Complaint: [redacted] I am rejecting this response because: It was interesting reading the response by the attorney for A-1.An attorney who has apparently defamed me but I do not expect anything more from an attorney who was suspended from the practice of law for months for ethics violationsMy receipt for repairs from A-clearly states type of transmission is 4L65-E which is not the same as a 4LThe 4L65E has the 5-pinion rear planetary carriersThere is also a substantial difference in the clutchesThe 4L65e is a high performance transmissionIt is the transmission removed from my car by A-My receipt confirms itFurthermore, A-claims that the transmission they put in was re-conditioned as was the torque converter but I did not authorize that A-was to rebuild the transmissionThe shop manager calling himself “curly” called me and asked to put in a “rebuilt” transmission I approved the installation of a “rebuilt” transmission, not some cheap “reconditioned” oneYou do not put a “reconditioned” transmission into a CorvetteIf A-wants to make another of their dubious claims such as “cost”, I paid via debit, not credit cardPeople with cash pay with a debitPeople who need to finance use a credit card in my experience You can note on my receipt that I did not sign itAfter I noticed the discrepancy back in (I had picked up the car after hours) I asked about this and was is “chevy did not have a transmission” which is BaloneyThe 4l65e is a The 4L65E P/N is and has been a standard part for yearsIt would have only been a few days to obtain one if one were not available locallyI own three cars so a rush job is another attempt at a smoke screenI also want to make certain that this is clear, I never received an written estimate for the work nor did or would I have signed off on a "reconditioned" transmission Rebuilt products are completely taken apart, cleaned and remade to a new conditionReconditioned products are cleaned, inspected, and repainted, and though some parts may be replaced, they are not returned to new condition I would like to point out that no parts were listed for “reconditioning” the transmissionIn court I will have a subpoena issues to obtain that parts listMy original quote from A-did not break down laborI was given a cost of $to “rebuild” the transmissionAttached is my receipt for the transmissionIt CLEARLY states 4L65e in the upper right hand cornerThe photos of the parts which were removed from the transmission found in my car are not parts found in a 4L65e The control module was also not upgraded as they are in the 4L65EThis is again smoke and mirrors as are the claims of not bringing the car back in days (it was) and the Mass Air Flow SensorIf you keep the sensor clean and do not over oil the aftermarket air filters you are fineFurthermore this can also happen with a standard factory filterAs to the two years of driving, this is not about that, it is about fraudI asked for a rebuilt transmission and that is what I thought I received, not a reconditioned oneFurthermore, until this transmission failed and was once again removed, this time by a third party, I would have never known that the transmission I paid for was in fact not there I also need to make clear that I NEVER signed any documentation authorizing a reconditioned transmissionUnder 646AI am required to receive a written estimate in ADVANCE and that never happenedQuite the contrary in factMy signature is nowhere to be found on any “receipt” nor is there a breakdown of charges for parts replaced or “reconditioned”In fact, with the receipt I received for the Audi suspension work A-did, you do see my signature and I did approve that workQuite a bit different than the one for the tranny I have included a portion of a receipt from the shop that had to rebuild the mess A-did, you will see my signature on it and approval for costsI would love to see A-provide one on the Corvette, in fact, any work done has to be verified and approved via signature or a phone call which is written down, showing approved byThat Approved by (phone approval) has to be on the repair receiptIt is the law Once again, the 4L65e noted in the receipt is NOT a 4LThe shop manager in fact disparaged the folks at the other shop as people who had worked for him and had been firedThe bogus claim of my losing my temper or shouting are another smokescreenI did neitherThis manager also told me their computer system was old so he could not find my receiptI also mentioned to the shop manager that I had photos of the parts taken out of the carI showed them to him and his comment was surprising, “ how do I know that those are the real parts and not replacements they made” referring to the other shop I want to also address the claim made in writing by MrB [redacted] that I wanted A-to write a fraudulent report in regards to my late wife’s autoI am not sure how many lies this company has offered in defense of itself against others or the smear tactics they try to use but this one is a reach too farMy late wife’s car had been worked on by another shop and apparently a bolt was not properly replaced which led to a structural failureA-repaired the work finding a bolt missingIn fact it was A-who told me about it, made the comments about what caused it and asked if they would like to have it put in writing Due to my longtime relationship with the company in question and the simple fact that A-could not confirm the absolute cause a claim was never madeI still use the company in question as I have over the last years and will continue to do soA-has quite the reputation in Salem and none of it that I have heard is positiveA-never worked on the transmission of that carI have included that receipt as well Another smokescreen is my having driven the car from SpringfieldThe transmission was already damaged, 4th and 3rd gear were goneDriving in second at low RPMS will not cause further damage and since I already knew the tranny was going to have to be replaced it would not have made a differenceI had also contacted Chevrolet about driving it in second gear and was told given the circumstances no further damage would be doneAs an aside, the Corvette can tell you the transmission temperature and it was constant at degrees MrB [redacted] states that the build sheet for the car shows a 4ltransmissionThat is irrelevant to the matter in handIn fact, the VIN for my car shows it is a Commemorative Model which it is notWhat matters is that I was told and paid for a rebuilt transmission that was a 4L65e as This office represents A-Transmission & Drive Axle RepairYour letter to A-dated June 26, 2015, has been referred to me for responseThis transmission repair was done on March 7, (See Exhibit 1.) As is clearly stated on Exhibit 1, the warranty was months or 12,miles, whichever
