I had my car towed because a wheel had been stolen and wanted to check for undercarriage damageThere was a jack and donut presentThey dragged my Honda Accord on the newly repaired pavement that new bares Dr parallel scrapes from my car being draggedThey then charged my insurance company 6k for missing wheels, meanwhile it was only 1, in addition to the damage THEY didbecause there was no other damageSo I complained about it scared that my rates would increaseThey are now holding my car hostage unless I PAY them $cash for storage meanwhile work never begun on my carNot to mention they caused the damage in the first placeTo top it all off the guy who towed my car became very nasty and tried to intimidate me

The Wrong Grill was placed on my vehicle and the bumper was installed improperlyWhen I took it back to get correctedThey said it was an honest mistake and that’s they’ll order the correct grill and put it onI’ve returned there several times and they keep giving me a different storyI’m starting to get the run around and doubt that they’re making any attempt rectify the situationI’m calling or visiting them once to twice a week and this has been on going since the third of this month

Review: Dear Sir or Madam, On June *, 2013 I was involved in a Motorcycle Accident which was a result of losing control of the motorcycle due to un-repaired pot holes and depressions on the road. After the incident, I legally parked my Motorcycle on [redacted] and [redacted]. I was treated in an ambulance and then taken to the LIJ hospital for further treatment. on the next day of my release, I went to the location where I parked my motorcycle to find that it was not there. I spoke to a witness of the accident that works in doctor's office across of the accident site and where I parked my vehicle, then I was informed that my motorcycle was towed that evening of 6/**/2013. The witness had no information or knowledge of the name of the towing company nor the location of where the vehicle was being towed to. Knowing that I parked my vehicle legally and never authorized any person or entity to two my vehicle,and I never signed any authorization for towing my vehicle, I spent over 5 weeks looking for my vehicle by calling dozens of towing companies in proximity to the area of the accident and as well as dozens of towing companies in the county of Queens. Unfortunately, I couldn't locate my vehicle for five weeks. By chance, I contacted a company named: A&A Motors & Towing, Inc. and I was informed that they had my vehicle and they were responsible for towing it. Know, my compaint conists of that I couldn't get my vehicle back because the company has charged me over $2,500.00 for towing expenses which I am not responsible nor liable for because on the one hand, my vehicle was parked legally and no illegal parking ticket was ever issued by the New York City Police or Traffic Department for my vehicle to be towed, and that also I have never called the towing company nor direct them to tow it or authorize them to do so. And, even my signature is not on the copy of the towing authorization that they provided me with on August **, 2013. So, Please, I am asking to please help me in recovering my vehicle and ending this type of scams by towing companies, or this towing company in question, because they tow vehicles without permission and authorizations from the owner(s) and charge excessive fees that cause the owner to be unable pay in order for them (Towing companies) to take ownership of the vehicle because they know that the owner would be unable to pay the excessive and unrealistic fees. Thank You Very Much. I am looking forward to your decision and reply As soon as possible because everyday that passes makes it harder for me to recover my property.Desired Settlement: Although I have never personally authorized the company to tow my vehicle that was legally parked ,and that the New York Police Department nor NYPD traffic issued a ticket for parking violations and/or for removal of my vehicle, I am willing to pay the towing company amount of $400.00 for unauthorized towing. and expect to release the vehicle to me as the only owner.

We responded to an accident call from Direct Accident Response Program (DARP), who Dispatches for the New York City police department on June [redacted] 2013, of the 105 precinct, job number [redacted].. At 9:46pm, at accident location, [redacted].

The Accident occur on June [redacted] 2013 not June [redacted] 2013, which was stated in [redacted] complaint. On arrival at the accident scene we were told that [redacted] was taken to the hospital, The tow was then sign and Authorize by an officer of the New York City Police Department, which is by law if the driver is not available or have been taken to the hospital, the officer then handed the Key of the Motorcycle over to us for better access. .The Motorcycle was then towed to our facility, and a copy of the receipt that was sign by the officer was taken to the police precinct for [redacted] with the location of

his property, which could have been retrieve from the police precinct as soon as he was release from the Hospital, and not the five weeks that he said he was trying to locate it, the first contact we got from the owner was on July [redacted]2013. When [redacted] contact us he was informed of his charges which he didn't contest, He was contacted twice after that to arrange payments and removal of his property, he refuse to, he then state that he will be in as soon as possible which was. August **, 2013 the motorist then went on by stating that he had legally parked his bike, basically this was a live accident scene so the key was handed over to the offer by the Motorist. And unfortunately he still refuses to pay. This complaint was filed on August [redacted] 2013, almost two months after the accident and one month after he had located his Motorcycle. The bottom line is that [redacted] is trying to find excuses so he would not have to pay for services that was provided for his property.

Enclose is a copy of the Sign Authorize tow receipt, and pictures of the keys with the Motorcycle.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

the president and owner of A&A Towing & Motors, Inc, [redacted]

claims that they were called by the NYC Police Department on 6/**/2013 to remove my motorcycle and that an officer authorized them to remove the vehicle, and they did so based on DARP laws and regulations.

