24/7 A/C Inc. sold me a pair of [redacted] A/Cs with a stated "10 YEAR WARRANTY ON PARTS AND LABOR."
4 years later, they refuse to honor it.
In 2009, I purchased a pair of 3-ton [redacted] air conditioning units from 24/7 A/C, Inc.
At that time I accepted the estimate No [redacted] dated 1/30/2009 for $6,880.00. I signed it on 2/4/2009. . The proposal among other claims stated: "10 YEAR WARRANTY ON PARTS AND LABOR". I signed it, paid for the units, and the units were installed on Feb 9, 2009. The proposal, the sale, and the installation were courteous, fair, and very professional. Every year since, I had the system serviced and cleaned as preventive maintenance by 24/7, and paid for the services performed.
On Thursday, December 5, 2013, one of the units failed, and I called 24/7 for service. on Friday, and after checking the unit, [redacted](employee) told me that the warranty was until 2014, and I was lucky because the fan motor would cost $1,400.00 plus labor of $295.00; but the part was under warranty for another two months, and I should only pay for labor. I agreed, and he came and replaced the motor the next Monday.
On Monday, during installation, questions arose about the units and as I read the contract, and the installation documents, I noticed the warranty statement, and immediately told [redacted] (employee) who then called the office and I was told by [redacted] (employer) that the statement was a "Typo", and no one in the industry in their right mind would give a 10 year warranty on these units. In the discussion that pursued, I discovered that [redacted] warranty is actually 10 years.
I refused to pay the discounted labor charge of $265.00, and then I was told by [redacted] (employer) NOT TO EVER CALL THEM AGAIN. [redacted] (employee) also left me an Invoice No XXXXX for $265.00, with a note on it stating: "UNPAID ALL WARRANTIES VOIDED."
This letter is a complaint about the professionalism of the owners and operators of 24/7 A/C, Inc., and how they tried to charge me $265.00 for something that was clearly covered under their own warranty. And now they are trying to avoid warranty responsibility for the next six years. They cannot unilaterally decide to void a warranty that they are obligated to honor until XXXX-XX-XX.
