Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and the matter has been resolved.
Sincerely,
[redacted]

The final payment of $200 was made today on 3/**/14. Please confirm that you received the payment and that this case has been resolved. Thank you.
[redacted]

[redacted] came into our office on 2/**/2014. She wanted to build a website for $3000. After explaining to her that our company requires a 50% deposit to get started, she said she couldn't come up with that much and...

that she needed a payment plan. So we worked out a payment plan which required a $400 deposit. After discussing our terms and conditions and refund policy, [redacted] signed the contract. The contract specifically states "If client halts work and applies for a refund within 30 days, work completed shall be billed at the hourly rate of $45.00, and deducted from the initial payment." [redacted] left our office at 2PM which gave our designers 3 hours to work on her project for that day. By 5 PM we had 2 homepage designs for [redacted] to choose from. Later that evening (around midnight) [redacted] emailed us saying that she needed more time to think about her project and requested a refund. We told [redacted] that we would refund her back the money, but she would need to reimburse us for the 3 hours of work that we had done. After going back and forth with [redacted], we finally agreed upon a refund of $310 (only 2 hours of work would be billed). We told her that we would send out a check that day. Only a few hours after that, [redacted] changed her mind and said she wanted ALL of her money back, and that she did not want to pay the $90. Unfortunately, that would not be possible because we had to pay our designers for the time they invested in her project. We are still willing to give [redacted] her $310 back, only if she signs a release form with us and removes any third party complaints that she has made.
Feel free to contact me with any questions or concerns,

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

On 2/**/2014 [redacted] and I began our meeting just before 2pm. We were scheduled for 2pm but I like to show up to meetings at least 10-15mins before they start. I have time stamps on emails to prove we were scheduled for 2pm. When I got there, I had him sign a NDA before we talked about anything. He gave me a background of his career and how he started his company “24/7 NY Web Design”. He talked about previous projects he’s worked on; he even showed me some of his work that he’s done in the past. Thereafter, he asked me about my project and what it was exactly that I was looking for in my website. So we started discussing my project in its entire complexity. By the time we were finished discussing my project we started talking about payments. As [redacted] stated, I agreed to the package worth $3,000 and didn’t have the 50% deposit needed to start, so [redacted] and I agreed on me putting only $400 down for now. I didn’t have cash and it cost extra to use a debit/credit card, so I decided to go withdraw the funds from (my bank). The nearest Bank of America from [redacted]’s office is 15mins away, so that’s where I went. I have a time stamp of my withdrawal made from my account at 3:07pm for $400 at the BOA nearest to [redacted]’s office. It was nowhere near 2pm when I left [redacted]’s office. When I got back to the office from the bank it was around 3:40-3:45pm due to slight traffic from kids getting out of school and a small detour from getting lost because I wasn’t familiar with the area. When I finally got there [redacted] was on the phone with another client for about another 20mins right in front of me. When he was finally done we started working on the contract and that took about another 25-30mins. I did not leave [redacted]’s office until around 4:40pm; I know this because I was dreading the traffic I was about to face, on my way out. [redacted] even said it himself, that he was going to contact his programmers “tomorrow” and that he should have a homepage for me to look at (clearly stated in our contract) “on or before February ** 2014” and that the homepage would be completed “on or before March * 2014”. He was evidently in no rush to start because I did not give him the full deposit, he had nearly a month to make a homepage and a homepage should only take about 30 minutes for a professional to create. Moving forward, after realizing my project was not fully prepared to be developed, I called [redacted] around 1am February [redacted] to leave him a message telling him not to call his workers in the morning to start the project; I emailed him that morning as well. The next morning around 9am [redacted] emailed me saying his “designers” already started working on my project and he sent me three links to look at; completely disregarding my request for him not to start the project. So I called [redacted] right after I read his email, he said he had two designers work on my project so he was going to charge me $45 for each of them assuming they both worked on the page for an hour; which he had no proof of when I asked for a time sheet showing that two designers worked on my project. Besides the color and background images, all three homepages looked exactly the same. There is no way you can give two different people a project and you get the exact same results. [redacted] did mention to me, before our meeting, that even when he wasn’t in his office he could receive calls; all of his calls and emails show up on his cell phone so I strongly believe [redacted] did it himself after listening to my voicemail just so he can get some money off of me. If I left his office at 4:40pm how did he have his designers work for the 3hrs he claims they were left with? Also, if he doesn’t have his designers work past 5pm how did the three homepages get created in time for when he emailed them to me at 9:19 in the morning? In his response to my complaint, [redacted], claimed “by 5pm they had 2 homepage designs for me to choose from” that is a lie because, as I said and proved before, I left his office around 4:40pm there was nothing for me to look at before I called with my decision to cancel. I received the homepage designs the next morning after he got my messages for him not to start. [redacted] never negotiated the refund total with me he told me he had two designers work on the homepages and that he was going to charge me for their services at “$45 each because each of them put in an hour’s work”. I know basic coding and web designing and it would never take anyone 3 hours to complete a basic home/login page with no personalized information added to it, let alone a professional. The homepage designs he sent me was in the form of a template. There was no personalized information from me added, besides the heading which isn’t even my name anymore. There’s no way anyone would believe it took 3hrs to create what he sent me. However, in his response now, he’s claiming that it did. On Friday 2/**/2014, After nearly 2wks of back and forth, [redacted] had enough of me calling and emailing him about my refund and mentioned how $310 dollars didn’t make a difference to his company and that he would write out a check, email me a copy of it [before] he sent it out so that I would know it was on its way, then mail it out to me. I never received an email of that picture, instead, on that following Monday February [redacted], I received an email with an apology, form [redacted], stating that he forgot to send me a picture but he sent the check out on Friday, February [redacted] and that I should receive it in the mail “today or tomorrow” which was that day Monday or Tuesday. By this time of his email, I’m already on my way to his office to show him that he was charging me for a scam and that I wanted my full refund back. Still, to this day I never got a check for any amount in the mail from [redacted] “owner of 24/7 NY Web Design”. I don’t have to sign or do anything for what is already rightfully mine. If [redacted] would like me to compromise with him and sign a release form to remove any third party complaints then he will have to give me a refund of the full amount that I am asking for; which is $400. [redacted] is very unprofessional and tells a lot of stories. Before filing my complaint, [redacted] was very rude and kept giving me the run around about my refund. He saw a young girl who believed in her project and took complete advantage of my ambitious spirit. $400 may not seem like a lot of money but for someone who just graduated from college that was hard earned money. He was given ample chances to refund me but he thought he could get away with being dishonest. He gave me too much time to realize who he is and what his company stands for and I despise dishonest companies. I have tried to be fair with [redacted] too many times and it hasn’t worked in my favor, so now I stand firmly behind my complaint and will not waver; I will take this as far as I have to until I obtain my full refund.

Review: [redacted] At 24/7 ny web design took a deposit of $400 from me and even after canceling only hours after I signed the contract, they refuse to refund my deposit. Till this day I still haven't received my money from him. I left a message and an email letting him know that I didn't want to go through with the website anymore and he quickly created a ** home page to charge me for his services. Still I haven't receive any money back from [redacted].Desired Settlement: I get my full refund back.
