From my perspective (and that of the redi-mix company) Mr
*** seems to have some unrealistic expectations as to how exterior
concrete handles a Wisconsin winter
What Mr*** has
is fairly minor chert pops in
his drivewayI looked at his driveway last year when he called with his first
complaint and explained to him what he was seeingHe was pretty aggressive and
upset and made it clear that he wanted the driveway replacedI explained to
him the what he had was fairly for concrete in a climate where it
freezes like ours. I knew (and explained
to him) that there is a certain percentage of chert that is considered
acceptable in a standard bag mix of concrete and from my experience his
driveway appears to be well within that amountI told him that it would not do
any good whatsoever for me to even contact the redi-mix company where we bought
the concrete because what he has is well within the industry standard. Mr*** was not happy with that and
said "Something needs to be done!" I told him we could try and patch
these little spots for him but there was no guarantee these would stay and they
surly would not match in color.... He
was agreeable to this and later on in we patched all of his chert pops
(With him standing directly over the top of my guy while he filled them)
I received the
following e-mail from Mr*** in March of this year
FromSubject: Bad Concrete

I am very upset with the concrete driveway and
sidewalk that you installed in June of 2013, then you sent your son out to
patch all of the chirp or popping areas of this concrete in Augof It is
now March of and I have he old chirps returning and many more, this is the
poorest looking year and month old concrete that I have ever seenI would
like to know what you are going to do about this before I turn it over to
the Revdex.com and or lawyer. We are trying to sell our house,
but this driveway looks so bad that I am sure that it will cause issues with
any type of future sale
Please let me know ASAP what will be done to
rectify this situation, *** *** ###-###-#### or e-mail ***
I responded the next day with the following:

sent him the following e-mail

The title of your e-mail is "Bad Concrete"This is actually not very
accurate, your concrete is very normal. I understand that most of the
general public is not very well educated on what would be a realistic or a
unrealistic expectation of the care, maintenance, and wear and tear of
concreteWhen most people think of concrete they think "Tough as
nails". Although that statement may be true when we are talking
about trying to remove concrete, it is not very accurate when we are talking
about the amount of abuse the top 1/2" can withstand... We try and
make it a point to educate our customers as to proper care and maintenance of
their concrete and what to possibly expect in the first few years, but seems in
your case somehow this message was not understood or presented clear enough
The issue that you are concerned about with your driveway/sidewalk is
considered and acceptable aging in exterior concrete in WisconsinLast
year when I came and looked at your driveway I explained that what you have is
called Churt pops (and some delaminating from salt).. I am sorry that
your expectations are not metYou asked for a standard residential driveway
We gave you an estimate for a standard residential driveway. You accepted
that proposal and that is what we installed, and what you have.. There is
no such thing as a driveway that is guaranteed "churt free" and we of
course do not stand behind any driveway that has delamination problems due to
salt
When I came to look at your driveway last year, I saw
that your churt pops were very minimal. I did not even contact the
redi-mix company at that time, because I knew exactly what they would
say... When you sent the e-mail again this year saying that you had
"Many more" churt pops, I did contact the redi-mix company to please
take a look at this Although I personally have not come and looked again
this year, one of the owners of the redi-mix company did come and look at your
driveway and I heard back from him last weekAfter seeing your driveway, he
said "That's all pretty minimal, I just don't know what people
expect" His statement lines up with what I saw last
year..
The attached file is the industry standards from the Wisconsin Builders
association, You may find this helpful so you are not just taking my word for
all of this Neither I or the Redi-mix company feel that there is any
significant problem with your driveway. You have exactly what you were
billed for, a standard residential driveway. I will say again here (in
writing), it is important that you take care of your concrete, Seal it (With a
proper sealer) every 3-years and in the winter keep it clean and free of
snow, ice, and saltIt will last for 20-years if properly maintained
I understand you will not be happy with this e-mail and I am really sorry that
your expectations were not metI can only imagine how "icky" this
might get before it's done

I am still very dissatisfied where this is going since no one from A1-Concrete has been out to take a look at the worsening condition of a less then 2 year old driveway they have not seen this pictures that I took yesterday. Of ther 14 sections in the driveway alone half of them are damaged, some of the sections have holes, popping or churting that are 2" to 3" dia. over 1/2" deep. I have attached some pictures to show this. I would have to remove these sections in order to correct this continuing deterioration.
