertain to this complaintI am a homebound, Navy Veteran with 100% physical disabilityI am wheelchair-bound because of extreme neuropathy and diabetesBecause of my condition, I require a daily caregiver ( [redacted] ) that comes to my homeBecause I have limited interaction with the public, I have come to rely on my caregiver for daily care, trust, and friendship In January 2015, I noticed severe water damage in my kitchenI contacted my insurance companyAfter quick interaction, I was promised a check for $9,to cover the damage [redacted] championed for her husband, Allen S [redacted] of 1st Quality ConstructionHe assured me he could do the job within 7-days I trusted her and agreed to hire him He immediately began his communication with the insurance company, talking directly, sending and receiving informationWhat appeared during the onset was a skillful couple helping one in need, was really a couple working in tandem to take advantage of a disabled Veteran The insurance originally paid $9,for the following which is extracted from the estimate of 1st Quality Construction: Removal (from estimate) of the wall cabinets, base cabinets, counter tops, range hood, and sinkReplacement (from estimate) of the counter tops, range hood, ceiling fan with light kit, light above sink, new installation of GFCI electrical outlets as per code, walls behind sink and all water damaged areas will have insulation removed and replaced after being treated with mold control agent, finish all drywall and paint kitchen, all damaged sub floor will be replaced with yrwarranted advan tech flooringAll existing tiles will be removed, and 1/4" hardwood underlayment will be installedFloor covering will be with quality vinyl floor tileAll products and finishes will be choice of home ownerEstimate includes two bowl stainless steel sink and all plumbing; including faucetAll cabinets will be screwed together, and top will be screwed to bases Estimate includes all disposal and deliveryEstimated time frame is approx- hours, which includes finishing cabinets, delivery, etcAll work is 100% satisfaction guaranteedAn additional claim was submitted to the insurance company for work outside the house totaling $1,Per 1st Quality Construction’s estimate to remove siding and damaged sheetingReplace damaged studs, insulation, exterior sheeting, and wood sidingEstimate includes painting sidingPrice includes disposalEstimate includes replacing exterior electric outlet with GFCIAllen never showed me any receipts of purchased items so I am not sure if he actually used [redacted] ***, for example, or how much anything costA third estimate was submitted to the insurance company for $for sill replacementThree payments from the insurance company: $9,244.00, $1,663.00, $totaling $11,Three payments to 1st Quality Construction: $6,000, $3,000, $totaling $9,An amount of $1,was withheld or not paid to 1st Quality Construction because Allen left abruptly without repairing or fixing the areas that were done incorrectly or were not finishedHostile relations developed, [redacted] quit in mid-shift and I was without a caregiver for over two weeksAllen left with the following problems still existing with my home: These areas are: The tiles in the kitchen began coming unglued within days of completionPhoto #The space between the wall and dishwasher was measured incorrectly which left a gapAllen put wood in these areasPhoto #The wood on the cabinet sticks out on the left sidePhoto #The floor tiles were placed over the heating ventPhoto #The counter top was broken and re-gluedPhoto #The corner cabinet on top was angled away from the wall instead of flushThis resulted in a gap which Allen put a board on top and below to fill the gapPhoto #The bottom cabinet has a gap with a board on top of itMy cat got into this hole and was unable to get outPhoto #The outlet was not covered with a face plateThe wires are hotPhoto #There is paint splattered on my electric chair and the wood floors adjacent to the kitchen tilesPhotos #9-#There is paint on the wood trimPhoto #The cabinet knobs are not what I orderedI ordered a rope design (hence the Navy inspiration)Refer to pictures of the cabinetsThe outside of the house was not paintedPhoto #Quarter round was old and broken with a sharp edgePhoto #Photo of ***’s footHe had to go into the hospital for surgery because he had hit it on something (unable to feel it/possibly the sharp quarter round) causing a huge chunk of foot to fall offThis required surgery to scrape the bone and remove chunks of debrisPhoto #One of the floor joice was attached to another but rotting wood still existsNot sure if mold agent was usedPhoto #Can see daylight from the basement to the outside where Allen workedPhoto #The original job estimate was opened on January 26, Allen was still working on the project as of April 23, 2015, when he refused to fix the problems and walked outHe and his wife have cussed at me over [redacted] and have caused my home owner’s insurance company to cancel my coverage – a 18-year relationship is ruined because of Allen’s poor ethical standards - a consistent character trait all the while he is employing a family member paud under the table because he is receiving disability payments I have contacted another contractor to give an estimate on fixing the damaged areasThe remaining insurance money will be used to correct Allen’s mistakesAllen has stated I received over $3,worth of free laborI have not received anything from Allen that I have not paid for; however, I will not pay him for things that are not done right or are broken Regarding his wife/and my caregiver, over a ten-month timeframe as my caregiver, I gave her family gifts totaling over $1,(57" Samsung high definition flat screen television set, Galaxy tablet, numerous lunches and a few for Allen as well, and I paid first payment on their new refrigerator) It appears that those who we rely on the most, knows our very most personal information, our weaknesses, and vulnerabilitiesNot unique, I imagine the elderly and disabled can easily be taken advantage of by many I would like my complaint to be registered with the Revdex.com in hopes that others don’t become a victim of 1st Quality ConstructionSincerely, [redacted] Attachments (photos) [redacted]

