VPSales & Marketing, clearly and concisely addressed his complaints in a January 19, response letterI will address each issue in the same order as noted in the Revdex.coms Customers Statement of the Problem.Mr*** description of the charges that his refuse collection account was assessed is correctHowever, his statement for the underlying reason for the charges They had to raise the rate because the county (sic) raised the landfill rate...” is not correctAs explained in Ms***s January 19" letter, his account was assessed additional charges because of the significant increase in the weight of the trash he was placing in his waste bin for Maui Disposal to dump and dispose of as our Service agreement states and as accepted by his signature of February 12, 2012.The terms of Maui Disposals service agreement that we sign with all of our customers are very clear and conciseOur service agreement consists of sixteen (16) separate articles of agreement and is completely detailed on two sheets of paperEach article is clearly titled, ieTerm, Rate Adjustments, Liquidated Damages, Binding Effect, etcEach article is short without vague or ambiguous meanings and none of these articles are more than six sentences longIn addition, Maui Disposals sales staff will discuss and explain the reasons or meaning of each article as requested by any customerAlso, the clear and concise service agreement is a defined, legal document that is voluntarily signed by each signatory and withstood legal challenge.It would appear that Mr*** primary complaint is that Maui Disposal did not agree to his demand to waive the heavy Waste Materials charge and also not increase his monthly service rateMaui Disposal made multiple attempts to resolve this issue with Mr*** in a mutually satisfactory manner and he was not satisfied by these attempts.Finally, Maui Disposal decided rather than fighting with Mr*** or involve attorneys; we agreed to terminate the service agreement for a single monthly paymentMr*** stated that this satisfied the Liquated Damages clause that is an incorrect statementHis 60-day notice of termination was not received within the time frame clearly stated in the service agreementTherefore, six months payment would be normally required to satisfy the Liquidated Damages.But rather than hold an unsatisfied, unhappy customer to contract and to continue the dispute, Maui Disposal voluntarily terminated the three remaining years of a legally binding and willingly signed service agreementMaui Disposal did so after Mr*** threatened to push our bin into the streetIn addition, Maui Disposal did not threatened to take Mr*** to court over this service agreement.If you or Mr*** have any questions concerning this response, please do not hesitate to call me anytime at *** ***Sincerely

Even though Maui Disposal has released me from the contract I think it is very important for the Revdex.com to see and understand what and how they are conducting their businessI will actually be repeating myself from the complaint but in more detailIn the order of the responseThe letter I wrote was after personally talking to their salesman, and the owner of this business speaking to *** *** of Maui DisposalWe both put in numerous calls to the General Manager to try and resolve this issue but never got a call backSo I finally wrote the termination letter, and filed this complaintI personally spoke to their salesman about the heavy load chargesHe told me that Maui County raised the landfill rates to themIt is not me who made an incorrect statementAfter calling the County we found out that they did not raise the rates last yearOnly AFTER my termination letter did *** try to correct the reasoning behind the increase.
When I was told by their salesman that only some of their trucks have these sensors that means only some of their customers are getting heavy load chargesSo Maui Disposal is now discriminating against some customers How do you decide which businesses to send these trucks to?
On the section RATE ADJUSTMENTS They use the word proportionatelyThey charge me $per month for my trash pick up once a weekThat is roughly a pick upOne pick up with the heavy load charges they charged me an extra $That's a 400% increaseThe week before they charged me an extra $That's a 300% increase They picked up my trash every Thursday morningThey were very good at that After my complaint they sent me a print out of my heavy charges11/27/Thursday 415lbs and 12/8/MONDAY ??????? 468lbs Their salesman told me that the heavy charges start after 350lbs Just think, if of me hop in that bin we would be paying extra chargesFor the pick up on 11/27/it is 65lbs overThat's 19% overFor the pick up on 12/8/if that is even mine???? it is 118lbs overThat's 34% over Where does proportionately come in? For them to use the example of a steak in a market is crazyYou want to buy a steak? It tells you exactly how much it cost a pound and exactly how heavy it is and the total costIt even tells you exactly what kind of steak you are buyingEverything up front, nothing deceptive.
