I am rejecting this response because: I did not finish the original complaintI was cut off in the middle of the 12th point of the complaintHere is the rest the point complaintThis would mean that the title and
therefore legal ownership of the vehicle had
never been transferred over to meIf the title and therefore legal
ownership had been transferred over to me through
proper DMV channels the DMV would have record of that transaction and
upon my
visit to the DMV for an Application of Duplicate or Paperless Title
there would have
been no issue or cause to contact the dealer/ owner even if the title

legal owner of the vehicle I visited HAuto Group

when he realized that each of the forms; both Application for duplicate
or Paperless
title (REG 227) and Lien Satisfied (REG 166) both required a signature

notarizationEventually the (REG 227) and (REG
166) did get to Mr*** who proceeded
to take his time signing the documentsI became so frustrated with Mr
*** and his obvious and apparent
unwillingness to sign and notarize the documentsIt seemed that he no longer cared to
help me in this matter or even relinquish his
own liability in this case until I called yet again on October 11th and at which time I
spoke to one of the individuals who answered the phone and explained to
him that if
I could not get Mr***’s signature and notarization of the DMV
documents;
(REG 227) and (REG 166) I might have to bring a lawsuit against himI called Mr*** on October 13th and he was very rude and accused me of
losing the titleHe told me that I had lost the title
and that I had waited too long to obtain it from him
and that I was causing him trouble and harassing himHe told me to come in and pick up
the paper work that day and unbelievably when I
arrived I was handed a signed and notarized All Purpose Acknowledgement
form
which is totally and completely irrelevant to what the Department of
Motor Vehicles
require for transfer of legal ownership of a vehicle in the state of
CaliforniaThe other two forms; Application for
Duplicate or Paperless title (REG 227) and Lien
Satisfied (REG 166) were signed but not notarizedAgain let me point out had Mr
*** turned in the appropriate paper work to
the DMV as he is legally obligated to do by the laws of the state of
California and the
statutes of the Department of Motor Vehicles as a car dealer operating
in this state
this issue would mootIt is my understanding that in the
state of California when purchasing a vehicle from
a dealer or individual it is the responsibility of the
dealer to report the sale of a vehicle to the DMV within days of the
sale by filling out a Notice of Transfer
and Release of Liability form (REG
138) and mailing it to the Department of Motor Vehicles
If this is not done or the form is not filled out completely and correctly the ownership of the vehicle will not transfer and the
vehicle record will not be updated to show the buyer as the new owner until the buyer
applies for a new title as in my case
The dealer could be held liable if the buyer is involved in an accident before
then, and the dealer is still considered the
owner of the vehicle
I have never received a pink slip from AA Auto Sales (aka A&A Auto Sales),
Mr *** or the DMV
At no time have I requested or demanded the title from Mr*** prior to
this dispute

Review: Purchasing a vehicle at auction where it was clearly indicated with mechanical issues and then selling it on without making any attempt to repair.

The sales person blatantly lied to me about the mechanical issues of the vehicle, despite me asking him and when I saw the auction documentation it was all clearly detailed when they purchased it. They made absolutely no attempted to repair and just turned straight around and sold it to me knowing all the issues. I've sent them a letter and haven't received a response. Desired Settlement: I'm looking for a refund for the warranty that I purchased and some sort of good will gesture for selling me a vehicle with know mechanical issues and blatantly lying about them. Failure to resolve this will result in me filing a claim in small courts... I will not let this lie.

As we talked on telephon and we did fax all the papers and buyer gide, asis agryment we sold vehicle as is no warranty at all and we did tell him what is as is means and after he read all the papers and signed (buyer gide and sold as is ...means) attach

- The same day we sold the vehicle we did smog and safety (attach)

- Mr. [redacted] did test drive the vehicle and signed inspection form (attach 4)

- Mr. [redacted] did buy extended warranty from ASC warranty we did not have any profit on he can call and cancel the warranty, they have to give him money back not A&A Sales