[redacted] has been asked to purchase a new faucet and have at it his job site to install and we would then also complete the other finishing touches to his workWe have asked him to do this on a number of occasionsThe faucet he picked out and purchased was to tall for the interior shutters so the shutters do not openWe offered to perform this work free of charge so long as he purchases the faucetHe also given us the parameter of only starting work at noon each day, which he changed from 10amHe is the only customer that we agreed to start at 10am withOur working hours are 7am-3:30PMWe feel that we have tried to resolve the issue in an amicable way but he has not complied with our request to have the faucet their so we do not have to send guys on multiple tripsAlso, we would like to be able to work a full day their at his houseAt his point mediation would be helpful

Parcel number *** belongs to *** and *** *** of ***, ***. A mechanics lien has been filed and will be foreclosed upon. As a response to this complaint without jeopardizing process of discovery, the following statement is made: This is a insurance
claimMr*** transferred the money into his account, spent part of it, and did not pay the balance due upon completion. Mr*** received over $3,worth of free materials and laborAll obligations of insurance claim was metWithout a third party inspection of the property; these claims are without merit! They are only accusations based upon the fact Mr*** does not want to pay his bill! He spent money that did not belong to him, and now he is filing frivolous complaints!

We will hire a WV home inspector to inspect the home if Mr*** AgreesCurrently we are preparing to foreclose on the lien. 1st Quality Construction is a Limited Liability CompanyAny names and personal references will be considered in a defamation suit against all involved if this practice is allowed to continue!! If the insurance has dropped Mr***; it is because the entire claim was not handled correctlyThe adjuster never inspected the home prior to the claim or afterThe check was wrote to *** *** and not the bank holding the mortgage and the contractor doing the work! Mr*** had no legal rights to even see the claim money let alone spend it as he did! If I was not forbidden on the property; I would have completed the punch list which included painting the siding and installing the switch cover; which is in the dining room, which was not a part of the claimAs with the paint on the floor, which is in the hallway. If Mr*** is claiming he was injured from my work; he needs to contact my Insurance company and file suitUsed 1/round? I don't use used items in my work? All oak 1/round was purchased and stained to match cabinetsMr. *** has no rights to any claims as he does not own the property; he is only a tenant! I guess since Mr*** can no longer taunt and provoke me on *** ***; he has found a new media!

He assured me he could do the job within 7-10 days.  I trusted her and agreed to hire him.     He immediately began his communication with the insurance company, talking directly, sending and receiving information. Estimate includes two bowl stainless steel sink and all plumbing; including faucet. All cabinets will be screwed together, and top will be screwed to bases.  Estimate includes all disposal and delivery. Estimated time frame is approx. 88 - 106 hours, which includes finishing cabinets, delivery, etc. All work is 100% satisfaction guaranteed. An additional claim was submitted to the insurance company for work outside the house totaling $1,663.00. Per 1st Quality Construction’s estimate to remove siding and damaged sheeting. Replace damaged studs, insulation, exterior sheeting, and wood siding. Estimate includes painting siding. Price includes disposal. Estimate includes replacing exterior electric outlet with GFCI. Allen never showed me any receipts of purchased items so I am not sure if he actually used [redacted], for example, or how much anything cost. A third estimate was submitted to the insurance company for $928.62 for sill replacement. Three payments from the insurance company: $9,244.00, $1,663.00, $928.62 totaling $11,835.62. Three payments to 1st Quality Construction: $6,000, $3,000, $859.62 totaling $9,859.62. An amount of $1,976.00 was withheld or not paid to 1st Quality Construction because Allen left abruptly without repairing or fixing the areas that were done incorrectly or were not finished. Hostile relations developed, [redacted] quit in mid-shift and I was without a caregiver for over two weeks.
