I have been a tenant at 7 Bly St., Rochester, NY 14620 for approximately six years. I paid $550 a month in rent plus $10 a month to have pets in the apartment.My wife and I moved out of the residence on January 30th, 2012 because of a variety of factors:1. Poor maintanance of the apartment.2. The apartment not being up to code for a certificate of occupancy. These violations include exposed live wires, staples used to hold down bathroom tiles, poor furnace maintanance. Endured two years of city inspectors visiting the apartment. At the time we left the CofO was still not renewed.3. Landlord continually leased upstairs apartment to drug dealers and assorted criminals and would not evict tenants until they lapsed in rent. Criminal violations include using drugs, selling drugs, theft, domestic violence, child abuse, position of stolen property (firearm). Landlord would never require proof of income, background checks or any other reasonable measure to ensure that the apartment if being rented to an individual who can legally afford it.We gave thirty days notice prior to vacating the apartment and provided an addressed envelope to the landlord to ensure our security deposit and interest were returned to us. Landlord spoke to us in person and stated that as long as the apartment was clean we would not have a problem in getting the security deposit back.After not receiving the security deposit another letter was sent asking for the return of the deposit and interest on the six years of tenancy. This letter also threatened legal action should the funds not be forthcoming.I recieved a call today from the landlord saying that he would not be returning the funds because the rent was recieved after it was due. And that since the rent was not received prior to the fifth of the month he would be adding a $35 fee to each time this occured. He then stated that the fees were equal to or more than the amount owed and that he would not be refunding the security deposit.
