Initial Business Response /* (1000, 8, 2015/02/23) */
After I received call on January 25/from Ms***, I informed her through email of the wind speeds that had occurred and the wind warranty of the shingle type they selected and that I could repair the roof but it would be at a small feeShe
phoned me a left a vulgar meassage swearing on me and threatening lawyers ( which I have saved)The Fact is yr *** shingles only have a manufactures wind rating of km/hrThis was discussed with Mr*** (***) over the phone when we choose the shingle type, I had tried to convince him to use yr *** shingles with a wind warranty of km/hr but he opted for the yr *** because it saved approximately $plus tax off billHe had it explained it was only a rental and wanted to save money where he couldRegardless, On January I went to *** and repaired tabs that were blew offI never received a payment for this repairThen they had another phone call a day or two later from there tenant when the winds exceeded 100km/hr againMs*** contacted me and I informed her I could go take a look but I would need payment for first repair $and this repair should cost about half as I already have shingles purchased from first repairMs*** refused to pay and refused my serviceI have no problem returning to do any repair needed for free that are in my control, but when it a product issue and not a labour issue then I cannot do it for free or I will be out of businessI have many clients who pay for there repairs when winds blow above manufactures warranty
Initial Consumer Rebuttal /* (3000, 10, 2015/02/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The contractor has not addressed our complaintHe is blaming the problem entirely on wind speeds, but the problem has resulted from the improper conditions in which shingles were installed, which we were made aware of when he emailed the manufacotrs warrenty, to us, on Feb.6/
We have found out from the Mfgof the shingle and the adhesive Mfgthat they do not recommend installation of shingles on cold daysI would like to again mention that the contractor reasured us , in a telephone conversation that conditions were good for Dec.17/15, to complete job
I have done a little research on the official weather reports for Dec& 18/14, and found that on Dec17/14, the day most of work was completed, the tempin *** was below degrees C and that we had snow flurries.*
We have paid the EVO Group, in good faith, for the professional work that they claim they do,using the materials that Mr*** recomended** and expect the contractor to take responsibility for properly installing any damaged shingles and comply with the year warrenty he has given, and/or any implied warrenties which may be required by law
Again, we are requesting repairs, done in proper conditions

Final Business Response /* (4000, 18, 2015/03/23) */
Firstly, I have outlined the Main points under the heading (IKO Installing Shingles In Cold Weather), because YOU SAID in your last complaint that we did not install shingles in the proper weather conditionsSecondly, we use the nail high wind application when installing these shingles all year round , not only in the winter monthsThirdly, The plastic cement used is a winter grade cement made specifically for use in colder weatherfourthly , Other contractors who install a shingle with a MANUFACTURES WIND WARRANTY of 100km/hr, understand that when wind speeds exceed this warranty then it NOT the Installers responsibility any longerHence they pay there repair bills as if it is a new contract
Final Consumer Response /* (4200, 20, 2015/03/29) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Considering that our new shingles did not remain intact for much more than a month, we do not accept that you have installed the shingles in the recommended conditionsThe use of the winter grade cement would require close adherence to mfgrecommended conditions for applicationYou have admitted to installing the bulk of the shingles in -2C temp& that later in the day the tempsoared to -1C, & that the section of the roof completed in these conditions are in the area which has not adhered properly to the roof, yet you are denying responsibility for the resulting problems with the roofAgain, for the cement to set properly, the mfgrecommends several days of mild temps& sunshine, after application, or it may never cure.It may be a wind problem, but if the cement wasn't given the recommended conditions to set properly, then they will never have a chance to resist the wind
This and all other requirements for proper installation can only be proven with an inspection, as previously outlined in our communications, which under the circumstances must be preformed
You chose the time & conditions under which shingles were installed, and reassured me, when questioned, that the conditions were right, now it is your responsibility to repair your mistake, under the Workmanship WarrentyNo other outcome will be acceptable, to solving this complaint