On April 2014, I received a letter from MDC about a $increase for my cardboard pick up and an explanation on whyI received a letter for a little $increase but when they implement something as significant as these heavy load charges, nothing, no letter, no warningInstead they hide behind their wording in their contractThese next sections is where it gets really goodPlease reread my complaintNowhere does it say I wasn't informed about the day windowThey have a section that states if they do not get a certified letter from me at least days prior to the end of the contract it will automatically renew for three more yearsWhat is so unethical is how they did thisMy contract ends on Feb12th The 1st statement that we got that we were inside this day window they slam us with these heavy load chargesSo they feel we are now locked in for another years because it's to late to send a certified letter and be outside of the day window This is when I 1st called their salesman to discuss thisOur owner called *** to discuss this alsoThe 1st thing she did was to inform him that we were already rolled over for another yearsShe tried to convince him to pay a increased rate of $per month then she would waive the heavy load charges, or pay the heavy load charges and leave the contract as is, or pay $in liquidated damages to terminate this contract Right after their conversation she called him right back an told him " Just so you know, we spent $10,in your store last year so that should make it easier to swallow this bitter pill'On the section of LIQUIDATED DAMAGESThe year contract states : If the remaining term under this agreement is or MORE months, customer shall pay its most recent monthly charges times by If the remaining term under THIS AGREEMENT is LESS than monthsCustomer shall pay its most recent monthly charge multiplied by the amount of months remaining in this term This agreement in my hand shows it started on 2/15/years makes it 2/15/By the time they got my letter of termination I had less than month left on this agreementI still sent in a check to MDC for my most recent monthly charge including the heavy load charges for the liquidated damagesI received a letter from MDC accepting my letter of termination but the termination date is Feb16th years after the ending date of my agreement of Feb 15th They say my contract rolled over on 12/16/One day inside of the day window for more yearsSo if I want to terminate it's going to cost me $They use the date of 2/15/as the start date of my agreement to roll over for more years ending on 2/16/But they use the date of 12/16/as the start date to figure out liquidated damages.
I never asked MDC to waive the heavy load chargesThe point we were always making was the way they are doing this is wrongWe were the only ones making multiple attempts to resolve thisMDC never called us, we were doing all the callingThe one time she called was to tell us they spent $10,in our storeNone of our calls to the manager were ever returnedOne mistake that I made*** never outright threatened to take me to courtIn her letter to me she talks about how their contract will hold up in court and to have an attorney examine this contract because it is legally binding in the Court of LawI misinterpreted those statementsWould you?
I hope that the Revdex.com has the power to make some corrections in the way MDC does businessI was about to include all the letters, emails and notes that I have on this matter but I decided enough.

VPSales & Marketing, clearly and concisely addressed his complaints in a January 19, response letterI will address each issue in the same order as noted in the Revdex.coms Customers Statement of the Problem.Mr*** description of the charges that his refuse collection account was assessed is correctHowever, his statement for the underlying reason for the charges They had to raise the rate because the county (sic) raised the landfill rate...” is not correctAs explained in Ms***s January 19" letter, his account was assessed additional charges because of the significant increase in the weight of the trash he was placing in his waste bin for Maui Disposal to dump and dispose of as our Service agreement states and as accepted by his signature of February 12, 2012.The terms of Maui Disposals service agreement that we sign with all of our customers are very clear and conciseOur service agreement consists of sixteen (16) separate articles of agreement and is completely detailed on two sheets of paperEach article is clearly titled, ieTerm, Rate Adjustments, Liquidated Damages, Binding Effect, etcEach article is short without vague or ambiguous meanings and none of these articles are more than six sentences longIn addition, Maui Disposals sales staff will discuss and explain the reasons or meaning of each article as requested by any customerAlso, the clear and concise service agreement is a defined, legal document that is voluntarily signed by each signatory and withstood legal challenge.It would appear that Mr*** primary complaint is that Maui Disposal did not agree to his demand to waive the heavy Waste Materials charge and also not increase his monthly service rateMaui Disposal made multiple attempts to resolve this issue with Mr*** in a mutually satisfactory manner and he was not satisfied by these attempts.Finally, Maui Disposal decided rather than fighting with Mr*** or involve attorneys; we agreed to terminate the service agreement for a single monthly paymentMr*** stated that this satisfied the Liquated Damages clause that is an incorrect statementHis 60-day notice of termination was not received within the time frame clearly stated in the service agreementTherefore, six months payment would be normally required to satisfy the Liquidated Damages.But rather than hold an unsatisfied, unhappy customer to contract and to continue the dispute, Maui Disposal voluntarily terminated the three remaining years of a legally binding and willingly signed service agreementMaui Disposal did so after Mr*** threatened to push our bin into the streetIn addition, Maui Disposal did not threatened to take Mr*** to court over this service agreement.If you or Mr*** have any questions concerning this response, please do not hesitate to call me anytime at *** ***Sincerely

Even though Maui Disposal has released me from the contract I think it is very important for the Revdex.com to see and understand what and how they are conducting their businessI will actually be repeating myself from the complaint but in more detailIn the order of the responseThe letter I wrote was after personally talking to their salesman, and the owner of this business speaking to *** *** of Maui DisposalWe both put in numerous calls to the General Manager to try and resolve this issue but never got a call backSo I finally wrote the termination letter, and filed this complaintI personally spoke to their salesman about the heavy load chargesHe told me that Maui County raised the landfill rates to themIt is not me who made an incorrect statementAfter calling the County we found out that they did not raise the rates last yearOnly AFTER my termination letter did *** try to correct the reasoning behind the increase.
