Patio cover February 2018 was warranted for 2 years according to contract. Repeated calls to Carlos Hernandez to repair/fix roof leaking unanswered.
Final payment by check was made for Patio Cover installation in February 2018. Total payments for services are approximately $9000. I have had continuous issues with patio cover roof leaking, and with repeated calls, messages, and emails to Carlos Hernandez, he refuses to return correspondence, or return phone calls. In addition to leaking, quality of materials used, i.e. cedar wood has been warping, and additional cost to install and paint gutter has not been completed. Written contract has indicated that Mr. Hernandez has warranty for 2 years after completion, however he has not complied with his written contract nor verbal agreements.

Desired Outcome

I would like Mr. Hernandez to abide by his contract, and repair the patio cover, i.e. fix and stop ALL leaking, replace warped cedar, replace and paint the gutter he damaged himself on last visit.

On 08/14/2017 Affordable Fencing Plano (Represented by Ramon Candelario) and A&C Construction and Remodeling (Represented by Carlos Hernandez) started a formal businesses relationship. The same day Affordable Fencing approved and signed a contract with A&C Construction for the construction of a attached patio cover in Plano Texas. A & C was also paid that day with a requested down payment of the 65% of the total bill to start with the project. The contract was breached by A&C Construction in several different ways. Drywall screws were used instead of outdoors screws, the patio cover style is not as the pictures emailed to Carlos which was the final design per the customer, spacing between rafters are not the same as the plan of construction supplied by A&C Construction it was obvious that A&C Construction tried to shorten the materials underneath the shingles where it wasn't visible. OSB was installed only where it was visible from the ground and not over the entire structure as it should, rafters were short on the highest part of the structure and pieces were placed unattached to the structure of the patio cover, shingles were miss installed causing the structure to leak water on several places, the recently replaced shingles of the house were damaged on several places and more.Homeowner noticed some of the issues as it was occurring but Carlos convinced the customer that everything was going to be alright. Homeowner and Ramon were trying to get Carlos to make the repairs but Carlos kept trying to take shortcuts and denying and trying to avoid his responsibility as per the contract. After several attempts to resolve the situation through A&C Construction, Affordable Fencing had to agree with the homeowner's request to use another sub contractor preferred by the homeowner to complete the repairs that A&C Construction refused to fix. The total cost of the repairs has exceed the total amount of money that Affordable Fencing agreed to pay A&C Construction for the job by $2,354.44.

Desired Outcome

Refund A&C Construction was given with the opportunity to fix all issues and comply with the contract they prepared on their own and they failed. Affordable Fencing, as the primary contractor, had the responsibility to complete the job as per the customer's expectations. Affordable Fencing request that Carlos Hernandez, owner of A&C Construction and Remodeling pays for the repairs made to complete the jod as per the contract within 30 days of this notice. The amount owned is $2,354.44 as of 12/13/2017
