3 'n 1 Construction

I had 3 'n 1 Construction repair my roof about 3 years ago. This was because the roof was leaking. I required that the shingles they use must match the quality of 30 year shingles on the rest of the roof. [redacted] assured me he would fix the leak and he had access to quality shingles. He said that the repair would cost $900.00. This August I had the occasion to go on to my roof. I found that many of the shingle that were replaced by 3 'n 1 were cracking. I immediately contacted [redacted] and left him a message. I never received a phone call; I continued to call leaving several messages asking [redacted] to please contact me over the next two months. With no response I sent [redacted] a text message stating that I expected him to contact me or I would hire another contractor to replace the roof and he was responsible for the costs of the repair or refunding me my original cost. I gave [redacted] until the end of the week to respond. I have still not heard from [redacted]. I have had my roof replaced as I could not wait any longer, this repair has cost me over $1000, I have not received the final bill. I expect that [redacted] and 3 'n 1 construction refund me the cost of the original job, $900.Desired SettlementI believe that 3 'n 1 are actually responsible for the new costs of replacing my roof, approximately $1100. I have not received the bill for the new service so I cannot be sure. At the very least this business needs to refund me my original purchase price.Business Response In response to the complaint against 3'n 1 Construction: The Complaint is inaccurate in a few areas. First, the original work done for Mr. [redacted] was not 3 Years ago but 4, Invoice #[redacted] Dated Nov 7/11. The Work included Replacing Rotted Sheeting, Some Structural Work and Shingles To match the Existing. The Total on the invoice for all the work completed was &785.71 plus $39.29 GST totaling $825.00, not $900. The original work was necessary because his roof was leaking. When Mr [redacted] called this fall he left a message wanting me to replace the shingles at my cost because they were curling. The Shingles in his opinion were failing, but yet they were still not leaking. My warranty is one year, like any contactor's, at which point I would have been involved in the repair process. If the shingles were in fact failing after the time frame in this issue, Mr. [redacted] has to get in touch with the Manufacturer and at that time they will assess the condition and put through a claim. From day one, all my quotes have gone out with product information including warranty information, and Mr. [redacted]'s Case is no different. The fact that he decided to have the shingles replaced without that manufacturer inspection is his decision. On a side note, I was the second contracting company involved with this original repair. I was called in after they had tore everything apart and then walked away from the site [redacted]Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)3 'n 1 is correct that the original work occurred 4 years ago, that is why in my original claim I stated that the repair occurred approximately 3 years ago. I agree with 3 'n 1 that the original work 4 years ago was $825, I had stated originally what I had been quoted as an approximate price. However, with inflation the current cost to just replace shingles on the one side of the roof was $1100 plus GST $55.00 = $1155.00. Therefore I hold 3 'n 1 responsible for the replacement cost of the roof.I did share with 3 'n 1 contracting that we had released a contractor who we had hired to repair our home after our roof leaked causing damage and an insurance claim in the home. This contractor had not finished the house or roof repair after three weeks into an assured two week job. [redacted]. [redacted]. It was at this time that I told 3 'n 1 that I wanted 30 year shingles because I did not want to have to repair my roof for a long time. I was assured that I would receive as good or better quality shingles as the rest of the roof. I offered to pay the premium price for the best shingles however, 3 'n 1 said they had enough left over shingles that would be ideal for my roof. Since the shingles should have had 13.33% wear, after 4 years use of a 30 year shingle, but instead were splitting (pictures have been sent), it is clear that either the installation of the shingles was faulty or the product I received was not the quality I was assured. Therefore I expect 3 'n 1 to pay for the replacement cost of the roof.I also shared with 3 'n 1 contracting that the reason for my insurance claim was I had the entire roof replaced 5 years previous. This roof looked fine but was installed improperly, over time it leaked and we had water damage inside our home. [redacted] covered the damage, but warned us that if damage occurred when we were aware of a problem we would not be covered. With this in mind I began contacting 3 'n 1 the moment I noticed a problem with the shingles in August 2015. [redacted]. 3 'n 1 assumed the shingles were curling when in fact they were splitting apart and failure was just a matter of time. I gave 3 'n 1 multiple opportunities to help me over the next 3 months. Before I made the final decision to have another company complete the replacement, I let 3 'n 1 know, and gave them 1 week to intervene or I would be holding them responsible for the replacement. I asked the new contractor what I should do about the faulty shingles. This contractor said I could try to get warrantee from the manufacturer but I would need the support of the installer to verify my claims of the quality of the installation and product. Since 3 'n 1 choose to not contact me, inspect the issue, offer solutions to the problem , or disagree with my decision to replace the obviously faulty shingles, 3 'n 1 has by default assumed all responsibility for their faulty work. Therefore, I expect 3 'n 1 to reimburse me for the replacement of the shingles, $1100 + GST $55.00 = $1155.00.Final Business Response I can Appreciate that Mr. [redacted] has a complaint about the shingles; and according to the pictures he has submitted he looks to have a legitimate issue. But this is not an installation issue which is what 3'n 1 Construction does. I offer a one year warranty on the service I supply which. After which point if there is a concern with the product it is on the homeowner's shoulders to address concerns with the manufacturer of the product in question. This is not out of the ordinary in the industry. The manufacturer puts a life expectancy claim on their product, and if it fails within that period then the homeowner/end-user must take that avenue of concern up with them. I offer a one year guarantee on workmanship and this is well outside this window. There was not an issue with the installation.
