The complaint has made several allegations against our company and [redacted].1) He states that he contacted our office on several occasions. A log is kept of all phone conversations by [redacted] and [redacted]. They have no record of any contact with the complainant on or around the dates given and neither Mr. [redacted] nor Mr. [redacted] have any recollection of speaking with him concerning the complaint. 2) It is impossible to install tanks higher than the outlet leaving the house. The tanks have to be placed at a gradual drop from the plumbing leaving the house to the OSSF unit. The unit was installed according to the guidelines set forth by TCEQ and JCECD. 3) The complainant has received an estimate to alleviate the problem. He has chosen not to install the extensions because of the cost. The extensions would have been charged to him at the time of the installation as well as now (this was addressed in the initial response).

I am rejecting this response because: A1 wastewater accepts no responsibility for the flooding of the systems tanks which results raw sewage containing feces being distributed across not only my property but also the property of neighbors with children. A1 wastewater's claim that I have not called them about this problem on several occasions is false. Witnesses and I  will testify that I informed A1 wastewater at my job site on the day of the install and several times between then and now that the system would be submerged by rainfall. I called A1 a lot during the first year after the install, telling them that the tanks were getting submerged by rainfall. They refused to do anything about it. I felt powerless and pushed around so I put it out of my mind. Then later the air pump was submerged after a large rain, ruining it. When I notified A1 about the air pump I told them again that the system was too low and getting flooded. They offered to replace the air pump for nearly 800$ and again offered no remedy for the improper installation. I replaced and raised the air pump. Feeling defeated for the past year I have not called A1 wastewater about my expensive aerobic wastewater nightmare. Since my install I have found [redacted] to be very stubborn and unable to admit the job was done improperly. He seems so ridged in his position that I get the impression that he could be a vindictive person. I think that's why I've never taken action beyond phone calls asking for remedy. For along time I also thought that he would have a change of heart after getting around to considering how he would feel to have his own dooky water flowing around in his and his neighbors yard many times a year after spending such a large amount of hard earned money.  I can't take it sitting down anymore. I've made a promise to myself to go through all proper and legal channels to remedy this public health hazard. I find it hard to believe that my neighbors and I could be forced to live with feces water everywhere several times a year but if that's the insane world we live in I'll hire another company to come out here and fix this debacle. It will cost me plenty, but I'll be proud that I did the right thing and that I will never have to suffer the embarrassment and shame of having neighborhood children exposed to my bacterial infested crap water ever again. Also [redacted]'s assertation that I would "do something on the internet" is quite mysterious. I simply informed him that his stonewalling of the problem would not work anymore and that I planned to contact Jefferson County Environmental Control, then go as far as necessary including the Revdex.com, TCEQ, and posting online reviews of my horrible experience with his company.

The plan for Surface Application of Treated Wastewater was approved for installation for the complainant by the Jefferson County Environmental Control Department (JCECD), which falls under the Texas Commission on Environmental Quality (TCEQ) regulations, for Flood Zone AE on March 2, 2009.  The...

system was installed according to the design on March 4, 2009, and the system was approved by the JCECD May 7, 2009. The system was inspected and serviced every 4 months for the first 2-years under the "two year initial service policy" which is required by JCECD and TCEQ.  The complainant has purchased an annual service policy with our company annually on the following dates:  5/31/11, 2/29/12, 5/15/13, 1/27/14 and 4/24/15.We have no history of requested repairs by the complainant nor have we been contacted concerning this problem.  The complainant contacted our answering service June 16, 2015, stating the system has had a "big problem since it was installed".  [redacted] returned his call the same day.  The complainant stated he was concerned about his sewer running onto his neighbors' property.  He said it was not put in at the correct elevation and he expected us to fix it or he would take us to court in Hardin County.  [redacted] told him to do what he thought was necessary or he would see if we could fix it.On 6/18/15 at 9:41a.m., [redacted] called the complainant with an estimate to install 2-12" poly extensions.  When he was given the price of $247.68, the complainant informed [redacted] he would not pay but would take us to court.  The complainant called [redacted] back at 12:26p.m. just to let him know he had called JCECD, Revdex.com and TCEQ and that he would post "something" on the internet as well as call his lawyer at which point he hung up on [redacted].The extension would have been added to the cost of the system had we installed them at the time of installation.  We are more than willing to correct the problem at the price listed above.  Supporting documents are enclosed for your review.A-1 Wastewater Services, Inc. prides itself on our product and work ethic.  Sincerely,[redacted]Accounts Administrator
