To Whom It May Concern: I have addressed my response in order of his complaintMr [redacted] contacted us last December about helping him fix numerous issues with his car and the computers VIN number not matching the car We told him our lead time was weeks before we could bring his car in and he declined stating that was too long...we did not hear back from him again In early September a shop by the name of [redacted] contacted us about fixing some issues with a "Low Speed Fan Circuit #1474" and said the car would not go into "readiness mode" where all of the sensors would test ok Due to the fact we are a performance shop and not a repair shop, we hesitated to take on the task due to space in our shop We informed [redacted] of [redacted] that we could probably get to the bottom of it, but would not promise any repair time as our shop was backlogged and electrical problems can be a task to repair [redacted] had the car towed to us on approx 9/20/ Within a week Mr [redacted] contacted us with a hostile demeanor complaining about how long we were taking and something to do with a registration issue Once I was able to figure out who he was with relation to the cars in my shop, I advised him that we had only had time to briefly evaluate his car, but a complete diagnostic had not started I had suggested that if he was in a rush or had a deadline that it would be best to pick up his vehicle and take it to a shop that could meet his expectations He advised me that it had been to [redacted] , Ford, and a local dyno shop and no one could resolve any of his issues I explained that I sympathized with his situation and said that I understood, but that had no bearing on my clients that were in my shop before him He protested again, and I asked him to pick up his car He then agreed to leave it and not hassle us again I explained "OUR" client was [redacted] and any correspondence would need to go through them going forwardFrom the date of drop off to our completion of what we were hired / paid to do was 9/20/to 10/2/ We had the car in our possession for exactly business daysTo his claim of the car being dirty when it left, yes we agree it was dirty We were hired to work on the car, not wash it However, when it arrived it was already dirty, and left in fairly the same conditionTo the claim of the vehicle being "out of gas", yes that is correct Since we ran the vehicle on the rack for approx miles (unloaded) and tested the car for several hours, we consumed the 1/of a tank of gas the vehicle came in with Since [redacted] concluded the work they hired us to do and was going to tow the vehicle back to his shop, we didn’t feel the need to bill him to go obtain gas to replenish in his carWith regards to the battery, after speaking to [redacted] at [redacted] ...he informed me he drove the car onto the tow truck But when it arrived here, my technicians had to utilize a jump box to get the car started on the tow truck We tried charging the battery on our Snapon Battery Conditioner for approx hours (at no cost) It would take a charge, but would not hold ampers This caused quite an inconvenience to our shop as we had to jump the car every time to move it, which we did not bill for But we are unclear how he thinks that his car sitting for majority of the last months would not deteriorate his unknown aged battery We are not sure why he thinks we had any responsibility for his battery's failure and / or the possible battery drain from his electrical systemYes, the vehicle left here with the check engine light still on The Evap system and the catalytic readiness sensors would not set However, we were able to find and correct several wiring issues, incorrect wiring connections, several vacuum leaks, EGR system failure and loose, faulty Osensors which we gave him at no charge However, doing any further work could not be completed at our shop since we don’t have the proper test equipment to move further to test his Evap system This was the conclusion of what we could fix, and [redacted] concluded our contracted workYes, we informed them that we utilized the Ford factory tune on his SCT tuner so that we could eliminate any "Tune Calibration" issues and that is a common issue with Dyno Tuners shutting evap systems off in the "Aftermarket" tune calibrations We informed them of this so that they could reinstall the tuneHowever with the Aftermarket tune in his car, the car ran poorly in our opinion For clarification, the car could suffer no damage as the car was never put under load and never driven on the street since it did not have the correct tune or current registration Understanding compound boost systems, we made sure the car had noboost during our testing and was disconnectedI contacted [redacted] as we received a random hostile email from a “ [redacted] ” That is when I contacted [redacted] @ [redacted] and asked him to verify if that name was associated with the car we worked on for him Yes, I asked him about the conversation he ( [redacted] ) had with his client as to why we were getting this derogatory email It would seem clear to me that maybe his client either didn’t understand mechanics, or misunderstood the communication given to him or even possibly was given incorrectly to him Either way it is unusual to have a client upset with us and we won’t be the brunt of itFacts of his complaint: The charge to [redacted] was $926.26, not $He is actually not our client; [redacted] is and according to our correspondence is happy with us and the work he hired us to doHis wife sent us an email in which nearly all of this was explainedWe will not be refunding anything; we charged and performed everything we charged for even giving a substantial discount Our posted labor rate is $per hour We worked on his car for approx hours As an Industry favor/consideration we only charged [redacted] hours at our rate, and hours at a near 50% off rate while we were testing readiness mode, which should have been at our rate since his car consumed a rack, testing equipment and a technician We empathized with ***’s situation, and understood the expense of fixing this car was being covered by [redacted] , not [redacted] so a large discount was given as compared to what should have been charged [redacted] should have been charged $plus vacuum line, parts wash at cans, Used OSensors, and battery charging / conditioning That would have amounted in excess of an additional $Mr [redacted] has publically lied about our shop on a public forum (documented), causing our company to have to address such frivolous claims that have no merit, after we responded to his email on 10/18/This caused damage in the time needed to take to respond to such claims and the damaged reputation we incurred because of his public remarks We have approx hours of time on 11/21/combating damages to our companies reputation, consultation fee’s to our Attorneys, and now the hours required time to completely respond to this Revdex.com complaintI don’t appreciate my time being wasted with this unmerited harassment or the constant lies Mr [redacted] did not contact our shop on 10/13/as stated, [redacted] @ [redacted] did Since Mr [redacted] ’s call in late September we have had no conversation directly If he had any questions, concerns or even clairification he could have called us before bashing us and filing a complaint, he hasn’t I believe he is trying every avenue to rectify all the money he spent on this broken car he claims to have been “screwed” by the sellerAt this point we are requesting no further correspondence, harassment, or social media post or it will result in legal action To be honest we are exhausted with this nonsense and will take swift actionSince his desired sans-serif">I am sending you 10% of the correspondence that we have with [redacted]  Basically, he bought a "Special Ordered" or otherwise assembled part for him.  We have a clear policy of no returns, especially parts that are non stocking or special order**.  He tried to return the parts, we said no.  He became belligerent to the point where we have to call his local Sheriff department to get him to stop.  We offered to take it back with a restocking fee, that wasnt good enough.  Then he claimedto have a missing hose in the assembly which we believe he has on his car.  So we sent him another one, he refusedit.  He also filedca complaint with the B.A.R. as well, in which they dismissed as well.
We are not willing to do anything for him.  Please let us know if you [redacted] further information for a Satisfactory Report.  [redacted] IS

