I am rejecting this response because: They are merely giving an explanationThis does not give me any confidence that they will be hiring better/different contractors and/or engineers going forwardThey also seem to be immune to apologizingWhile I understand they have “no control” as they stated over the contractor work, they are the party responsible for hiring the engineer that hired themOn top of this complaint, they are now throwing glass in front of my window which is shattering as I write this responseIf they really don’t think cement splatter and broken glass is a safety concern worth halting the job for, that is just wrongLegal action will be my next step if this is not resolved
Sincerely,

Seasons Management Group is a managing entity engaged by the Board of Directors of Park North Townhouse Corp (the Association or HOA) to manage the day to day affairs of the AssociationThe Association has a number of policies in place
including a Covenant Enforcement policy, which the Association has to followWe were instructed by the Board of Directors to follow this policy in this instance, which Seasons has done as required by the policy and instructed by the Board of Directors
We are attaching a report showing all the violations sent to this owner regarding various matters that Mr*** brought to our attentionPlease note that the Association held one hearing regarding these matters, to which Mr*** was invited but he did not attendThe Association has also imposed fines in this matter, thus again, following its Compliance Policy as set forth in state statute
Neither the Association or Seasons Management has any legal authority to evict the tenants or go outside of the bounds of the Declaration and Policies in place
At this time, the Association has authorized their legal counsel to begin mediation efforts between these two partiesIn addition, due to harassing and threatening behavior of Mr*** against the Board of Directors and Cheryl Hardman, the Community Association, the Board of Directors has also authorized a cease & desist letter to Mr*** advising that all correspondence in this matter go through legal counsel from this point forward
Lastly, Seasons has dispatched ASCES, a company that does repairs at the property, to fix the fence in Mr*** yardWhen ASCES arrived at the property, they found the gate to be locked via dead boltMr*** has ignored our written requests (sent via e-mail) for a phone number so that ASCES can schedule a repair directly with the owner and they will leave a door tag in with their information so that Mr*** can contact them directly to schedule said appointment
As this matter is between two owners and Seasons was acting at the direction of the Board of Directors we are requesting that this complaint be removed from our record

Hello,Seasons Management Group manages Homeowner Associations in the greater Denver area. Each Association/Community has a Board of Directors that contracts with ALL the vendors performing services in the Community. Seasons does not engage any vendors and only
implements the decisions of the Board of Directors. About half of our clients utilize towing services as contracted by the Board of Directors of each community. As already stated, Seasons does not hire any contractor and does not set any policy for the community. The Board of Directors for each Association sets the parking policy as mandated by the Declaration and other governing documents Seasons has no authority to hold any towing company liable for towing a vehicle that does not comply with the Association's parking rules. Vehicles with improper registration are not allowed in any community. The complaint implies some sort of illegal activity on the part of the towing company and Seasons. We strongly deny any such accusation (temporary tags are posted on the back windshield from inside the car) and, given that Seasons does not hire any community vendor including towing companies, we request that this complaint be removed from Seasons' recordWe also recommend that the resident attend a Board meeting to bring this matter to the attention of the Board of Directors who does have authority in this matter.Sincerely,*** ***, CMCA, AMS, PCAMPrincipal/MemberSeasons Management Group, LLC Tell us why here
As responded for the customer's review, the Association is repairing a number of balconies since last fall. The Association has hired an engineer to oversee this project and a contractor to complete the repairs. The contractor was responsible to post notices to the units as the work
was going on and the engineer was overseeing the projectThe Association has already expressed their dissatisfaction with this project as the contractor has taken a very long time to complete this project and other issues arose along the way related to this project. We received the owner's complaint about the lack of notice and tried to explain that unfortunately, the contractor didn't advise us when they were coming to do the work, and that we could not pull the contractor off the job. This is outside of our authority as the management company was not hired to oversee the project. We have communicated with the engineer on this complaint so that he may address it with the contractor directly. While we understand the owner's complaint, we have no authority on this project and have communicated the complaint to the proper party that the Association hired to oversee this projectWe respectfully disagree with the complaint as a) we were available to the owner to discuss the issue as clearly we spoke to her when she called to log in the complaint (this is directly related to the initial review); b) we disagree with the original review that our staff was rude as we have reviewed the recording and find no such issue; c) we informed the owner correctly that the contractor did not advise us when they were doing work on the property; d) the contractor was responsible for posting notice and e) the management company is not charged with overseeing this project. We have reviewed this file and respond as follows: Carmen S[redacted] has never spoken to Mr. or Mrs. ** [redacted]. Upon review of our phone recordings, it was determined that Ms. ** [redacted] spoke to the office manager, Larissa H[redacted]. We are attaching a copy of the recording herein for...
your review. Please note we do not hear anyone from our office being rude, unwilling to help or hanging up on the owner, therefore we strongly disagree with the owner's review.According to the ledger, a copy of which is attached, the owner has had late fees waived on three other occasions. The policy of the Association is that the Management company can waive one late fee without approval of the Association. After that, the owner needs to send in a written request to the Board of Directors via the manager, where the Board can review the request and vote on waiving any additional late fees. As you see from the ledger attached, the manager has waived late fees in August 2016, March 2017 and July 2017, therefore the manager doesn't have the authority to waive any further late fees. The owner must submit a written request for the Board's consideration. We disagree with the owner's statements that 4 Seasons has been unwilling to waive late fees for this account, when in fact it has done so three other times. When the owners log in to the website, there is an automatic date/time note that is logged in the owner's account. The record shows that the owner logged in their account on December 30, 2017 and February 15, 2018. They did not log in to the account in January 2018 as they claim in the voice mail and if they were to set up for ACH, the notes would reflect that as well as the owner has to accept the changes to the account. The notes do not indicate any such set up, therefore we can only conclude that the owner didn't sign up for ACH on the HOA's account, or that they signed up with their bank, which we would not have any control over. Either way, we disagree strongly with the owner's statement that that signing up for ACH is problematic, as we don't see anywhere in the record that they even attempted it. Initial Business Response /* (1000, 9, 2015/09/04) */
The owner is correct that the check was deposited May 21, 2015 for the new shed door. As of May 25th, the company performing the replacement, Asces, had advised the manager that they had run out of shed doors and had placed an order for 25 more...
doors with [redacted] but that the doors were on back order and that they would advise the manager as soon as the doors were received.
We were advised that there were shipment delays from the manufacturer. The manager advised Ms. [redacted] of this issue on several occasions.
On June 26th, the manager sent an e-mail to Asces advising them to place Ms. [redacted] at the top of the list. The manager checked back with Asces on August 17th and she was advised that they overlooked her e-mail. In addition, they advised that a door had been provided to Ms. [redacted], however, the door was an odd size and an option was given to Ms. [redacted] to either do a special order for a door exactly the size of her shed or to cut down the door so it could fit. Ms. [redacted] asked Asces to bring the new door and have it cut down to fit her shed. The door has since been delivered.
As to the violation letter for the dead tree, please note that the letter was sent to the owner at the request of the Board of Directors. 4 Seasons is engaged by the Board of Directors and is responsible to implement the decisions of the Board. Ms. [redacted] responded advising that the tree was not dead. The Board requested that an arborist check the tree out to determine if it was healthy or dead. An arborist from Arrowhead Landscaping inspected the tree and determined that it was dead. The arborist advised the Manager of this finding and provided a removal proposal, which the Manager forwarded to Ms. [redacted] with a request that she remove the tree as soon as possible.
Ms. [redacted]'s accusations of retaliation are just not true. The Board of Directors requested certain actions from the Manager at 4 Seasons. The Manager complied with the requests and followed the direction given to the Board.
Thank you.