occurs firstThe customer agreed to installation of a reconditioned transmission and a reconditioned torque converterThe charges were reasonable and the vehicle operated in accordance with standards and specifications when it left the shopAs far as A-knows, it continued to operate without difficult until recently when apparently Mr*** experienced a transmission problem near Crater LakeAs Mr*** indicates, the car was towed to A-TransmissionA-Transmission was more than willing to repair the damage, without charging for laborHowever, Mr*** became hostile and abusive towards A-1's managerThis conduct included screaming obscenities which caused a disturbance with employees and other customers, even though he was asked on several occasions to lower his voiceMr*** presents some specific complaints which are simply not trueFirst, Mr*** claims that the transmission installed was not a transmission and had missing partsObviously if it had missing parts, the transmission would not have operatedHowever, the transmission installed by A-was the correct transmissionApparently Mr*** believes that the vehicle has a 4165E transmissionThat is not trueThe transmission is a 4160E, which is the one that was repaired and is the proper transmission for the vehicleA-called General Motors and gave them the VIN number for the vehicle and received a complete printout for the vehicle which demonstrates that a 4160E was installed from the factory in Bowling Green, Kentucky(Exhibit 2.) Mr*** complains that the MAF (Mass Airflow Sensor) has nothing to do with the operation of the transmissionHe was advised on March 7, that the MAF needed to be repaired(See Exhibit 1.3)He refused to correct the problem, at least with A-Attached as Exhibit is a General Motors' bulletin that deals directly with the issueThe relevant sentence is in the third paragraph which reads "MAF sensor problems not only effect the engine operation but also effect the transmission operation." Accordingly, Mr*** was incorrect in his position that the MAF could not affect the operation of the transmissionThe third claim made by Mr*** is that the transmission was missing parts and valves for coolingMr*** agreed to return his vehicle for a free day checkSince often times transmissions need to be adjusted, A-makes it clear that if you do not bring a transmission back for the check, you void the warrantyIn spite of Mr*** claim that there were missing parts, he drove this vehicle for over years and 20,miles without any complaintsMr*** advised A-that he drove from Springfield in second gear to his house, then had the vehicle towed to A-1's shopDriving the vehicle in second gear could also potentially cause further damage to the transmissionWhen A-1's manager spoke with Mr*** regarding repairing the vehicle, as stated earlier, he became verbally abusive which made it impossible for the manager, MrB***, to even talk with himA-also repaired Mr*** wife's vehicle sometime agoHe was very happy with the service, however, he wanted A-to write up a bad report so he could make a claim against another shopA-refused to do so because that would not have been trueIt appears as though Mr*** is attempting to use the same tactic against A-that he wanted to use with respect to his wife's transmission on the shop that repaired it prior to A-In summary, Mr*** claims should be rejected and no action taken against A-The vehicle was out of warrantyMr*** did not correct the problem which A-told him he needed to correct which may have caused a problem with the vehicleA-provided the rebuilt transmission which was the proper one for the vehiclePlease let me know if you have any questionsVery truly yours, William *B***

which parts were damaged she authorized us to do so along with her DOB for over the phone authorizationShe declined to have the repairs done to the vehicle since she sold the car while it was in our shop and handed the title to the new owner at our counterThe New owner has the same vehicle at home and informed us he was going to interchange parts around himself, The new owner left with us all internal parts which we are saving, we then worked 11/hours overtime helping to load the vehicleIf the new owner wants us to re-install the transmission into the vehicle we will gladly do it since it is our policy as stated on our paper work.

My receipt for repairs from A-1 clearly states type of transmission is 4L65-E which is not the same as a 4L60. The 4L65E has the 5-pinion rear planetary carriers. There is also a substantial difference in the clutches. The 4L65e is a high performance transmission. It is the transmission removed from my car by A-1. My receipt confirms it. From March 2013 through September 2013 the car was driven about 4,000 miles as it is a pleasure car. After that it was on Park insurance and in my garage. In 2014 the car was driven between May of that year and October. From August 2014 through mid-October it was driven by my daughter to work, a distance of 12 miles round trip. After that the car was again put on Park Insurance. The trip that the car broke down on was only the second time the car had been driven in 2015. I had been ill from September 26 2014 through April 19, 2015 including 6 weeks in the hospital and 4 ½ months bedridden so the claim of 20,000 is another one up in smoke.
I will also mention that I received a written quote from [redacted] for $1200 to rebuild my transmission this year. That jumped when they saw that the parts were not as claimed (4L65e) and had to be replaced with the correct 4L65e parts that A-1 claimed they had installed. In fact the shop manager at A-1 also made comments about J&L transmissions. I happen to be happy J&L were able to help me and to show me that I had been defrauded.
