50 Floors have not met up with their responsibilities and has caused a Material Breach in contract. After you and I spoke I was advised to not divulge any further information that I have on email(s) between myself and the -contractor or phone messages of explanations from your sales representative. My attorney advised 50 floors did not render services of not fulfilling a contract, which is also known as a breach. Nonperformance happened when the failure to fulfill the obligations under a contract was not met upon non- completion of the contractual obligations.

There is noted records and several telephone communications of complaints /grievances before, during and after the contract reference to the workers and contractor that provided services.

I spoke several times reference to-

1) Starting date- did not begin when designated- (excuse- workers stated they were delayed on another job)

2) Next date- workers did not start job (excuse- was too cold in basement)

3) Beginning of working day- workers stated they could not finish, had wrong materials

4) Last date worker stated in broken English- they "(Did not speak or understood the language and would have Manager contact me)

It is advertised -"50 Floor partners exclusively with only a select group of flooring installers that we believe to be the best in the industry. We consider our expert installers to be the "heart" of our business. Our installers are background-checked, fully-insured, and skill-tested before performing any 50 Floor installation"... ?

5) Informed manager and salesperson immediately of damages- (Broken base on toilet and pipe damage to toilet- different color molding and floor trim)

6) Advised by Manager- due to not finishing flooring to satisfaction - (he would deduct $400.00 from price -this was to include shimmering doors)

7) Received a call from corporate (Month after damages-sustained- and advised damages were repaired because it was in need of immediate repair for water leakage)

8) Received phone calls from account department (only-communicator) advising and warning of payment/collections

In all fairness,- 50 Floors has come out to my residence and received over half the monies for an incomplete job. The workers that were sent out were not properly vetted or they would have been able to communicate with me to know they were installing the wrong color molding and quarter round. 50 floors representation and stance has been some what a tactic of -'pay the monies or we will put your account in collections, for an unsettled debt."

Companies or individuals that work in your company is why - the ordinary consumer is leery about paying all monies up front. I am sure the materials that was paid for- by myself, I witnessed majority of the material(s) I had paid for-,-left with the workers along with the dissatisfaction and frustration of an incomplete job.

I(having a frustrating time working with decent contractors), - . 50 floors has disappointed me enough to stand by the factual evidence that work was not completed. I have before and after pictures with emails and record voice mails from the sales person of apologies.

I will never ever get anything from 50floor my wash machine got broken, there are serveal holes in the wall fr. The door knobs,, costomer service stink, never resolve any of there issue or problems. I'm so disapointing from all of my result. It beter to be kind then ignore or ignorant by not responding to the costomer. No matter what you do in life it will alway have a reputation on the coroorate manger and the whole company it self.

This is the worst company I have ever worked with A 2-day job to install tile in our kitchen/laundry room area is still ongoing after almost months The work is shoddy at best and the customer service is completely and utterly inexcusable Not once has anyone called me to apologize The tile is uneven , not level , and the grout lines in a few places are so far off they don't even come close to matching up They first had to reschedule due to a truck breaking down, they then ran out of tile because they did not order enough (it took three weeks to get more tile in), then they came out and finished (so I thought); however, they ran out of molding and didn't communicate this to anyone including my wife, there was a tile under the stove that was so high it looked as if they put tiles on top of each other They sent someone out to inspect and said they would fix the tile under the stove and replace the tiles where the grout lines were uneven, only came to replace stove tile

We would definitely recommend 50 Floor to install hardwood floors. We were very satisfied with the quality, as well as the efficientcy, of their workmanship. We were especially pleased with the way they framed the raised hearth and made certain the new floors were even with the existing hardwood floors.

I COULD NOT BE MORE HAPPY WITH MY NEW FLOORS OR THE GREAT EXPERIENCE THAT IT WAS WORKING WITH 50 FLOOR FROM START TO FINISH, THEY MADE ME FEEL REAL AT EASE FROM THE FIRST PHONE CALL TO THE FINAL WALK THROUGH, KEEP UP THE GOOD WORK 50 FLOOR.

