Review: I listed my own property for rent on various websites, and 25Realty took my listing and my personal pictures and relisted the property as their own listing. I requested a week ago over the phone that remove their listing, and they had verbally agreed. The listing still has not been removed.Desired Settlement: I would like the agency to remove the listing featuring my apartment, and delete the images of my apartment from their servers.

Review: This letter is a cry for help and justice against 25 Realty LLC and its co-owner - [redacted] also known as [redacted]. On July *, 2013, my husband and I came to 25 Realty LLC at [redacted] with the intent of renting an apartment. [redacted], was the broker who helped us. He told us that we would have to pay a minimum downpayment towards the brokers fee in the amount of $300, and also fill out an application, which we did. He said that the total fee would be around $3,000 and that it would be a good idea if we could put down anything between $300 and $3,000. All we had at that moment was $500 which we paid him with the thinking that we will pay less later towards the entire brokers fee, a copy of the receipt is attached. On the same day we went to see an apartment that [redacted] found for us. We agreed to take the apartment, but 4 days later, on July [redacted], we changed our mind. We realized that the apartment was too small for our needs and we went back to [redacted] to let him know. It turns out [redacted] had two different repliesone for us and another for a friend who later called on our behalf. He told us personally that we will not lose our deposit and that he will use that deposit towards a downpayment for the next apartment. As he was saying this, we could see that he was being reluctant, insincere and dismissive. It seemed he said that to make us feel better so we could leave. We came home and were seriously doubting the truthfulness of his promise and to confirm our feelings we asked our friend to call him and double check if we are on the same page with [redacted]. (We have to mention that we are new to this country and English is not our native tongue. Our friend, who graciously agreed to assist, speaks fluent English.) This time [redacted] said something completely different to our friend. He told our friend that the deposit of $500 was non-refundable. He claimed that in a 4 day period from July * to July *, he could have rented the apartment to someone else, and he would keep the $500 as a fee for the inconvenience. We were distraught. Never in our prior agreement did he mention that the deposit is non-refundable, and that there are penalties for changing our mind. In addition, we believe that the amount he appropriated is too excessive even if he claims he is entitled to some fees. The apartment we looked at was $1,200, and for [redacted] to withhold $500 is almost 45% of the rent. We understand that there might be some penalty for changing our mind, and at least it would be fair to calculate the daily cost of living in the apartment and add it up to make up the cost for 4 days (1,200/31 x 4= $156). Even if you do that, it comes to $156, not the $500 that he pocketed. What kind of fuzzy math did he use? It seems that [redacted] is driven by greed and love for money. Initially he asked for a minimum of $300 of the $3,000 as a deposit, if we were to pay him the $3,000 as a downpayment, he would have pocketed that also with no hesitation or remorse. We went back to see him again. We asked for a copy of the application to see if there are any mention of a non-refundable fee. He refused to give us a copy of the application and promised that he will use our deposit towards another apartment. We knew that he was lying because a day before he told our friend over the phone something different, but we still couldnt understand what was the need for this game he is playing? We were correct in our suspicions. Weeks passed, no word from [redacted]. He had no intention of assisting us in any way, and all he was doing was taking his time and toying with us. We realized that we cannot count on him and we sent him an e-mail on July [redacted], asking for our money back or a resolution for this disagreement. He never replied to that e-mail. [redacted] is very well aware that we are new to this country and that our English isnt perfect. He surely considered this when he decided that our resources and knowledge are limited to cause him any real harm, and that it would be easy for him to swindle us. He fully took advantage of our inexperience. This kind of predatory practice that [redacted] and his realty are involved in is damaging to consumers. Today he ripped us off, tomorrow he would do the same to some other unsuspecting immigrants to come to his office. We are asking for your agencys intervention to protect consumers form people like [redacted] and his predatory practice. We are asking for your assistance in recovering our money and from further protection of consumers from owners like him. This letter is to respond to [redacted] on applying to one of our apartments located at [redacted]. This is a one bedroom apartment listed with Licensed Real Estate Broker 25 Realty LLC. The rent for this apartment is $1200.00 a month. I, [redacted] Licensee with 25 Realty LLC is the representing Licensed Real Estate Agent for this apartment at the time and showed it to potential tenant and client [redacted]. I showed the apartment to her and she showed high interest in the apartment like she noted in your complaint. I disclosed and made it clear to her that if she would like to secure the apartment and to hold the apartment she would have to submit an application and a earnest money deposit of $500.00. I also disclosed that by making a deposit that the money will go towards first month's rent. Additional fees were disclosed for the apartment and that she was aware before submi tting an application and earnest money deposit; first month's rent, one month security deposit, one month broker fee and a $300 application/credit check fee were the fees. She was also told by submitting a deposit and application for the apartment the money was only refundable if the application was not approved and if it was approved and decided to back out the money is non refundable. The reason brokerages take earnest money deposits on apartments is to allow the potential tenant/client to secure an apartment and not allow anyone else to see it. It also allows the client/tenant to be guaranteed the apartment when approved. The next day (Tuesday) the management approved her and also had a meeting with the landlord and both parties agreed and planed the next day for the lease signing. She was to come in to the office and sign the lease that day. She was full aware and willingly to do so and very excited that she was approved for the apartment. We were confirmed to meet with her, landlord and I at my office for lease signing the next day(Wednesday). She had called and told me that i'm running late at work can we move the lease signing to the next day (thursday). We rearranged the time for thursday and the same hour we were confirmed she called me an hour before the lease signing and told me that she had changed her mind and that the apartment wasn't what she was looking for and she wants to keep looking. By her doing this, she cost myself and the landlord to lose other potential tenants for this apartment who were interested. We didn't show the apartment because she left a earnest money deposit. I informed her when she backed out of the apartment and didn't want it anymore that the earnest money deposit was forfeited. I kindly decided to continue helping her find another apartment as her Real Estate Agent. She requested that I keep her informed of any potential apartments that came available in her budget (2b edroom for $1400 in Bensonhurst South Brooklyn). I told her of course I will and that if anything came available she would be informed right away. There's no guarantee that I know what apartments come up in our office, we strictly work on apartments that are available. We do not carry every apartment that's for rent. I didn't guarantee her that there was an apartment matching her criteria but if there was one she would be informed by me. She has to understand that the earnest money deposit was for apartment located [redacted]. A copy of her application, a receipt and a letter from the management is filed in our office for proof. As a courtesy we informed her that we would deduct part of our Broker Fee if she decided to find an apartment with me.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[redacted] is not offering any resolution to my complaint but instead keeps falsifying and misrepresenting the facts.