When I was told by their salesman that only some of their trucks have these sensors that means only some of their customers are getting heavy load chargesSo Maui Disposal is now discriminating against some customers How do you decide which businesses to send these trucks to?
On the section RATE ADJUSTMENTS They use the word proportionatelyThey charge me $per month for my trash pick up once a weekThat is roughly a pick upOne pick up with the heavy load charges they charged me an extra $That's a 400% increaseThe week before they charged me an extra $That's a 300% increase They picked up my trash every Thursday morningThey were very good at that After my complaint they sent me a print out of my heavy charges11/27/Thursday 415lbs and 12/8/MONDAY ??????? 468lbs Their salesman told me that the heavy charges start after 350lbs Just think, if of me hop in that bin we would be paying extra chargesFor the pick up on 11/27/it is 65lbs overThat's 19% overFor the pick up on 12/8/if that is even mine???? it is 118lbs overThat's 34% over Where does proportionately come in? For them to use the example of a steak in a market is crazyYou want to buy a steak? It tells you exactly how much it cost a pound and exactly how heavy it is and the total costIt even tells you exactly what kind of steak you are buyingEverything up front, nothing deceptive.
On April 2014, I received a letter from MDC about a $increase for my cardboard pick up and an explanation on whyI received a letter for a little $increase but when they implement something as significant as these heavy load charges, nothing, no letter, no warningInstead they hide behind their wording in their contractThese next sections is where it gets really goodPlease reread my complaintNowhere does it say I wasn't informed about the day windowThey have a section that states if they do not get a certified letter from me at least days prior to the end of the contract it will automatically renew for three more yearsWhat is so unethical is how they did thisMy contract ends on Feb12th The 1st statement that we got that we were inside this day window they slam us with these heavy load chargesSo they feel we are now locked in for another years because it's to late to send a certified letter and be outside of the day window This is when I 1st called their salesman to discuss thisOur owner called *** to discuss this alsoThe 1st thing she did was to inform him that we were already rolled over for another yearsShe tried to convince him to pay a increased rate of $per month then she would waive the heavy load charges, or pay the heavy load charges and leave the contract as is, or pay $in liquidated damages to terminate this contract Right after their conversation she called him right back an told him " Just so you know, we spent $10,in your store last year so that should make it easier to swallow this bitter pill'On the section of LIQUIDATED DAMAGESThe year contract states : If the remaining term under this agreement is or MORE months, customer shall pay its most recent monthly charges times by If the remaining term under THIS AGREEMENT is LESS than monthsCustomer shall pay its most recent monthly charge multiplied by the amount of months remaining in this term This agreement in my hand shows it started on 2/15/years makes it 2/15/By the time they got my letter of termination I had less than month left on this agreementI still sent in a check to MDC for my most recent monthly charge including the heavy load charges for the liquidated damagesI received a letter from MDC accepting my letter of termination but the termination date is Feb16th years after the ending date of my agreement of Feb 15th They say my contract rolled over on 12/16/One day inside of the day window for more yearsSo if I want to terminate it's going to cost me $They use the date of 2/15/as the start date of my agreement to roll over for more years ending on 2/16/But they use the date of 12/16/as the start date to figure out liquidated damages.
I never asked MDC to waive the heavy load chargesThe point we were always making was the way they are doing this is wrongWe were the only ones making multiple attempts to resolve thisMDC never called us, we were doing all the callingThe one time she called was to tell us they spent $10,in our storeNone of our calls to the manager were ever returnedOne mistake that I made*** never outright threatened to take me to courtIn her letter to me she talks about how their contract will hold up in court and to have an attorney examine this contract because it is legally binding in the Court of LawI misinterpreted those statementsWould you?
I hope that the Revdex.com has the power to make some corrections in the way MDC does businessI was about to include all the letters, emails and notes that I have on this matter but I decided enough.
I never asked for any money or a refundJust to terminate this agreement*** arrogance is why it has gone this far.