First off, the company is in violation of current NYC code of removal and towing of motor vehicle because my motorcycle was NOT damaged, NOT abandoned, NOT disabled, NOT immobilized due to the accident. In fact, the accident was not as a result of a crash with another vehicle, or property either public or private. in other words, it did not involve a cash with another motor vehicle. In addition, my motorcycle was not obstructing traffic but instead it was LEGALLY parked on [redacted] and [redacted] as I explained in my first statementy. So, A&A Towing and Motors, Inc does not have the authorization to remove a vehicle even with a police officer's authorization because my motorcycle was not in violation with traffic and parking rules but again instead it was legally parked. [redacted] and his business should know better the rules under the current provisions of the NYC removal and towing code.

The only time that a motorcycle or any motor vehicle can be removed with a police officer's authorization is when it is disabled and obstructing the traffic or illegally parked and ticketed, or the motor vehicle has been been abandoned by its owner and have received at least 3 parking tickets. the company should have used its own judgement and knowledge of the NYC code of removing and towing vehicles since it is licensed to do so rather than trying to put the blame on the New York City Police Department or myself. If there is a problem or misunderstanding it is the company (A&A Towing and Motors, Inc.) responsibility and duty to bring this issue with the NYPD. Furthermore, A&A Towing and Motors Inc., is not licensed to tow motorcycles nor does it have the equipments to do so except for cars. Furthermore, the scanned photos of the towing authorization shows my name misspelled, and signed by another person. Also the scanned photo of the towing shows keys of the motorcycle proves nothing. When I first visited the towing yard, I brought my keys to try to start the engine and see if the battery is still charged. I left the keys with the person responsible because they were going to charge the battery because they did not allow me to remove the battery and take it with so that I can charge it myself. So, all these allegations are baseless and absolutely false.

Second, As opposed to [redacted] statement, I first contacted their office on the second week of July but not July [redacted]. I have gone personally to the company's business office in two occasions and I also called the company several times and even spoke to him personally to try to resolve this matter amicably and in fair manner, unfortunately, [redacted] was not willing to provide or accept any solution. I personally offered to pay them their towing fee, yard fee and storage fee from the date that I first learned that they had possession of my motorcycle knowing that my motorcycle was towed without my presence and authorization, I had absolutely no idea of where my motorcycle was located. and I contacted several dozens of towing companies in Queens County until I called came up with his company information and fortunately find out that they were the ones that towed my motor vehicle.

Furthermore, I gave the business a very generous offer from me to end this matter in a friendly manner although I did not authorize the towing and also knowing that the towing was illegal. [redacted] was not willing to compromise or make an offer or provide or accept any solution but instead he insisted that I had to pay in full the amounts that he has charged me and accumulated since June **, 2013 knowing that I have never authorized them to tow my motor vehicle and that the towing was illegal even with a police officer's authorization and also knowing that his company is not authorized to tow motorcycle. I was told by [redacted] that I had to bring this issue with the NYPD despite the fact that I explained to him that his business or himself has to bring this issue with the NYPD because they illegally authorized him to tow my motor vehicle. Again, [redacted] and his business should know better provision contained in the current NYC towing and removal code since they are licensed and they decided to tow my motorcycle without legal based or leggal authorization. [redacted] can't just do whatever the police tell him to do so, but he and his company have to operate within the provisions of the law instead on putting the blame on me and assign me the responsibility to bring this matter with the NYPD). [redacted] and his business MUST assume the responsibility for the Illegal towing of my motor vehicle based on the current provisions of the NYC towing and removal code. An officer authorization DOES NOT make the towing legal unless it is stated and defined in the current provisions of the law. If his business accepted the authorization which is clearly in violation with the provisions of the NYC towing and removal code, then it his and his business responsibility to return my motor vehicle to me. any issues with the NYPD has to be resolved between him and the NYC Police Department. I have absolutely nothing to do with the NYPD.

In the end, I am still willing to put an end to this problem in a friencdly and amicable manner and retrieve my motor vehicle if [redacted], his company and I come to a fair resolution.

[redacted] had mention that he had legally parked his motorcycle and call the pol ice which once he did there should be a police report, the accident was on June [redacted] 2013, of the 105 precinct, operator number [redacted], job number [redacted], at 9:46pm at accident location, [redacted], this information should help you retrieve the police report, which could help you understand more fully that this was a live accident, which grant the police the right to Authorize the towing of his motorcycle.

The main factor is that [redacted] needs to remove his Motorcycle from this shop and all he needs to do is come in with his payment. [redacted] Motorcycle was towed to our facility for 102 days now the charges are has follows:

June [redacted] ,2013 to October [redacted] 2013.

The storage fees goes up 27.00 per day :tor everyday the motorcycle is here, until [redacted] comes in and make a payment.
