Initial Business Response /* (1000, 9, 2015/09/21) */
Yes I do hire 1099 workers. This particular crew has worked for me and with me for 2 plus years without any problems.
We did the work and when we finished I sent this client an invoice for the work.
I contacted after one week as we had not...

received a check. The client stated he had some issues with some of the work. I sent the crew over to fix everything he wanted. Waited another week and did not received a check. Sent email and client stated he had more issues. Sent over some one to fix and it was done in full.
Waited another 10 days and received a check finally. My invoice and bid say payment upon completion.
After a month the client asks me to come by as he has more issues. I was going to but decided to not go as I had lost all respect for this client. He had tried to hire my crew behind my back and I was not too happy about this. The person in charge of my crew reported this to me. When I told this to the client he told me he can hire anyone he would like to. I explained to him he had no integrity and would not be coming by for a walk thru. His issues are subjective as they are dry wall issues. We are painters. He paid after 3 weeks of looking at his property and work.
Anyone can find new dry wall issues with a house that has been lived in before.
What ever drywall issues he has he can have someone come in and take care of as he has acknowledged that dry wall issues were to be paid on top of painting. The painting was done correctly.
Client agreed it was and paid for services rendered. Client is upset because I let him know he had no integrity and he would like to smear my company name which I go to great lengths to make sure my customers are happy.
This person would never by happy. I put several thousand dollars into project and had to worry about getting paid as client was less than responsive to paying his bill.
His complaint that it looks terrible is invalid. He would not have paid and I would not have expected him to if it was terrible.
Just trying to get something for nothing.
Initial Consumer Rebuttal /* (3000, 11, 2015/09/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I'll address his response one claim at a time.
1099 employees. First, they're not just 1099 employees, they are an entirely stand alone business called Medina Painting. I referred them to my uncle as my issues weren't really with them. [redacted] doesn't do any work and doesn't employ anyone. He gets work and then has someone else do it. Then doesn't care if the work is done to satisfaction although that's what he states.
Payment. At least we agree that he never did a walk through. I would have written him a check in person had he done so. To claim he was worried he wouldn't be paid is nonsense. I live in a nice home and pay my bills. I paid him as I had made the assumption that all looked ok based on first look. We moved and had a sea of boxes in the house for three weeks. I also have a young child and work 60 hours per week. Not to mention the hardwood flooring contractor who was still working on part of the house that was painted for another week. The deficiencies I've pointed out to [redacted] were not noticed until I had a chance to look closer. A walk through was never done with me to go over the work. These issues would have been caught had one been done.
Drywall issues. When we put the bid together it specifically stated that he'd charge me $30/hour to sand and do wall repair. It was very clear what I wanted done. The work I challenged [redacted] on is only part this issue. His crew missed a few area I wanted repaired. Again he never has even seen the finished product, so he wouldn't know. Had it not been part of the bid, I'd have no room for complaining, but the bid called for the work as I requested. I'm not asking for perfection, but to follow through on his quality promises and the bid.
Secondly, the drywall sanding\repair are only a fraction of the issues. I sent [redacted] multiple pictures of my issues and it's not as he claims. He's never come by so I don't know how someone can make the claims he's making. Examples of issues include paint on the ceiling, paint on marble counters, paint on white trim, paint on wall plates, sloppy paint on walls above door jams, paint tape damage on paint lines. These are issues any painter deals with. Again, [redacted] wouldn't know, he's never reviewed the work.
"This person would never be happy". The famous words of poor business owners. He didn't do the work to my satisfaction or per the bid. Period. And even the drywall issues are things that should have been done per the bid. The other issues are inexcusable but instead he blames me. My guess is he doesn't want to pay to have it redone as he subs out all his work so it's easier to blame me.
"Less than responsive to paying his bill". Really? Payment was made in full and received in under 30 days. It took longer than expected through Wells Fargo bill pay, but I told [redacted] what I'd done every step of the way. In fact, he basically accused me of not making the payment. Really professional. Again, he never came by to inspect the work or collect payment.
[redacted] has not "gone to great lengths" to ensure my happiness. He is short and acts annoyed anytime I question him. It is highly unprofessional to blame customers and act so hostilely toward them. I've read his Angie's list reviews where he does this to unsatisfied customers. He has a very clear pattern of doing this.
"Trying to get something for nothing". Not sure what I'm trying to get for free. I paid $220 extra to the bid in wall repair time. He just didn't do it all well and now doesn't want to take responsibility. All I want is the job completed.
Had a walk through been done, he's right, I wouldn't have paid until it was done. But I never saw him and had a lot else going on.
"Smear his company". I have no interest in smearing anyone. What would my motivation be for that? I have no track record of doing so and stand to gain nothing. I just want [redacted] to be a stand up guy and fix the issues. If he doesn't like it, then I'd suggest to stop hiring other companies to do the work HE wS hired to do. Instead, let the guys doing the work take responsibility and I could deal directly with their company.
I will be taking [redacted] to court if he doesn't want to fix my issues. Pictures are attached to show examples. Only one attached has anything to do with drywall.
Final Business Response /* (4000, 13, 2015/10/07) */
No. 1 It does not make any difference who I hire.
No. 2 I was on site everyday and put thousands of dollars into project before finally getting paid. Payment was due upon completion not in 30 days.
No. 3 We went back twice for touch ups and then client claimed he was pleased with work and finally paid. He was also on top of the project from start to finish and inspected all work on a daily basis as I did.
No. 4 Client called to let me know how much he liked crew not only for professionalism but for great work. He also claims that he referred them out to his uncle as he was very happy with them. Now he states that there is paint on ceiling and paint lines are bad and such... but he referred them out because he was happy with work. Which one is it?
No.5 He said he had in movers and flooring people in after we were there... and he moved his family in. Five weeks after paying he finds all of these problems. How many were caused by family and other contractors?
No. 6 I spoke with client in detail about problems with drywall and such and explained this was not a new property and it would never be brand new which he accepted as knowing it would never be prefect.

I don't know why he is complaining about paint work and then refers out my painters. He is also calling them to do work again at his home.
Why would someone want back crew that did such a horrible job?
It is very plain to see that he is trying to get something for nothing. When we were paid and I let him know that he was trying to get my guys to work behind my back is when he got upset. He sees nothing wrong with this. I see it as a character flaw.
We did all of the work that was written in bid and we were paid in full for services rendered. He is just pandering to the Revdex.com in order to try and smear my company further.