olive branch that works for both of us:  Send me the [redacted]
HOSE, UPPER [redacted], that is missing from the kit and refund or credit me a
fair amount of money to lessen the pain of losing $150 to $175 on this deal and
also considering that I didn't ask you to match other's prices.  Then I'll
take care of selling the hose kit.

There are many types of customers in this world….one of them never
makes a good client.  That kind of person whom makes a mistake, and then
demands someone else pick up the pieces by picking up the tab or they whine and
complain, and bash them on the internet for gratification isn’t someone we are
involved with.  I call them “consumer bullies.”  You knew exactly
what YOU had parts wise I did not, and you request** what you want** to order
by part number.  You then discovered YOU didn’t [redacted] the parts and/or you
order*ed the wrong parts.  Not even without a compromise on your part you
start with lashing because for our policy of 7+ years we’ve had as a No Return
Policy. 
 
I’ve seen your post online, and because now that you don’t get
your way you’re going to post derogatory comments and be negative. 
Ok.  Pretty disappointing after all we’ve done for you.  As to the
recommendations I gave you, ok….just because you cannot afford to buy them…I
thought it would be nice to give you some goals and ideas to enhance your cars
performance and that’s a bad thing??  Ok.
 
If you don’t realize the quality of our relationship you had here
with us – I wish you the best of luck out there.
 
