Thank you for allowing me to respond to the referenced complaint. As noted in the papers accompanying the complaint, the customer was given ample lime, from April to October, to complete his purchase of the vehicle in question. The customer had paid approximately 71% of the amount due, but indicated...

that he had to dispose of other cars before he could pay any more towards the purchase, and that he had no money on hand to complete the purchase. In early September he was informed that the transaction must complete before the end of October 2016, over six months from the date of the original purchase agreement. Because the customer had thereby entered into this agreement that he could not complete, his deposit amount was forfeited. Also, storage charges were incurred for six months. Further, the value of the vehicle was depreciating as the winter months approached and it was necessary to find another buyer. As indicated in the termination letter, a check was enclosed for the balance that he was due. He cashed or deposited the check within days of its receipt, confirming his acceptance of the termination of the transaction.
