A-1 Glass and Windows

I recently ordered and paid a $100 deposit for a small pane of glass to replace a bathroom window. City Wide did the measurement for the window. After installation, there is a blank band surrounding the pane, and the window is no longer operational. The installer said my windows are old, and it was not his fault that the inner frame broke during installation. I refused to pay the balance and after several calls by me, the owner [redacted] visited my home yesterday. [redacted] admitted the pane was measured incorrectly, hence, the black band. He also said the installer incorrectly installed the glass--he should have removed the window frame to install, rather than trying to "pound/force" it in. This is how my frame got damaged. [redacted] said my window was damaged beyond repair, and a new window must be ordered. Since the pane was incorrectly installed, he would apply my deposit to the cost of a new window, but that a new window would cost approximately $300+. He said we would finalize the details of this transaction later, but it would take several weeks. Later that day, I called [redacted] to determine what kind of window he planned to order. I want the new window to match the other windows in my house--I have double hung, aluminum clad outside, wood inside windows. [redacted] said he has no access to such windows--he planned to order an all vinyl or all aluminum. He said if I wanted a window to match, I'd need to order and pay it myself.
