to the complaint using the URL address provided in the letter, however that URL did not work. I was hoping to ask a question before filing my response, but as I cannot reach you, I will send this email and hopefully speak to someone first thing Monday morning.

This complaint was filed by the girlfriend of an employee that was terminated. I would like to mention this in the complaint, as it obviously goes to the credibility of the complainer, but do so in a way that it will not be redacted by your office. I was hoping for some guidance on this.

My response to the complaint is as follows:

We understand that a relocation may make it impractical to continue working out in our establishment. Therefore, we happily comply with Missouri law that allows members to cancel out of an agreement when they move to an address more than 20 miles from the gym. However, members that sign-up for a membership while living more than 20 miles from the gym may not later site the distance of residence as a reason to cancel. When this member called inquiring as to how to cancel, she was informed of this policy. She mentioned that her house was "on the market" and was encouraged to notify us with proof of change of residency once it sold, so that we could cancel the membership per her agreement. Since that time, she has discontinued payments without providing proof of a change of residency and without further communication with our business, hence the calls regarding her account. It should be noted that this member was also the girlfriend of an employee that was terminated, which precipitated her desire to cancel.

I attended regularly for nearly 9 weeks (approx) and experienced some cardiac health issues. I met with a cardiologist, etc., even worked out at the gym with my cardiac halter monitor as the dr. was watching my heart rate. I was instructed to stay out of the gym and needed to take it easy. In April I requested a cancellation of my membership by contacting [redacted] (owner). On April 26, 2016 I received notification that my contract was cancelled from [redacted]. On May 3, 2016 I requested a refund on the unused portion of my contract. On May 12, 2016 [redacted] said she was working on processing a partial refund and I would hear from her soon. I sent follow up emails to [redacted] on June 18th 2016 and August 3rd 2016 and have heard no response. At this point I have simply been ignored and paid $724 to work out at 9 Round for approximately 9 weeks. I tried to be patient and understanding, never once did I threaten or use harsh words. I would simply like a response and a partial refund for the time I did not use.Desired SettlementI would simply like a refund for the unused portion of my contract which I paid for up front that the owner agreed that she would be giving me.If $724 is 52 weeks, then it is approximately $14 a week to use this gym. I used 9 weeks of my contract which is $126. It seems as though they owe me $598.