I spoke to [redacted] @ [redacted] and he and I agree we’d really prefer
to not have to deal with a bully.  Take down your frivolous comment on the
[redacted] forum and under the conditions that you (on your dime) return the kit to
[redacted] @ [redacted] in an [redacted]ed” and “UN-OPEN**” condition so that it is in-fact
new and in re-saleable condition, and we will accept the return with a 20%
restocking fee.  Once [redacted] has credited us after receives the cooling kit
and accepts the return in good condition, we will refund you $399 less the 20%
restocking fee [redacted] is going to charge us.
 
This is all I am willing to do along with [redacted] as well.  It
is really unfortunate after all we have done for you that is has come to
this.  But you can’t make everyone happy.

I don't have to admit it but I found the
"sales order" that you sent me via email.  It does state your return
policy.  Your "invoice" does not say the same thing.  So I
guess you've got me.  I think its a dumb and short sighted policy that
totally protects you and screws your customers but you have covered your bases
on that one.  Good job!  Many companies have a similar policy but
don't enforce it because they understand what it does to customer
relationships.  You could have easily made a bunch more money from me in
the future because I trusted and respect*edand valued your advice which is the
ONLY reason I chose 281 Motorsports and payed a premium for it.  However,
your attitude of "sorry, but you screwed up" has showed me what you
are really about.  I guess its better that I find out now.  
 
I shall consider the issue closed when I
receive the missing part.

First of all,  I haven't
talked to you in any particular way.  I've simply stated the obvious about
your purported "services" and call*ed you out on a lame return policy
that totally protects you at the expense of you customers.  Going into
this I was pretty happy with the service even knowing that I had overpaid for everything
I have bought.  I would have been singing your praises all over the place.
 However,  you are the one that tried to stick it to me with no room
for negotiation on the return policy.  Its great for you when your
customers bear all of the burden for trusting you to keep them from making
mistakes.  Then when a mistake is made you make them eat all of the cost
for trusting you.  Only after a heated conversation did you offer a 20%
restocking fee which is quite ridiculous. Many companies have that disclaimer
so that they can make it difficult on those that abuse the system.  However,
 I've never actually been charged it for ANYTHING from several automotive
suppliers.  Not sure what [redacted] does about returns and I really don't
care as I didn't buy the parts from them.  I suspect most companies
realize that a happy customer usually returns to spend more money with them.  Others
take the money and run.  I think you are the latter.
 
Furthermore,  you did
indicate that you match [redacted], [redacted] etc prices on the phone.  As I'm
finding out,  that is your mode of operations.  Everything is verbal.
Nothing is in writing so that was you have no responsibility.  
 
Again,  I'll offer a
compromise that I think is fair:  Send the missing hose and refund me $75
for excessively [redacted] up parts.  Then I'll sell the hose kit at a minimum
$125 loss.  I'm still bearing most of the burden and you are still making
a healthy profit.  It will take me a long time to sell the hose kit.  No
[redacted] on planning for future business transactions between us because there
won't be any.
 
As an alternative,  I
will continue pursuing a 100% refund which is really what should be happening.

curious how he would handle this.
To your acclaim weeks
later you mention a missing hose....now that we have been notified one will be
mailed to you tomorrow by the manufacturer that made and sent you the kit.
If you would have asked about our return policy you would have been notified.  In California where
our business resides and conducts it's business is under our
jurisdiction....when you never asked for our policy which would have been
readily told to you.  It is and always has been on our sales order which
is in accordance with our State Law...and most states for that matter.  It
is also approved by the Bureau of Automotive Repair.  I know for a fact no
business explains it's return policy without being asked.  Stop with that
nonsense.
I'm glad you value [redacted]'s
opinion.  If you want to make an enemy of us that is your choice but I am
done with the bullying and child like banter...I'm sure we both have better
things to tend too.
Closing recap...As a
Goodwill Gesture to you, we will take the kit back within 30 days of your
receipt with a standard 20% restocking fee provided it is unopened, unused, and
I'm resaleable condition as determin** by [redacted].  You will [redacted] to call
us for an RMA number and directions and have the item returned by the 30 days
not**.
Or...I have offered you
a $100 store credit to use at our discretion as a good will gesture within 6
months provided we can get back on positive terms via phone conversation.
I sincerely wish for the
best for this situation and the best for you.  I was excited about your
project and connect to be.  I ask the negative emails stop, if they don't
they will just be filed and dismissed.

