I contacted Paige S with AR Building Company and let her know that I was to be laid off due to COVID-19, I'm in the baseball industry and it is still unknown if we will have a season. She informed me that as long as I moved out of my apartment by May 31, 2020 I would be relieved of all obligations of my lease. She requested a letter from my employer, which I provided, and now is stating that I am going to be held to my lease, even though I have lost my job and have to move back to Illinois, where I am from, and cannot afford to pay my rent since I am no longer employed. When I requested a phone number for the corporate office, since she is stating that all lease arrangements come from the corporate office, she says she is not allowed to give out that information. I would like Ms. S to be held accountable to what was stated in the email she provided stating I would be let out of my lease because I was losing my job. COVID-19 has been an unforeseen complication for a lot of businesses and employees, I have no control over the loss of my job, I just want AR Building Company to stand behind what they stated on May 13, 2020 when they told me that I would be allowed to leave, void my contract, and relieve me of any further rent payments.

To whom it may concern, I have been doing my best to help my residents considering the circumstances of Covid 19. Each resident is in a signed leased agreement and non of us could have expected these uncertain times during the pandemic. The particular resident I am responding to reached out and asked me if there was anything she could do to get out of her lease without penalties since she had lost her job. I said if she moved out by the end of May she wouldn't have to pay the cancellation fee but that I need to reach out to corporate because she didn't want to move out unit June. After speaking with corporate I found out that is she had lost her job and couldn't pay rent for April or May we could let the resident move out without cancellation/ lease break fees. I then explained this to the resident also explained that I spoke too soon as I wasn't quite clear on our policy and thought she would just be able to leave but she is current on her rent payments. Further more this policy would exclude someone who has a cosigner who can help pay the rent, which is her situation. I apologized for not being clear in one of my emails but as we all know this is a very uncertain time for us all and I am doing my best to assist each resident. It is unfortunate that she is in a signed lease during the time of Covid and I wasn't able to offer other options than what is described in her lease agreement. I have offered that her fees can be broken up over a 12 month period with no interest. This is the same thing being offered to all residents who need to break their lease during this trying time.

1.) Ms. S never said I would not have to pay cancellation fee, she offered to let me out of my lease if I moved out by the end of May, which I told her I planned to do. (document provided)

2.) I never said I would move out in June, I said it was a possibility I was going to lose my job in June, I am now losing my job this Friday, which she was made aware of (document provided)

3.) Ms. S keeps telling me what corporate said but will not provide a phone number or contact at corporate.

4.) Ms. S never offered to break the payments up over a 12 month period (document provided)

While
I know an apology does not change what I said but as I have already explained,
I misspoke on what our policy is. Unfortunately, a misinformed manager passing
along information to a resident does not override a signed legal document
(lease). Again, I am sorry for that. I am only human and made a mistake and I have
apologized multiple times. During the entire Covid-19/stay at home order,
policy changes were daily and that was not just for our corporation but many
corporations. When the resident originally reached out to me, they were fully
aware of our lease policies because they were asking me if there were any other
options than breaking the lease contract. Also, there is no corporate number to
call or for me to give out. All tenant relations are handled with the property
manager of each location. That is the property manager duty. Furthermore, all
payment options are offered to a resident 4-6 weeks post move out when they receive
their final account statement. I am happy to discuss these options earlier, but
the resident has not been happy with these options thus prompting this
complaint.Thank

On 5/14/18 my wife *** and myself went to 5700 madison looking for a 2 bedroom 2 bath apartment. I remained in the car while my wife spoke with paige about the apartments. My wife was told they had a 2 bedroom 2 bath available and we needed two seperate $50 money orders and a completed application to hold the apartment. Paige assured my wife it would be availabe. We immediately left and returned with these requested money orders and completed applications. We were told to just mail in the $300 money order which was also mailed.

My wife on 5/25/18 called to request information about signing the lease and renting the company provided moving truck.
Devon answered and informed my wife the apartment was rented to someone else and we would be changed to a different apartment. My wife never agreed to this and request a refund due to fradulant sales practices. My wife was told by Devon,she would contact the corporate office and would contact us on tuesday 2/29/18.

On 2/29/18 my wife,while on speaker phone, contacted 5700 madison again and was answered by paige. Who states the events never happened and we will never see these monies again. When we requested the corporate office paige informed us "you can talk to me and only me."

We then requested a refund due to fraudulant practices. Which she replied "you will never get that money back."

To whom it may concern,

Paige, working for 5700 Madison Apartments as property manager on 5-3-18, gave *** an application to apply for a two-bedroom two bath that was available to reserve for June 2018. Each application costs $50 and there is a clearly listed statement on the application,” THIS APPLICATION SHALL BE ACCOMPANIED BY A NON-REFUNDABLE APPLICATION FEE OF $50.00.” *** completed the application, singed and turned it in on 5-3-18 (without payment). We must have payment to submit the application. She then brought in her husband’s application on 5-14-18 (with two payments of $50, totaling $100). This application and payment was given to my colleague (Devon), so I am not sure what was discussed between the two of them at that time. They were then informed their application were approved and they were again instructed to reserve the apartment by paying their $300 deposit. Our policy here at 5700 is to give applicants three days to reserve an apartment by submitting the deposit. We did not receive payment until 5-22-18. So, from 5-3-18 to 5-22-18 a lot can change at an apartment community and when Mrs. called on 5-25-18 and spoke with Devon, we offered her the two-bedroom one bath that we still had available. She did not want this unit so then we offered to put her on the waitlist for the next available unit. She did not want that either, she was upset that we didn’t hold a specific apartment for her for almost a month, we unfortunately cannot do that without the $300 deposit. Mrs. continued to dispute so, Devon told her that she would speak with me Paige (property manager) about refunding her deposit. I spoke with Mrs. on the 29th and again offered her the units that we had available, but she did not want them nor to be put on the waitlist. She demanded that all her money be refunded, and I told her that I could refund the $300 deposit but that the application fees totaling in $100 are nonrefundable. She then demanded to speak with corporate. I do not have a “corporate” number, everything is handled through me, the property manager and my accountant who would refund her $300 deposit. I informed Mrs. that a refund could take anywhere from four to six weeks. After we got off the phone I contacted my accountant who then started the refund process for $300 to ***. Mrs. and I have since then been in contact about the refund via email. Mrs. can expect her $300 deposit to be refunded to her over the next coming weeks.

Applied for an apartment with LA Cabreah on Monday (8/28) paid $75 application fee and $300 deposit. Made it clear that we had a low credit score and were told that the credit score was not an issue. Was told on Tuesday (8/29) we were approved for the apartment once a debt was paid and letter of satisfaction was submitted. Was also told deposit would be increased by $400 due to low credit score. Wednesday (8/30) letter of satisfaction for debt was turned in, we were then told the application had to be sent to corporate. Thursday (8/31) application was denied. Spoke to Hailey at LA Cabreah and was told the application had actually been denied on Tuesday but we had not been made aware of that. Called corporate office and spoke with Annette (receptionist) she stated she was not aware of company policy and procedure. Stated I was not allowed to talk to anyone else that did know policy and procedure. Was told there was nothing they could do. When speaking with Annette I gave a different situation in which someone would not be denied due to credit score and was laughed at and was also told they do not discriminate based on credit history.
