Thank you for the opportunity to respond to the allegations being made against this company. I am attaching a copy...

of the Management Agreement with [redacted] for the property located at [redacted], Grants Pass, Oregon which took effect in October, 2003. I have highlighted the requirements of cancellation by either party of the agreement. I am also attaching all email correspondence that we have had with [redacted] from April 28, 2015 through my last email sent May 8, 2015 which I have had no response to. On April 28, 2015 I received an email from [redacted] copying me emails that she was having with Realtor [redacted] regarding the sale of her property at [redacted] She had made the decision that she would be listing the home for sale. I promptly replied to [redacted] thanking her for the "heads up" that she was listing the home for sale and also that she would need to verify if she was going to leave the tenants in the property or if she intended on giving them notice to vacate. I also informed her that she would need to send management cancellation based on the fact that she was listing the home for sale and that the effective date would be determined by the decision that she made regarding the tenant (we would have seen it through the notice of the tenant if she chose to have them vacate- the reason for determining the effective date of the cancellation). If [redacted] had contacted me "before" she made the decision to list her home for sale to discuss any possible changes that may occur in our management because of her decision, I would have explained our office policy which was made quite some time ago to "not" be involved in homes that are listed for sale with tenant occupants. She could have taken this into consideration in determining "when" she would list her property for sale and take the time she feels that she needs to make other arrangements for the management of her property. She did not do this. From that point on [redacted] became aggressive and accusatory in regard to our business practices. She wanted an explanation which I provided in detail in my email response sent on the same date at 12:18 pm (again, copy attached for your review). Please note that in that email I suggested that she contact another management company who perhaps handled rentals that were also listed for sale or even that she handle the tenants directly since she felt it would be for such a short period of time. She did not like my response. She responded at 2:48 PM with accusations of being unethical and that we were abandoning her. I again responded to her email at 5:01 pm explaining our position and at that time issued her notice to cancel management at the end of May, per our management agreement. I also thanked her for the opportunity to be of service and wished her the best of luck with the sale of her property (we are experiencing an active sales market in our area). In my email of May 8, 2015 which [redacted] did not respond to, I suggested that she contact her Realtor to discuss issuing the tenant notice to vacate the property. I went on to explain that "if' she did decide to go that route, that we may be willing to stay on throughout the notice period and subsequent security deposit accounting. I made it clear again that our business decision to "not" manage homes listed for sale was a business decision and that this decision was not directed at her personally or to inconvenience her in any way. In summary, we have a property owner that for her interest only has decided to list her home for sale. She did not call to discuss this decision and any changes that this decision would result in, in regard to her management services. She feels that she should be able to dictate the business policies of the management company who has overseen her proper(y for over 12 years when that property was "not" listed for sale. She is accusing this management company of thinking ONLY in the Broker's interest. I feel that this client is doing exactly what she is accusing 221 Property Services, Inc. of doing- thinking of ONLY herself and what is good for her- everyone else involved will just have to deal with her decision no matter what adverse effects that her decision may cause to them or their ongoing business practices.
