This concern and request for assistance is written on behalf of my ** year old mother, [redacted] of [redacted] in [redacted] XXXXX. (XXX) XXX-XXXX. [redacted] would like to have the services that have been paid for in full be actually properly performed fully or have her money returned fully reimbursed.On October 23, 2012 [redacted] paid a personal check, [redacted] for $700 to [redacted] On November 6, 2012 [redacted] paid a second personal check, [redacted] for $1,500 to [redacted]. The purpose of the payment was for services that were intended to have a small tree removed from [redacted] chimney and to place a properly fitted cap on top of the chimney.Ms. [redacted] company is Masonry Specialty at [redacted] in [redacted] XXXXX. Phone: (XXX) XXX-XXXX; Fax: XXXX) XXX-XXXX. There were issues with the work performed from the start. [redacted] ordered the incorrect hydraulic lift for her employees. The lift was too short to reach the chimney so for one day, workers muddled on the sidewalk outside of my mothers house and no work was accomplished. The lift sat unused outside my mothers house for several days. [redacted] informed my mother that another lift would need to be rented and that it was my mothers responsibility to pay the additional costs in order for the work to proceed. Afraid that the work would not be completed, my mother felt no other options but to have to pay for [redacted] mistake. My mother was shown a piece of wood and told the tree was removed from within the chimney. An ill fitting cap was placed on top of the chimney. [redacted] had also ordered a cap that was too big and overlapped the top of the chimney.In June of 2013, the tree that was supposed to have been removed from the chimney by [redacted] was once again growing out of the chimney. On June 28, 2013, my ** year old mother [redacted] called Ms. [redacted] and informed her that the same tree was still growing out of the chimney and was never properly removed. My mother stated that she would like to have the service paid for actually performed, that is the removal of the tree and have a properly fitted cap placed on the chimney. [redacted] stated to my mother that she (my mother) had been shown the tree with roots. My mother stated that she was never shown the tree with roots. [redacted] then stated that the tree had actually been grounded up and that is why my mother did not see the roots. Ms. [redacted] stated that she would have to call my mother back.On July 3, 2013 my mother left a message for [redacted] that she had not heard back and would like the serviced paid for to be actually performed otherwise she would have to request assistance by filing a complaint to have the paid services actually performed properly. [redacted] never returned the call.$2,200 was paid by [redacted] to [redacted] of Masonry Specialty, to have a small tree removed from a chimney and have a properly fitted cap placed on top of the chimney. The tree remains growing out of the chimney and the cap is too large. Ms.[redacted] is refusing to return calls.My mother, [redacted] would like the services that she has paid for to be actually completed without having to again pay for [redacted] mistakes, or be reimbursed in full since the tree is still growing and the chimney cap is the wrong size. The tree needs to be removed to prevent damage to the chimney and a properly fitted cap needs to be placed on top. Thank you, [redacted]Desired SettlementMy ** year old mother, [redacted], would like the work for which she paid $2,200 paid for to be actually performed properly, that is to have the tree removed from the chimney and have a properly fitted cap placed on the top of the chimney. If [redacted] is unable to properly perform the work for which she was paid, then my mother would like to have her money returned in full so she may pay another company to perform the work.
