We find the response unacceptable for the following reasons:
Your communication of July stated you were sending us a letterWe have not received a letterYou have acknowledged that you know we didn't receive the letter but haven't sent another copy
The day after we filed a complaint you left a phone message asking us to callI tried the two phone numbers I had for you and both were disconnected
There is no information on when or how you plan to complete the wall or if you are giving us a refund
The following is mostly a summary of the letter we sent to Dillon that he didn't pick up
We have lost confidence in your design of a retaining wall for two reasonsFirst it fell over a week after completionSecond when I did research on building retaining walls there was absolute universal agreement on the sources I checked that a retaining wall more than inches required a specific design for the specific soil and contourSome sources specified a civil engineer should provide this design
The things we want are for the most part a repeat of what is in the complaint:
We want your insurance information per your web site and contract form, it states you are fully insuredWe have asked for this information twice before and you said you would provide the informationWe haven't received itAlso the name and contact information for who we should work with at the insurance companyIf you have filed a claim for the fallen wall we want the claim number or id
We want either a full refund or for you to complete the retaining wall as specified below
If you choose to complete the retaining wall we want a signed set of plans from an Indiana licensed civil engineer and his insurance informationAlso if drainage is required to tap into the drain pipe as originally agreed uponAlso before working have the location of the underground electrical cable marked rather than depend upon my description as to its location as you previously didWhen the retaining wall is completed to clean up the work site including the broken bricks pushed over the edgeThis work is to be completed within days
Lastly, send a certified copy of the letter of resolution to me at the address you have on file and a copy to our mortgage lender

Precision Landscape's response is unacceptable
The refund offer is unacceptable because it is so low and the offer to complete work is unacceptable because it doesn't include building to a civil engineer's design
We want the wall replacement completedWe currently are seeking others to do the work because Precision Landscape hasn't give us any indication they are going to do the work
Things may seem repetitive to you (Precision Landscape) because you have not addressed the issues
The first issue and most important is we have lost confidence in your ability to design a retaining wallThe two things contributing to this is the wall fell down and when doing research we learned special attention needs to be given by civil engineers to all walls over inchesThus we want a licensed Indiana civil engineer's signature on the design
The second issue which is important is costIt appears that by the time we buy a signed drawing and hire someone to complete the work it will cost us more than $12,plus the $5,we have already paid youThis will total more than $17,We budgeted $11,for rebuilding the wall and any cost over $11,will be a hardship on us
The third issue which should be important to you is you committed to building the wallYou contracted to rebuild the wall for $11,and received a down payment of $
Based on our original complaint, other communications, and what we have learned there are three basic choices
1) Precision Landscape complete the job per a signed licensed Indiana civil engineer's drawingsThis commitment must reach us before we purchase our own drawings or hire another contractor
2) Precision Landscape give a complete refund of $5,This must reach us before we purchase drawings or hire another contractor
3) Precision Landscape wait until we purchase drawings and hire a contractors and then pay us the cost of the drawings plus contractor minus $5,(This is based on the original contract of $11,of which $5,has been paid to Precision Landscape as a down payment and $5,which we still hold

This has become quit the long processYou said you would arrange for a Civil engineer, yet failed to communicate the meeting placeThat is what put the project on holdAs well as no explanation as to where 1/of the bricks went that were used during construction
Our offer is a final offerIf you are stating your quotes are for over 12,and that is with the wall down, the majority of the grading done, and most backfill materials on site, than we grossly underbid the job
This is a final offer as well as affirmation that we cannot assist you with litigation against the home builder as we do not consider it good business practice

So here it is Sept 8 and he has not bothered to reach me. I'm doing all the corresponding. I've called. I've sent emails. I have even gone to his house. If he was so interested in making this right, he would find avenues to reach and contact me. We already discussed that it was ok to drop off the rest of the brick. What's the hold up? Why does the customer always have to initiate? I feel like this is the last attempt . Papers are ready to file with the court. All I need to do is pay court cost to get a date set. Do the right thing . You've ran out of excuses.