repair facility, and imply we did a bad job just because we didn’t give you
what you wanted, that is kind of bullying.  If you felt you would have
been better served there, then why did you come to us?  I guarantee you
that you wouldn’t have received the service we gave you from PSE.  As
well, they are backlogged 4-6 weeks, and would have charged you much more than
we did.  We may not do tuning, but we are every bit of a shop that [redacted]
is.  I know what our capabilities are and we are not a follower.  You
were certainly treated fairly in my opinion.  We’ve had that policy from
day 1….doing something differently for you would have been treating everyone
else with discrimination.  So I really don’t know what you mean by saying
I was hiding behind some policy I wrote.  Our policy is on everyone of our
Sales Orders, and would have been clearly explained to you had you asked. 
I have many customers that order replacement parts and such that ask “hey if I
don’t use this can I return it”, the answer is no.  We are not the only
company that has that very same policy.  I do feel bad that you never
asked.  But due to this experience, we are changing our procedures to
further protect ourselves from having occurrences like this happen ever again.

I provided the parts you asked to buy bas** upon your research of
what you knew you [redacted].  I made several recommendations, many of which
cost me making a sale to do what was best for you.  Just so you know, I
don’t price match.  [redacted] doesn’t sell the coolant kit or alt pulley
that I could find.  I charged you $45 for the alt pulley btw.  I’m
not sure how they would sell a genuine pulley that cheap as we paid more than
that for it from [redacted].  And again with all due respect, you call** to
order the kit, I had no reason to think you didn’t know what you knew you
[redacted].  You did review the manifest.

Please find me a company that would pay for return shipping that
has a “brick and mortar” facility.  I know of no one that would pay to
return your part.  Most (outside of AM) would charge a restocking
fee.  You say that you can source the part for $250, please show me
where…I paid MUCH more for it than that.  And if so, WHY did you
buy it from us?  I did not make enough money to really care.  But
since we are quoting [redacted] let’s take a look at their policies:

accessories, kit components, promotional items and instruction manuals

Their policy isn’t ANY different than ours or anyone else’s except
for with us “All Sales are Final”, yet you feel like we should break the rules
for you because you ordereda part you don’t [redacted] or you’re going to swear at
me, threaten me and bash me on the forums??  How is that not
bullying?  Seems like your trying to force me to do something I don’t want
to do or should have to do.
 
I would like to offer an

this…this was not our mistake but yours.  If you want the $55 I made on
that part, you can have it under the understanding that you won’t post
incorrect statements about us and understand I will humbly decline any further
business with you.  Before your quick to not care about doing business
with us remember getting service like we provide is rare.  Maybe you
should take a min to reflect on all the honest and supportive help I’ve given
you…re-read your emails to refresh your memory.  Honestly, I would love
you to get on the forum and RAVE about how awesome we were in EVERYTHING we did
for you and all the time I gave you helping you along the process, but I don’t
see that happening.
 
My Olive Branch counter offer is this, when you’re ready for your
AFCO Heat Exchanger, I will give you $100 off whatever AFCO’s MSRP is.  That
is currently $799.99 as I can recall.  A metaphoric hand shake would be
nice too!

to not have to deal with a bully.  Take down your frivolous comment on the
[redacted] forum and under the conditions that you (on your dime) return the kit to
[redacted] @ [redacted] in an [redacted]” and “UN-OPEN**” condition so that it is in-fact
new and in re-saleable condition, and we will accept the return with a 20%
restocking fee.  Once [redacted] has credited us after receives the cooling kit
and accepts the return in good condition, we will refund you $399 less the 20%
restocking fee [redacted] is going to charge us.
 
