Hello ***, Upon further review of your account # originated on 6/20/I found that you never picked up any of your checks for items that had sold in When you came on 6/17/16, a year later to remove what item's where left, none of those checks were available because all checks are STALE after months of issue if not picked up That is stated in the first paragraph of the Contract CONSIGNOR RESPONSIBILITIES: During the first months of the consignment period items removed by the consignor will be charged a 10% fee for each item at the original consigned price After the first months of the consignment period items may be removed by the consignor with a day written notice without penaltyThe consignor is responsible to pick up items by month Equine Exchange will dispose of items after month at EE’s discretinotice to consignor will be givenConsignor is responsible for updating contact information with EE (phone, address and e-mail.) Consignor is responsible for contacting EE regarding availability of checks for piat the shop Mailing of checks to consignors is done solely at EE’s discretion, based on if the Consigner lives out of the area Postage and addressed envelope should be supplied to EE if consignor wants checks mailed It is also the consignor’s responsibility to pick up checks from EE within months of issue EE may attempt to call at least once to let consigner know they have a check waiting No reissuing of stale (past six months of issue date) checks will be availableChecks are only valid for six monthsEE is not responsible for checks lost in the postal service; any request to reissue a lost or damaged check(s) will be assessed a $stop payment fee along with any other applicable banks fees Attached is the whole accounting the way it should have been, I showed where my staff may mistakes for taking % off the sale price when they shouldn't have, and gave you the price it should have been, but I left it when they made a mistake in your favor, and didn't take off the % when they should have I charged you rent owed from Oct to June ($9.00) on the final re-issue check and the $re-issued check fee as that is at my discretion if I do a re-issue, this is also stated in the First paragraph of the Contract that you signed I have mailed your Checks today to your address on file, [redacted] ** [redacted] OR *** It is always our Policy to make it right where we may make a mistake and will abide by that as it is the right thing to do We will not continue business with anyone who isn't willing to also work with us, no matter how long it takes Let this correspondence serve as a final business transaction between you and the Equine Exchange Elaine S [redacted] /Owner Equine Exchange
Complaint: ***I am rejecting this response because:
First I do not remember signing the agreement that the owner of Equine exchange sent you regarding "picking up the check in person"This would not have been in my best interest as I am a travel nurse and am gone for a minimum of weeks at a time and usually am extended up to one calendar yearThis would mean I would not be able to pick up a check every three months. Also, I explained this travel requirement with the teller and she said to call and check on the items On that note, I put my items on consignment and did stop into the store in Septbefore leaving on my out of state assignment that started at the end of SeptAt that time the cashier said that my bare back pad had sold in July (over one month prior). The teller said that the owner must be "sending the check"
Second, I have two recorded phone conversations from the owner of Equine Exchange stating she was "Trying to locate the check" and that she is "going to make it right"There where many other phone calls and conversation where she said she was working on it and would call me back in a few days with the informationThis happened multiple times and I would have to call her again. I will look at my records from my cell phone over the last year and get back to Revdex.com with the trail of callsThis will take me at least weeks as I have limited access to a computer and printer
Third I would like to see PROOF of: my signature on the Contract she is referring too, :PROOF of the "sent check" or written check, with validation of the chronologic order verified by her bank, :and check for all sold and "lost" tack that I trusted her to sell for me.Sincerely,*** ***-***
I've lived here for 2 1/2 years and it use to be a nice, clean and safe place to live when Fairfield was the property manager. Ever since MG properties has taken over the complex has gone down hill. Me and my dogs have twice been attacked by off leash dogs with the most recent attack being 2 pitbulls. I reported it to MG properties and they're like oh well we can't do anything about it if you can't tell us their apartment number. The grounds are always filthy and full of dog waste. I'm actually going out to buy a firearm tomorrow because MG properties cannot ensure the safety of me and my pets. Yeah think about that for a bit. I have to arm myself just to walk my dogs. THIS IS NOT A SAFE PLACE FOR CHILDREN OR PETS!!! MG Properties only cares about getting the tenant's money and not the actual tenants themselves. I will not be renewing my lease and you shouldn't sign one here either.

After the first 3 months of the consignment period items may be removed by the consignor with a 15 day written notice without penalty. The consignor is responsible to pick up items by month 19. Equine Exchange will dispose of items after month 19 at EE’s discretion-no notice to consignor will be given. Consignor is responsible for updating contact information with EE (phone, address and e-mail.) Consignor is responsible for contacting EE regarding availability of checks for pick-up at the shop. Mailing of checks to consignors is done solely at EE’s discretion, based on if the Consigner lives out of the area. Postage and addressed envelope should be supplied to EE if consignor wants checks mailed . It is also the consignor’s responsibility to pick up checks from EE within 6 months of issue. Let me just start out by saying that SOME of the office staff there are nice. When we first moved there, it was cool because we qualified for no required security deposit and application fee was only $12.00. It was a great deal, we got a 3 bedroom 2 bath two story town house for $1,080. In the first couple months it was great living there. Our last few months were the worst. Word of advice, READ YOUR LEASE AGREEMENT BEFORE SIGNING. The reason I say that is because most apartments require a 60 day notice of lease renewal. Well not 909 West, they require a 90 day notice. Not once did we receive any renewal letters. They claim they sent us 3 letters. Not one was received in our mailbox nor our front door. So, before we found out about this notice we had already signed a new lease some where else. So, we were stuck with another month's rent plus the rent went up to $1,300. My roommates went to the office to see if there was something we could work out. The gentleman gave us the manager's name and said that there is a payment program that we could qualify for. I called the next day, the manager said there is no payment program and hung up the phone. So, by this point I'm frustrated because she was rude and didn't offer to help. Now going forward, I just received my final bill for the walk through. This bill is $1,725.00. $900.00 for carpet, $60.00 for painting, $135.00 for cleaning and a $435 collection fee. Not to mention they also include taxes. I am not happy with the final walk through bill. There were no marks on the wall and only one stain on the carpet. I would not recommend these apartments to anyone if you don't want to get charged with outrageous prices!
909 west was absolutely awful! They didn't fix our air conditioning for the first month we moved in. They told us that it was fine when it clearly wasn't working. This awful maintenance service continued throughout the term of the lease. Then when the time came to renew the lease, we made it very clear to the staff that we were not staying. They told us it would be no problem to end the agreement , only to find out they charged us an extra months rent for lack of notice. Instead of being understanding of our confusion, the staff were rude and stated that they were still extending our lease despite the fact we did not even live there anymore. Overall I would never recommend this property to any one and will never rent with Fairfield again.
Re: [redacted] & 909 West Apartments Dear Ms. [redacted], We represent 909 West and are familiar with the concerns of the complainant, [redacted]. Ms. [redacted] experienced two incidents of sewer back up in her apartment. My client immediately addressed the...
issue and sent out vendors to address the problem. The back ups were not caused by my client and all repairs were done in a timely manner. My client has already fully resolved the issue and refunded her $1,030.00. Her claims that my client did not handle the situation or that there was toxic mold is absolutely false. The owner of this beautiful community takes pride in providing residents with a beautiful.place to live and immediately addressing any concerns a tenant may have. They are disappointed that Ms. [redacted] was inconvenienced by a sewer main back up but believed that the unfortunate situation was handled professionally and that they went the extra mile to amicably resolve Ms. [redacted]' concern.Sincerely, [redacted]cc: [redacted], 909 West
