Instead of address Mr*** letter point by point I will plainly state our perception of the events
Mr*** and Ms*** hired us to remove all vegetation from their backyard except the existing fruit trees We initially gave them a bid for the removal in both the front and
the back and new landscaping in both the front and the back It is a section from this larger bid that the estimate Mr*** refers to is from and does not include everything that we were asked to do and did
We did the work in good faith and completed the job.
We took out five yard dumpster loads (loaded to yards) of weeds, sod, rock and other debris Their backyard had no existing topsoil or irrigation system and it was because of this that Ms*** wanted everything removed so that she would have a “clean slate” to start over with
Even if the estimate was not take out of context it states clearly that clients will be billed for ACTUAL time and materials We do not mark up materials or equipment rentals
On May 26th Mr*** asked for yet another detailed invoice of the costs of the project, which I provided, and which is the final invoice of $ The total that I asked Mr*** to pay to was $with us absorbing $in hard costs just to be done and move on.
I was willing to settle for a final payment of $ but Mr*** was unwilling to do this He did offer $which I was unwilling to accept and have reserved my right to take him to small claims court and file a lien against his house.
Regarding the slew of counter claims of damage to the backyard, front yard and fence This is all just hubris on the part of Mr*** to avert attention from his unwillingness to pay us and I will counter these claims in court where I am assuming this is going to end up