Review: 1. In early September 2015 I discovered that I did not have the title to my vehicle which I have had for more than 10 years and is fully paid for and I realized I had never received a title from the dealer or DMV. 2. I attempted to contact the dealer which at the time of the purchase of the vehicle was A/A Auto Sales to try to obtain the title. 3. The first time I called I spoke with an individual who claimed not to be affiliated with AA Auto Sales, or the owner. 4. This individual stated that Mr. [redacted] the owner of A/A Auto Sales was not available at that time. 5. He told me that the owner of A/A Auto sales, Mr. [redacted] was on the premises on Mondays and Tuesdays around 12 or 1pm and shared office space within the building occupied by [redacted] Group. 6. On Tuesday September 08, 2015 I tried contacting the dealer again and requested to speak with him. 7. Again someone else answered other than Mr. [redacted] but said that he was in the building and that I called at a good time. 8. He came to the phone and I explained my situation. 9. He suggested that I go to the DMV to obtain the appropriate forms and return them to [redacted] which is the address of [redacted] and anyone working there would be able to sign them. 10. I went to the DMV on that day and obtained an Application for Duplicate or Paperless title, form (REG 227) and a lien satisfied, form (REG 166)11. While at the DMV it was explained to me that the vehicle that I had fully paid for and have had in my possession for more than 12 years although registered to me is still legally owned by A/A Auto Sales and therefore the previous owner Mr. [redacted].12. This would mean that the title and therefore legal ownership of the vehicle had never been transferred over to me. 13. If the title and therefore legal ownership had been transferred over to me through propeiDesired Settlement: I would like Mr. [redacted] to sign and notarize both the DMV form (REG 227) Application for Duplicate or Paperless Title and form (REG 166) Lien Satisfied.

Review: Dealer made harrassing calls; threats

I purchased a car for $5500., after tax & License, the total was $approx. $6200. I paid $5000. cash. dealer allowed me to make 6 pmts of $193.78. First pmt was due on 6/4/13. Dealer called me on 6/4 and I apologized. I inadvertently thought pmt date was 6/7. I told dealer I would drop pmt in mail on 6/5-to which he agreed. Dealer called me on 6/6/13 threatening to reposses vehicle if pmt was not in his office by 5:00. I asked did he have a grace period, he said yes. Dealer used the simple interest contract, which states "if payment is more than 10 days late you may be charged 5% of the amount due". Dealer told me in call of 6/4 that there was a $20.00 late fee. In call of 6/6 he indicated it was a $25.00 late fee.

In addition, upon delivery of vehicle, dealer promised to make a few repairs (without charge), which were NOT complete upon delivery (as promised). I brought car back to dealer for repairs. Stayed in the mall for 6 hours, which dealer made repairs. We had discussed more than once that these repairs would be free of charge. When I returned to dealership to retrieve vehicle, dealer indicated that "these repairs costs him $700.00, and asked that I pay $200.00'. When I advised dealer that he had verbally told me these repairs would be free, he backed off and simply said "that was my fault". This dealer is UNSCRUPULOUS and should be double checked. He appears shady to me (at best). After the harassing calls, I have decided to pay the balance owed without making monthly installments. Due to the unprofessional nature, I prefer to have no further dealings with this establishment. Thank youDesired Settlement: I would simply like to receive a letter of apology from this business for making the threatening call to me.

Business' Initial Response

1. The customer did not pay his payment on time. The due date of his payment was on 6/4/2013, but we did not receive the payment. A day after the due date (6/5/2013) we called to remind him that he passed [redacted] due date. We always call when the customers pass the due date. So, it is not just him.

2. Also, two weeks after he bought the car "as is", he called us to say that the passenger side power seat is not working. He added that his mechanic wants to charge him $750 to fix that, and asked us if our mechanic would charge less. Although we sold the car "as is" and it was not our responsibility, we said to bring his car to our shop to fix the problem. We told him that our mechanic would charge only $200. He did thank us and brought his car to our mechanic. But, after the mechanic fixed the power seat, the customer jumped in his car, laughed and said that he won't pay anything and left the shop! So, we called him, and he accepted to pay only $100.

WE SOLD THE CAR AS IS.

MAKE PAYMENT ON TIME, NO PHONE CALLS.

Owner is not honest. Before I purchased vehicle, owner told me "since the seat is not working, have it repaired under the 30 day warranty I'm giving you". Warranty company would not cover repair. Dealer told me "bring it to me, my mechanic will repair. He promised this would be free of charge. After bringing car to him, he had it repaired, THEN advised it would cost me $200.00. Again, I wouldn't have brought it to him. As far as his harassing call, pmt was mailed on the 5th. Dealers contract indicates a grace period. Dealer called with very nasty threat on 6/5 telling me he was going to reposses. Check finally arrived (after I drove 60 miles to deliver a new check. Dealer apologized and kept the mailed check for my July pmt. admitted that many times mail is mis-delivered. Simply don't recommend anyone doing business with this entity. Dealer treated us like criminals, all because his mail was late. Dealer should honor his contract grace period. When I arrived to deliver a replacement check, dealer tried to make me pay an additional $100. Late fee, which was not in contract. Dealer also told me "no checks"! He finally changed his main, and accepted my check. When I delivered replacement check, I paid dealer the $100.00 for the seat repair (he requested that amt). I paid it only to TRY to maintain a good relationship. This place is shady, at best.
