homeowner by *** ***, the original selling retailer and installed sales
Care
and cleaning recommendations were provided to *** *** via a CPG
International, LLC (hereinafter “CPG”) Sales Representative and the claim was
closed as cleaning is not a warrantable issue.On October 9, 2015, a call was received by CPG from *** ***
requesting that the claim be revisited for cleaning and reported
inconsistencies in the surface pattern of the deck planksA site visit was
performed by representatives of *** *** and CPG on October 29,
Demonstrations were performed on-site to illustrate how to clean the referenced
“difficult to clean” areas and recommendations of how to aid in the aesthetics
of surface abrasions were presented*** *** representatives informed us
that the cleaning recommendations would not be acceptable to the consumer so a
verbal offer was made to cover the associated expenses of a one time,
professional cleaning service in good-faith to service the customer.*** *** representatives again stated
that cleaning would not be acceptable to the consumer and requested a joint
concession between CPG, and *** *** to gain the satisfaction of Mr
***The requested concession was comprised of CPG crediting for the
originally purchased decking to allow replacement; and *** *** would
cover the labor expenses associated to the removal and replacement.The offer of credit for the originally purchased decking materials was
documented by CPG on November 4, and presented to *** *** to obtain
Mr***’s signature of consentThis document was signed by Mr*** on
November 16, 2015.At his own discretion, Mr*** decided to change the
color/style of the decking to an alternative TimberTech productThis decision
was made beyond the agreement which was signed by Mr*** on November 16,
This decision resulted in upcharges as the product chosen is a premium
priced product beyond that of the original purchaseAdditionally, this change
in color resulted in the originally installed trim boards no longer matching
the installation.The TimberTech 25-Year Limited Residential Warranty states that if
TimberTech determines a Purchaser’s claim is valid, TimberTech will at its
option, either replace the defective TimberTech Products or refund the portion
of the purchase price paid by Purchaser for such defective TimberTech Products
(not including the cost of its initial installation).Although a warrantable issue was not present, TimberTech/CPG
Building Products has fulfilled the obligations of the Limited Warranty in its
entiretyAdditionally, the obligations of the release signed by Mr***
dated November 16, have been fulfilled via credits to *** *** as

[To assist us in bringing this matter to a close, we would like to know your view on the matter.] TimberTech (TT) has not adjusted the problems identified in my complaint. TT has not sent a representative to his home to physically inspect the condition of his deck prior to rendering its written position. I could not locate the deck cleaning agent recommended (Wash Safe) by TT on the internet and it would not help me locate the product on the internet  which I was told could only be acquired via the internet. I did use a product that it identifies in its brochure but there has been no noticeable improvement to discoloration or the product. I am entitled to refund beyond extending the warranty.

We are interested in working with TimberTech on a resolution, however, their solution to only replace the fasteners is not acceptable.  The warranty on the product is 25 years and this particular product was discontinued and the subject of a class action lawsuit due to defects with the product.  Our deck has experienced fading, substantial warping, and discoloration which is consistent with the exact issues under which it was discontinued.  I believe that it is appropriate that Timbertech stand behind its product.  They advertise the product as maintenance free and long lasting, yet the deck is not.  The deck needs to be replaced due to the warping and because they discontinued the line due to the defects we are unable to only replace the portions that are several impacted.  The entire deck needs to be replaced.  We have had three contractors out to look at the deck and they have all concurred that the entire deck needs to be replaced due to the defective product.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]By letter dated January 27, 2017, [redacted] from Timber Tech's warranty department sent me a letter offering a good faith resolution of $500.00 to purchase replacement boards in order to resolve my complaint. According to Mr. [redacted], he claimed the butt joints were installed on a single joist and screws were over driven. I had a professional deck contractor install my deck in accordance with the Installation Instructions so I do not believe Mr. [redacted] was able to determine a skilled craftsman "over-drove" all the screws. However in a good faith effort to bring resolution to my complaint I believe a fair resolution would be to reimburse me $1,000.00.

TimberTech provided a letter that did not provide any resolution or path to resolution in response to my complaint.My complaint simply asked TimberTech to stand by their product based on their claim that the product was defective and make me whole for a year long process to repair a deck that was new.  Their response is that they will not stand by their product.  After admitting defective deck boards and providing replacement product for all defective boards with the exception of the skirt boards (Timber Tech didn't provide replacement skirt boards stating "they aren't defective so we won't provide replacement boards") are shifting their position stating that "a warrantable condition was not present." My TimberTech deck was new, TimberTech admitted that their product was defective, TimberTech refused to pay for the labor to replace the defective boards and fought to deflect responsibility for over 12 months before finally admitting and providing replacement boards. In November 2015 the deck was replaced, on February 5, 2016 TimberTech requested I sign a release to accept replacement product in return for silence.  None of these issues were adequately addressed in their response.My expectation is that TimberTech would resolve this issue as requested.