This is all I am willing to do along with [redacted] as well.  It
is really unfortunate after all we have done for you that is has come to
this.  But you can’t make everyone happy.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
First of all I am tired of the blame game with this shop (281 Motorsports) stick to the facts. Car was returned filthy, out of gas and [redacted] now admits adjusting the tune on the car back to factory which caused the car to throw the check engine light. Battery has had no issue when charged and returned. I absolutely called his shop to ask the status of the car as I had an issue with registration but was no way hostile towards 281 in any way. When I contacted him via email that went under my wife's account as [redacted] and all I stated the car was filthy, out of gas and the check engine light was on when it was not when 281 received it. I did write my experience on social media but [redacted] blasted back with negativity about [redacted] Performance and enough people that had problems with 281 privately contacted me on the side stating 281 quality issues and it wasn't worth the time and 281 threats to sue me and bringing my mechanic ([redacted]) wasn't worth it for them, so I deleted the post. All this sensors and vacuum leak was fine they fixed but ultimately leaving the car in a worse condition than received and once again blaming everyone else and now want's to charge me? I believe people should be aware of so called experts performing less than minor results. I will not be bullied by this shop as the facts remain no matter how long 281's email is beating around the facts. I received the car in the condition I did, saw it when it arrived and still and won't be happy until resolution is made. The quality of work is poor and I feel I was taken for a ride with shelling out $900+ when I am spending more to repair 281's mistakes and mishandling. Further more no communication has been made by my Mechanic ([redacted]) and 281.

To Whom It May Concern: I have addressed my response in order of his complaint. Mr. [redacted] contacted us last December about helping him fix numerous issues with his car and the computers VIN number not matching the car.  We told him our lead time was 3 weeks before we could bring his car in...