I was greatly disappointed with the product that I received from 50 floors. I wanted an area of carpet in my office changed out to tile b/c the carpet was damaged. The area was 200 square feet. The salesman that came to the office showed me a limited amount of tiles. I selected the color that I thought would best match the carpet and tile we already had. He told me that the cost would be $2200. I assumed because the cost was so high that the tile would be of good quality but I was WRONG. They installed a 'peel and stick' tile on my floor that looked horrible and cheap. I called and told them I was very unhappy with the product, I had no idea that it was going to be of such low quality. They told me they would replace it which they did but for another $800!! The new tile that was installed looks better than the old but it is not worth $3000.00. At some point I will have to have additional work done on these floors. It is a 3000 square foot office. If 50 floors had been more interested in providing a quality product and good service I would use them again and recommend them. As it stands, because they were only interested in over-selling cheap [redacted] I will never use them again, nor will I ever recommend them to anyone. Very poorly done 50 floors

I called 50 floor to install some flooring after seeing their ad on TV. Big mistake. They installed the wrong flooring (!) and refused to issue a refund after multiple requests, even to the CEO. They ask upfront for 50% of the cost (which I now know is a ridiculous figure) so that they cannot be held accountable for the work. The 50% seems to be all they hope for, and then they move on to the next unfortunate customer. Since that time I watched a video published by the NC attorney general advising against down payments for such work. Below is a more detailed account of (some of) my experiences with 50 Floor:

Our suspicions of being charged for excess material quantity were confirmed when the merchant generated the itemization on 9/4 for American Express (not us directly). The total of the itemized charges ($7,302.03) differs from the original purchase order of $7,304.72 which was filled out by the salesman. The itemization was generated retroactively in a rush to fulfill a request by American Express. We were told that we would receive this document after signing the purchase order, but it was never provided, despite multiple requests over the phone and in writing. Had we known, we would not have agreed to the excessive material quantities and unit costs. On the itemization, the merchant showed charges for 540 square feet (SF) of material. The merchant's own measurements show only 470 SF, which disagrees with the quantity ordered and billed. The 470 SF also does not account for the saved material due to the cabinets, fireplace, and sink area. Upon checking the merchant's measurements and accounting for these simple adjustments, the correct area is 399 SF. The merchant overcharged us by 141 SF (35% extra), valued at $739.67 at their rate of $5.246/SF for vinyl flooring. The installers left a surplus of 108 SF of material and took the rest with them. Of course, these overcharges are secondary to our main concern that the material is not the type we requested in the first place.

The itemization we received via second hand news shows that the merchant also overcharged in quantity for the carpeting (93.33 SY, 17% overcharge) and carpet padding (90 SY, 12.5% overcharge) when compared with their original measurements of 80 square yards (SY). This was confirmed by the excess material the installers hauled away on 7/24, when they reported they had enough extra material to cover an additional stairway but we declined their offer to do so since we did not know how much the charges would be. The excess carpet material is valued at $276.24 according to their rate of $20.723 per SY, and the excess padding material is valued at $54.54 according to their rate of $5.454 per SY. The merchant's own measurements do not agree with the quantities they ordered and billed us for. The merchant has refused our requests for a refund for the incorrect material, which according to their itemization was $2,832.84. The merchant also refuses refund for the overcharge in material quantity of $1,070.45 as outlined above ($739.67 for the basement and $330.78 for upstairs).

The merchant has lied to American Express that we inspected the material before installation. On arrival the installers immediately began preparing the floor and when we checked back with them later we found they were in the process of installing the wrong product. We immediately called the merchant, but as it was Saturday the representative told us to call back on Monday. When I called on Monday, I spoke with General Manager [redacted] who told me he couldn't help me (he said he was preparing for filming a TV commercial!). We formulated our refund request to the merchant in writing, also requesting an itemization of the charges since we were billed for excess material. We followed up with additional letters with the same requests. In response, the merchant refused to provide us with a refund or an itemized list of charges.

The merchant has lied to American Express by attempting to use the Certificate of Completion for the carpet installation as proof of our satisfaction with the flooring installation two days later. We signed this document only because the earlier installers required it before they left, and we were told that we would be presented another form for the flooring installation two days later, which was never presented and we would not have signed. Our copy of the document is missing the installer's signature since it was added later and backdated in the version sent to American Express. Also note that page 2, which was omitted from the merchant's submission to American Express, reveals that the section "Product Verification" was not signed by us.

I recommend you do not hire 50 Floor for any job, and heed the NC Attorney General's advice not to provide down payments for this type of work.
