Nutrition Now has had continued use and occupancy of there space in the JMS. The buildings upper floors are in the process of a 7,000,000...
dollar renovation and the lower floor where he and other tenants reside currently will have new heating and air-conditioning systems as a part of the renovation. The last time we were in his space it was 65 degrees. I also visited the last Sunday when I arrived he and several other people were just sitting talking and laughing. We provided him on a temporary electric heaters. He refused to take the amount of heaters that would adequately heat his space. We have provided the other two tenants on his floor heaters and it is working fine. As far as the water damage I witnessed that personally. There several water stained tiles and we replaced the most damaged. This has no effect on his business. The amount of water that leaked into his space was at most a gallon or two which I personally moped up. He was also not open when this happen. So this also did not effect his business. He also has not paid rent a of this email.
OFFER:
Initial Consumer Rebuttal /* (3000, 11, 2016/01/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The space heaters provided are being used in the smaller office portion of our faciility where they keep it at a managable temperature as long as the door is shut to our fitness studio, which is also our main entrance and is not our ideal option, but our only. Our primary source of income is brought in through the Fitness classes we offer. The day the leak occurred I was present and have video/picture proof. Otherwise there would have been more damage and flooding had I not placed about 7 buckets through the facility to catch the water, as I stated in the initial complaint, I had to cancel our lunch time fitness class due to the flooding, clearly meaning I did lose out on business. 1 single ceiling tile was replaced, I believe there are 17 that are still in need of attention. The other tenants have heat, as I have spoke with them so I'm not sure why they would need heaters? As of this writing (01/07/16) there is still no heat. We do have team meetings frequently and still conduct classes, we're usually always found "talking and laughing" during these events. It is generally 50 degrees when I open for our 6am class and maxing out at a chilling 55 degrees.