and he declined stating that was too long...we did not hear back from him again.  In early September a shop by the name of [redacted] contacted us about fixing some issues with a "Low Speed Fan Circuit #1474" and said the car would not go into "readiness mode" where all of the sensors would test ok.  Due to the fact we are a performance shop and not a repair shop, we hesitated to take on the task due to space in our shop.  We informed [redacted] of [redacted] that we could probably get to the bottom of it, but would not promise any repair time as our shop was backlogged and electrical problems can be a task to repair.  [redacted] had the car towed to us on approx 9/20/17.  Within a week Mr. [redacted] contacted us with a hostile demeanor complaining about how long we were taking and something to do with a registration issue.  Once I was able to figure out who he was with relation to the cars in my shop, I advised him that we had only had time to briefly evaluate his car, but a complete diagnostic had not started.  I had suggested that if he was in a rush or had a deadline that it would be best to pick up his vehicle and take it to a shop that could meet his expectations.  He advised me that it had been to [redacted], Ford, and a local dyno shop and no one could resolve any of his issues.  I explained that I sympathized with his situation and said that I understood, but that had no bearing on my clients that were in my shop before him.  He protested again, and I asked him to pick up his car.  He then agreed to leave it and not hassle us again.  I explained "OUR" client was [redacted] and any correspondence would need to go through them going forward. From the date of drop off to our completion of what we were hired / paid to do was 9/20/17 to 10/2/17.  We had the car in our possession for exactly 8 business days. To his claim of the car being dirty when it left, yes we agree it was dirty.  We were hired to work on the car, not wash it.  However, when it arrived it was already dirty, and left in fairly the same condition. To the claim of the vehicle being "out of gas", yes that is correct.  Since we ran the vehicle on the rack for approx 50 miles (unloaded) and tested the car for several hours, we consumed the 1/4 of a tank of gas the vehicle came in with.  Since [redacted] concluded the work they hired us to do and was going to tow the vehicle back to his shop, we didn’t feel the need to bill him to go obtain gas to replenish in his car. With regards to the battery, after speaking to [redacted] at [redacted]...he informed me he drove the car onto the tow truck.  But when it arrived here, my technicians had to utilize a jump box to get the car started on the tow truck.  We tried charging the battery on our Snapon Battery Conditioner for approx 10 hours (at no cost).  It would take a charge, but would not hold ampers.  This caused quite an inconvenience to our shop as we had to jump the car every time to move it, which we did not bill for.  But we are unclear how he thinks that his car sitting for majority of the last 11 months would not deteriorate his unknown aged battery.  We are not sure why he thinks we had any responsibility for his battery's failure and / or  the possible battery drain from his electrical system. Yes, the vehicle left here with the check engine light still on.  The Evap system and the catalytic readiness sensors would not set.  However, we were able to find and correct several wiring issues, incorrect wiring connections, several vacuum leaks, EGR system failure and loose, faulty O2 sensors which we gave him at no charge.  However, doing any further work could not be completed at our shop since we don’t have the proper test equipment to move further to test his Evap system.  This was the conclusion of what we could fix, and [redacted] concluded our contracted work. Yes, we informed them that we utilized the Ford factory tune on his SCT tuner so that we could eliminate any "Tune Calibration" issues and that is a common issue with Dyno Tuners shutting evap systems off in the "Aftermarket" tune calibrations.  We informed them of this so that they could reinstall the tune. However with the Aftermarket tune in his car, the car ran poorly in our opinion.  For clarification, the car could suffer no damage as the car was never put under load and never driven on the street since it did not have the correct tune or current registration.  Understanding compound boost systems, we made sure the car had noboost during our testing and was disconnected. I contacted [redacted] as we received a random hostile email from a “[redacted]”.  That is when I contacted [redacted] @ [redacted] and asked him to verify if that name was associated with the car we worked on for him.  Yes, I asked him about the conversation he ([redacted]) had with his client as to why we were getting this derogatory email.  It would seem clear to me that maybe his client either didn’t understand mechanics, or misunderstood the communication given to him or even possibly was given incorrectly to him.  Either way it is unusual to have a client upset with us and we won’t be the brunt of it. Facts of his complaint: The charge to [redacted] was $926.26, not $957. He is actually not our client; [redacted] is and according to our correspondence is happy with us and the work he hired us to do. His wife sent us an email in which nearly all of this was explained. We will not be refunding anything; we charged and performed everything we charged for even giving a substantial discount.  Our posted labor rate is $125 per hour.  We worked on his car for approx 15 hours.  As an Industry favor/consideration we only charged [redacted] 5.85 hours at our normal rate, and 3 hours at a near 50% off rate while we were testing readiness mode, which should have been at our normal rate since his car consumed a rack, testing equipment and a technician.  We empathized with [redacted]’s situation, and understood the expense of fixing this car was being covered by [redacted], not [redacted]…so a large discount was given as compared to what should have been charged.  [redacted] should have been charged $1875 plus vacuum line, parts wash at 2 cans, Used O2 Sensors, and battery charging / conditioning.  That would have amounted in excess of an additional $100. Mr. [redacted] has publically lied about our shop on a public forum (documented), causing our company to have to address such frivolous claims that have no merit, after we responded to his email on 10/18/17. This caused damage in the time needed to take to respond to such claims and the damaged reputation we incurred because of his public remarks.  We have approx 3 hours of time on 11/21/17 combating damages to our companies reputation, consultation fee’s to our Attorneys, and now the 3 hours required time to completely respond to this Revdex.com complaint. I don’t appreciate my time being wasted with this unmerited harassment or the constant lies.  Mr. [redacted] did not contact our shop on 10/13/17 as stated, [redacted] @ [redacted] did.  Since Mr. [redacted]’s call in late September we have had no conversation directly.  If he had any questions, concerns or even clairification he could have called us before bashing us and filing a complaint, he hasn’t.  I believe he is trying every avenue to rectify all the money he spent on this broken car he claims to have been “screwed” by the seller. At this point we are requesting no further correspondence, harassment, or social media post or it will result in legal action.  To be honest we are exhausted with this nonsense and will take swift action. Since his desired settlement was stated, we would like to counter that and ask to be paid for all the time we spent combating his claims.  [redacted] $375 – Time spent consulting team about response and typing response. Review: I purchased a [redacted] for $399.00 for a supercharger installation. The kit was incomplete. The vendor did not meet my requirements for delivery and refuses to give me a refund for the kit.Desired Settlement: Full refund in exchange for returning the incomplete kit that was shippedto me.

We have a clear policy of no returns, especially parts that are non stocking or special order**. He tried to return the parts, we said no. He became belligerent to the point where we have to call his local Sheriff department to get him to stop. We offered to take it back with a restocking fee, that wasnt good enough. Then he claimedto have a missing hose in the assembly which we believe he has on his car. So we sent him another one, he refusedit. He also filedca complaint with the B.A.R. as well, in which they dismissed as well.We are not willing to do anything for him.
