Review: On May 17, 2013 my husband and I paid **. [redacted] $4,000 to resurface our patio with accompanying drainage and work around our shrubs. I realized that the work could not be completed by Memorial Day, but asked that it be completed no later than Labor Day. **. [redacted] never did any work at all. In September, I started calling **. [redacted]'s voicemail on a weekly basis, asking that our money be returned, and continued calling weekly through the end of November, at which time I told him that if we did not receive a refund by December 1, 2013 I would stop calling and seek legal recourse.Desired Settlement: We wish to have our $4000 returned ASAP. We do not wish **. [redacted] or anyone who works for him on our property.

Review: On 7/21/13 I paid [redacted] of AC&M Hardscape $2566.66 a deposit to get started on a 19x20 patio at the back of my house. He was scheduled to start work on August 2013, but never showed up to start the work, we continued to contact [redacted], but he wasn't responding for several days, each time he would respond it was another excuse after excuse of why he couldn't get started. He kept promising to bring the materials to our house but they never arrived. On 3/1/14 I managed to make contact with **. [redacted] on his phone, I notified him that I wanted a refund of our deposit, he argued with me that he had taken care of everything and would be starting work after the snow melted. I told him that I didn't want him to build our patio and I wanted my deposit refunded, he continued to argue with me that we had a contract and he wouldn't refund my money, the arguing continued for several minutes at which point **. [redacted] hung up the phone; I tried several times to call him back but he wouldn't take my calls. I left him several messages and text messages to call me back; he did and leave a message that he would refund the money less a re-stocking fee for the materials. I notified **. [redacted] that I wasn't going to pay a re-stocking fee and to deliver the materials to my house if that was the case. I never got a response after that message. I have continued to call **. [redacted] daily leaving him a message to call me, but he never calls back. On 3/18/14 **. [redacted] responded to my wife's text request to have our money refunded, by stating "No problem, 30 days out hopefully I will be able to find a customer for your product", to which she responded, "if you have the materials just deliver them, enough of the delay already". I continue to place daily calls to **. [redacted] with no response.Desired Settlement: I want the refund of my $2566.67 deposit plus any additional expenses I incur in the process of getting my money refunded.

Review: Patio

4/3/2013 signed contract and gave deposit of $7500.00

Was told would start 1st week in May ("around May 1st). Over the next month, weather was rainy so I waited until mid May to contact [redacted]. He had not bothered to contact me about the delay. I Was told he was a couple weeks behind but would start by 1 June. After 1 June past, no work started and no call from [redacted] so I called again and was told "finally got a 3rd crew going" and would start "no later than June 17". A sign was then placed in my yard out front. June 19, after getting no call and work not started, I called [redacted] multiple time and left messages. He did not return calls so I called him am of June 20 from work phone and he answered. I told him I wanted a refund of my deposit and he could forget my job "that maybe that would help him catch up with other jobs." He offered to knock another $500 or so off but I told him I was not interested. He agreed to return the deposit. On June 25 I called him from my cell and left a message, he did not return my call. On June 26, I called him again and left a message. I then spoke with the person who referred him to me and explained the situation. An hour or so later, [redacted] did call me and told me he "did all of his paperwork on Saturday and that he had mailed me a certified check on "Saturday" June 22. I worked Thursday night 27 June and left town on vacation early am on June 28. I asked my roommate to check mail in my absence. I did not receive the check and upon my return to town, I called [redacted] on July 8 and again left a message. He did not call back. On July 9, I called him from a work number, he did not answer but immediately called that number back. We then had a conversation in which he became agitated and told me he was "busy working for satisfied customers", that his phone was "in and out" due to location and that I "had been inpatient" and that "he had communicated with me". I went through the sequence of events as above and told him to put himself in my shoes and imagine my frustration. I told him we needed to get together and he could return the money in person and he agreed "Wednesday or Thursday" (10 or 11 July). On the afternoon of Thursday 11 July, I texted him to ask when and where we should meet to return my deposit but got no response. Evening of 11 July, I called [redacted] and left a message but so far no return call.Desired Settlement: I just want the deposit back

Review: On April 15, 2013 we hired AC&M Landscape and Design to re-do our patio with work to start within 45-60 days. A 50% required down payment of $4,000 was paid by us at that time. June came and went - we never heard anything from [redacted] - the owner of the Company. We asked [redacted] in July, August, September, and October to come out and do the work that he agreed to on the patio. He always had a different excuse. At the end of October we asked for our $4000 deposit back. He agreed that was fair. He never sent a check back to us. We have been pursuing him to get our money back with no luck. His last comment was he did not have the money, and he ignored our request for a time frame as to when he expected to be able to return our deposit. We are very angry. Not only is this a breach of contract - it is flat out stealing.Desired Settlement: We want our $4000 back!
