I am rejecting this response because: This company is clearly lying I have proof of the real date they towed my car which was illegally towed from my gf apartment complex without notificationMy car was already towed before the date they said it was towed on the 2nd I have proof of that alsoI also had to call the police because they didn't notify me it was towedI didn't know where my car was until the next day when the police told me who had itI have a police report number of the whole incident of everything that took place that whole week which includes the officers nameI also made several appointments and couldn't make two of them before yesterday the The first was the day I found out they had my belongingsI was told I cant get it the same day(which was the only day I had a ride) and that I had to set up an appointment for the next day and that I was already charged two days for the holdThe place was too far of a walk and didn't have another ride to make the 2nd appointment on timeThey left only a 12am-2pm window to get my items when there business hours clearly says they are open before and stays open until 5pmWhen I made the second appointment the charges were already at something dollarsMust I remind the fact that I did ask for all of my belongings since the beginning and was denied unless I paid and came in the two hour window on a set appointmentI have recordings of two conversations trying to recover my itemsI tried to at least get my wallet both times before this prior appointment(for obvious reasons) which I got just my walletI lost my job because I couldn't badge in because its in my walletI couldn't even cash my checks from my job because I couldn't get my walletIt also doesn't make any sense for me not to "want" my other belongingsThis place clearly told me I'm only allowed to get my wallet in which is the only reason I only got my walletI'm still being charged for items I could have gotten the first day free of charged but was deniedAlso when I came to pick up my wallet there was several people belongings just laying on the ground and in badly conditioned trash bags with tearsI want to also include this place is far from a A+ rated facility from the building condition to the staffThis place has nothing but bad comments from people dating back at least years until just recently before my caseAnd that's factual that anybody can look upAll I wanted was my items free of charge as it should of been giving the fact I didn't need them to "store" my items and my car was illegally takenBut this place did everything to avoid that to get moneyAlso all my cards and govI.D's were damaged with dark dirt that appears to be smudged on as if someone just ran over itI have proof of that alsoI also find it very unprofessional for a company to lie and discuss a customer with so much dissatisfactionAnd my girlfriend who called without my knowledge did call with anger which I didn't agree withBut who wouldn't be mad if they were denied at least the important things you need to work and get money or even identify myself to someoneMy girlfriend and my birth certificate is still yet to be returned and the conditions my wallet and cards was left I'm afraid to see the other important documents I have in the car or the car it's self reallyVery bad lookWhich is the reason I already contacted a lawyer and have plenty of proof on these guysAnyone with good humanity can see these guys are nothing but a scam and a bad company with all the lies they put into their response letter

This debtor picked up their vehicle from our lot and left the lot completely without advising us of any issue with her vehicle. We cannot be held responsible for anything that she may have done to her vehicle upon leaving our lot. She did not...

mention a problem with the vehicle before she left. She signed a standard condition report (which does state "360 dings and scratches" which is generic for any vehicle that is not straight off the show room floor and in perfect condition, it was not designed to be a lie or false) and personal release as everyone does. Debtors would normally then inspect their unit and personals before leaving our lot and advise us of any issues, which she did not. She returned later to sign paperwork that was missed and only then stated that her exhaust was making a noise and/or was loose. She did not mention a key chain/missing key to anyone during any communication with our office staff.
Yes, pictures are taken of all vehicles we repossess, the pictures of this vehicle we have as it sat on our lot show no damage to the units exhaust. We also advised her that pursuant to the BSIS business and professions code 7507.10, damage to any parts shall not be the responsibility of the repossession agency unless the damage is due to negligence of the agency. The vehicle was towed in accordance with normal vehicle tow procedure. This vehicle would not be required to be towed on a flatbed truck. And once again we would not be responsible for any damage done to the vehicle once debtor drove off our lot.

Gentlemen: I am in receipt of your letter dated November 7, 2016 (received letter on November 14, 2016) regarding the above-referenced individual. We received the necessary paperwork on Novenber 1, 2016 from Mr. [redacted]'s lender to repossess his vehicle. On November 2, 2016 we secured the...

We are not required by law to notify the debtor of our intent to repossess their vehicle via email, phone call or mail; this would defeat the purpose of the repossession. We are required by state law to remove all property from the repossessed unit within 24 hours of repossession. We send a notification to the debtor at this time to notify them of the repossession and any personal property that is left in the vehicle. The debtor called on November 4, 2016 and attempted to get information about his property but became upset about the fees that were being charged. A third party got on the i*one and was very aggressive and was verbally al:rqs...ve. We told the debtor that Ite would need to make an appointment to pick up his property, but he never did so. The third party continued to call on numerous occasions, but we are not allowed to talk to third party. In fact, the debtor contacted law enforcement to advise them of the situation. I spoke with the local police department and advised them of our procedure. The debtor had told them incorrect information. The debtor finally made an appointment to come by and pick up only his wallet yesterday (November 160), but did not want his other property. No fees were charged. I have been business for many years and I conduct my business with the upmost respect and abide by all state laws and regulations. I do net have a long list of bad reports. The first was the day I found out they had my belongings. I was told I cant get it the same day(which was the only day I had a ride) and that I had to set up an appointment for the next day and that I was already charged two days for the hold. This debtor was charged and only paid a flat fee of $100 to our company for storage of this unit. We have no knowledge or say over what was collected from him by his finance company. We did not collect $1600 in storage at our facility.

vehicle was impounded and placed on a 30 day hold by the CHP. The lien holder had us repossess this unit from the impound yard to be stored on our lot for the remainder of the 30 day hold because impounds are a violation of the retail contract and had the unit stayed on the impound lot the debtor would have paid even more storage to the impound yard.
The vehicle could legally not be released to the debtor until the 30 day impound hold was over, we also have no control over that as the hold was imposed by the California Highway Patrol and we are legally bound to abide by it.
As debtor stated in his own complaint, we advised him that it is required by law per Business and Professions code 7505.2 and 7507.10 (f) that we remove and inventory all property inside the vehicle upon repossession and that we are then able to charge a reasonable daily storage rate for this property.
