Then why would you tell me to come and drive it and that is was fixed????? And then after I drove the car and told you I wanted my money back you went and put additional money into the car to 'finish' fixing it???? You do not tell someone to come and drive the car that is not even fixed!

We gave her several opportunities to pay the vehicle off and she never did? We  talked to her and other people that she involved in this transaction over 20 times........other car lots called me and asked me to reduce the payoff......she was trying to sell it online and people would call me asking about the car that she was selling? When I asked her why people were calling me about the car, she denied that she knew anything about this lady trying to buy her car? I tried to help resolve this issue until the day she came in with people who wanted to buy the car (that is how she was trying to pay it off). She never had the money in her hand like she told me she did? I told her that my certified master mechanic would be in the next evening to diagnose the problem with the car.......that is when her friend started yelling things such as  "That's why I don't deal with f[redacted]n car lots like this". I had other customers on the lot and I asked her friend to leave my lot. Her friend had nothing to do with this transaction. We have been more than cooperative with her situation"When you buy a car for somebody like she did, you are responsible to make the payment"We will gladly provide her payment history.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. I did go and test drive the car on 9/2.  At that time I was told the car was repaired but it still made the clunking noises. They told me that this was normal for a car with over 240000 miles on it.  The agreement was to let me know what was wrong with the car and how much to fix the car before I agreed to put a deposit down.  We agreed on the price with the repairs and I put the deposit down.  The text clearly states that the car is fixed on 9/2 and it was not.  On 9/5 the deposit check clears my bank.   That same day I get the text that they were replacing additional parts and the car would be ready Tuesday. Then 9/6 they text saying the car is ready. While I was there on 9/2 I told them I was not buying the car with the clunking and would like my deposit back since they did not repair the car. Why would they call and tell me that car was repaired and it was not?

To Whom it May Concern,The agreement between 83 Auto Sales and the customer was to fix the clunking noises. It took a little over a week to do so. Sometimes, when fixing one part on a vehicle, you may then hear or see something else that is in  need of repair, which is why we had the customer...

take the vehicle on a couple test drives.  The vehicle is a 2008 Mazda 3 with 240000 miles on it. We spent over 700.00 in costs to the suspension of the vehicle to make it right for the customer. We were in contact with the customer letting her know the progress of the vehicle.  The vehicle was ready last week. We called her to let her know.   She had changed her mind and never came to test drive it after the work was completed 100%.  The original agreement still stands, she is more than welcome to purchase the vehicle. We will hold it for another 3 days. A deposit is always transferable if she is interested in another vehicle. Unfortunately, when we take a deposit for a vehicle and take that vehicle off the selling market and a customer then changes their mind, we do not return the deposit.  Our policy is posted in the office that we will transfer the deposit but will not refund it. Unfortunately, it is a bad circumstance for both the customer and 83 Auto Sales. Thanks,[redacted]

Better I totally disagree with their response. When I called the owner he offered to split the $100 deposit, if this was "the policy" why did he even offer to split the deposit with me. Second given all the things the needed fixed on this vehicle I could not in good conscience purchase someting from them, expecially because its for a sixteen year old, I would be worried about the kind of vehicle that I would be getting. When I told the owner Chuck what the mechanics had found to be wrong with the car he states that this was untrue.

Our policy has always been that deposits are transferable not refundable. If the customer would like to come in and look at another vehicle, we would be more than happy to transfer the $100.00 towards the new vehicle.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Hello again, I do not agree at all with what was said first I would like to point out they did not deny what I said about the initial responsibility belong to my aunt who was there when all this transpired. I did not miss any payments the person who I was helping was responsible. When they began to come irresponsible I took over and began to make payments every two weeks. I was the one who caught it up. I was the one who paid in advance as I said before I paid a partial payment for july in June. So theres no way I was behind. And we all have receipts for that. Another thing I want to point out I have phone records that indicate when I spoke with miss [redacted] that there was no repo and she was sending her men to look at my vehicle becausr the radiator was damaged. I could not drive seven minutes without it overheating. When her men came and left I knew I would have problems because the way she was cursing and hanging up on me which was also not denied. When they left she gave me a call and said it was repossessed. Then I said how could you do that if Im coming to pay it off?? Mind you I already made a partial payment for July. and wanted to pay July 28 the remaining balance of 702. Now when she informed me that was repossessing the said vehicle I said I would speak with their owner [redacted]. Who later that eveing said I may come in and pay it off. When I come in the vehicle is damaged. Another thing if that was the last time this employer of 83 auto sales heard from me why was I there to pay it off?? Brcause it was not the last time. I came to pay it off at the location and the vehicle was damaged I took pictures of those damages. The vehicle no longer started. I also had to offer more money just to come and pay it off. That was very greedy of them. So I as never informed of a repossession, my vehicle was damaged after 30 hours, I was cursed out and treated horribly because I wamted to come and pay off the entire vehicle balance. They wanted to take it so they could make more money. They knew what they were doing. I would like for them to refund every penny that was put into this vehicle or fix it up the way it needs to be and return it properly and clear my balance ? When they drove away with it was running and fine. Then they damaged it I would like for one of those options to be reached. I have a lot to back my claims up and an willing to. Hope we can work this out so wr can be done with this I never deserved to be treated that way. They knew who they were initially dealing with and tried to come for me.
Regards,

Sometimes when you fix one thing on a car, it requires you to fix something else. When cars are making clunking noises, it is hard to diagnose the exact part or parts that are making the noises. You may replace a part that was masking sounds of another part. Typically, we do not put 700.00 of repairs into a car without getting the whole 700.00 prior to repairs. We made an exception in this case. The car is fixed and the customer changed her mind.  The offer still stands til close of business 09/15/2015.
