[redacted] signed up for our Platinum Membership on March 5, She changed to our Diamond membership on May 8, The memberships are a recurring monthly EFT draft from a credit card, checking or savings accountPer her signed membership agreements, which she received a copy of at each occurrence, it clearly states that “in the event an authorized EFT payment is rejected, a $fee will be charged to youThe returned EFT fee and returned monthly EFT amount will be paid at the store by cash or credit card before tanning services are continued." Since all membership fees are paid in advance on the 1st of the month, that is why she could not use the services of the salon because she had not paid to do soShe did tan on August 1, because we had not received notice yet that her draft had been declinedEnclosed is her tanning history'I received a message on our customer care line from [redacted] on September 3, 2014, I returned her phone call on September 4, 2014, leaving her a message with my contact information [redacted] paid her August declined draft on September 5, in the store as you can see on her account history enclosed [redacted] did not return my call until September 12, At this time I explained to her that she would not receive a resund for August because her membership is a recurring monthly membershipAs a courtesy to her I credited her tanning account $Tan Dollars which she could use in the store for her [redacted] Tan additivesShe used this credit on 9/12, 9/17, 9/& 9/as you can see from the enclosed paperI then received an email from our customer care center on September 19, from [redacted] stating what she has stated in her complaint to youThis issued had been resolved since September 12, so I emailed her back the same day restating what we had done with her account (the $credit as a courtesy) and that it was her responsibility to keep her account current and asked her what she wanted to do with her account because she was again saying that she couldn't cancel her account (which was incorrect because she had made payment on September 5, 2014)received no email back from her [redacted] could have cancelled her account any time once her August draft was paid on September 5, 2014, but continues to tan with us, as you can see from her tanning history, the last session used being 9/26/Since her payment was approved for the September draft, her tanning membership is good through today, 9/30/I will be cancelling her membership todayThe cutoff date for stopping her draft for October was 925/14, so when she gets charged her monthly membership on 10/1/14, pending approval, I will then issue a credit back to her card for that amount

membership would have been cancelled for the very next billing cycle. The customer contacted us on 2/2/15 about her membership. I stated that I would cancel her membership for her per her email as a courtesy, but that she would need her return receipt furnished by the post office for her certified letter if she was requesting a refund because to date we had not received any correspondence from her. The customer was not happy with this so I reiterated to her our cancellation policy and also told her as a courtesy that I could refund her for December, January & February's drafts. So to date the customer's membership has been cancelled and her credit card was refunded for 3 months. The customer was sent her refund receipts through email.If there are any additional questions please contact me at ###-###-####.

Review: I had an insufficient fund with Palm Beach Tan after this I tried to cancel my contract and was told I could not cancel because I now have a balance of 60+ dollars. Amy, the district manager, explained that the only way to cancel my contract now was to pay the 60+ dollars I supposedly owed or have 3 consecutive insufficient fund occurences which leaves me with a balance of around 200 dollars and no opportunity to tan either.Palm Beach Tan will continue to draft 60 dollars a month from my account and I can not tan because I owe a balance and I can not stop them until I pay the 60 dollars or have consecutive insufficient fund occurances.So, they will continue to take money from my account monthly, but I will not be allowed to tan because I owe a balance.I have also notified the home office via email and have received no response.PLEASE HELP, I would like out of my contract and my 60 dollars returned.Sincerly [redacted]Desired Settlement: I would like first to cancel my contract and would also like my 60 dollars returned.My account # [redacted]Palm Beach Tan store number [redacted]Against [redacted] ending in [redacted]Date signed 5/8/2014