1. [redacted] claims in his reply that he originally requested an “earnest money deposit of $500”, yet in the subsequent sentence he goes on with his explanation of fees that his agency charges, and in the process he admits that an application/credit check fee is $300. So if the application fee was $300, what was the reason for [redacted] to supposedly ask for $500 deposit then? What made [redacted] to decide on $500 and not on $800 for instance? The answer is that [redacted] never asked for $500 as he claims, the reality is that he asked for $300 and now he is simply not telling the truth because he wants to pocket the difference of $200. We were naïve enough to trust him and pay him $500. The reason we paid him $500 is because that’s the maximum amount that ATM can dispose per day. If the ATM were able to dispose $1,000 a day we would probably pay him $1,000 deposit.

2. He claims that he informed us that if we “ decided to back out the money is non refundable.” This is another lie. He had never informed us that the money are non refundable.

3. He claims in his reply that a “copy of her application, a receipt and a letter from the management is filed in our office”. When we came and asked for a copy of the application, he told us he doesn’t have it because he forwarded it to the landlord. Here is another of [redacted]’s lies and I don’t know which one to believe.

4. In his letter he claims that we came to his office on Monday, and “the next day (Tuesday) the management approved her..” In reality we came to see him on Thursday, July 4th, not Monday as [redacted] claims. So what Tuesday and Wednesday he is referring to in his letter?- I have no clue. It seems [redacted] can’t get his story straight even when this fact can be easily corroborated by a hard evidence- a dated receipt filled out and signed by him. Please see the attached receipt. If [redacted] is not telling the truth about facts that can be easily proven, how much credit can be attributed to all his claims in his response?

Not only is his response a pure falsification and misrepresentation of facts, it never addresses the issue at stake. How did he come up with $500 deposit if the application fee is $300? Based on the abovementioned facts, this complaint hasn't been resolved since [redacted] is not offering any resolution but only misrepresentation of facts.

I offered several options to help [redacted] on her apartment search after she decided to back out of the apartment. 1. I believe [redacted] seems to be confused to the process of when leaving an earnest money deposit and applying to an apartment. She left an "earnest money deposit" to hold the apartment, $500 is what she left. Knowingly this amount would go to the remaining balance when approved. Yes, again she was approved and a lease was drawn out. She decided to back out of the apartment after having left the deposit. 2. What is the purpose of leaving an earnest money deposit? The purpose is to allow the potential tenant to leave the deposit to hold off the apartment from other potential tenants in seeing it. It secures and assures them the apartment until there application is processed and either denied or approved. If approved they would have to come in and pay the rest of the monies due for lease signing subtracting the "earnest money deposit". If denied you get the money fully refundable. As I stated several times to her. 3. No lying is intended here by all means. Everything I said to [redacted] was factual and evidence can be provided. I stated if "she decided to back out of the apartment when approved that the money is non refundable". It also states that on the application filled by her and on a receipt. The landlord for the apartment had a meet and greet with them and approved them directly. Why would someone leave a deposit for an apartment, decide to back out after being approved and still think to get a refunded full deposit. That would make the "earnest money deposit" no use at all. 4. As a courtesy I offered her an option. I offered to use the "earnest money deposit" she had left and transfer it to another apartment that I would find for her. I continued to work with her even though the deposit should not have to be transferred. I called her to show her other potential apartments but she would not return the call. I felt as she wanted to try her best to get the money back. Which isn't fair at all. She made me hold the apartment for a couple days and got her approved and processed her application. 5. If she would like to continue for me to work with her in finding a suitable apartment, I am ready. Again the money will be transferred as a courtesy to another apartment of her liking.
