Complaint: [redacted] I am rejecting this response because: I have not received an e-mail from Mr [redacted] and asked that he please post a copy to the Revdex.com website for my reviewIf Mr [redacted] would review previous attachments, one of his addendums states he would remove debris for $I also want reimbursement of the LP gas plumbing($380.81), the replacement of spa blower motor which is defective, fix air blowing in return line to pool and payment for missing water nozzle Regards, [redacted] ***

Complaint: ***
I am rejecting this response because:1. Mr*** is correct, on page under EXCAVATION the original contract #*** dated 03/31/states MATERIAL: to be left on site. However, an addendum #was issued 05/18/charging an additional $2,for item 5X "Haul off excavated material". 2. Mr*** is in error when he wrote that he asked us to wait until he had extra time and money. Twice, Friday, October 7, and again Monday, October 31, 2016, he assured us he would schedule the debris removal and provide the equipment loader (Bob Cat) if we would pay the dump truck as he was in a financial bind. We agreed to this both times and he never followed through. 3. We only have one (1) equipment warranty issue which is the spa blower motor. The first time Mr*** was notified of the defective blower motor was September 7, 2016. It has been 2-1/months and the equipment still hasn't been replaced with no communication from him of the status. 4. When the water hose nozzle came up missing the day the workers left, Mr*** was notified and he stated he would replace it so it was entered on the punch list. 5. Compassion or true understanding? Mr*** has had 7-1/months to complete a job that on page of the previously mentioned contract states: CONSTRUCTION TIME: *Approximately working days from first day of excavation. 6. Mr*** failed to address the following: aAfter several notifications to include handing a copy of invoice in person the homeowner had to pay *** *** *** in the amount of $(originally $+ late fees) due to threat of a lien. bThe water return lines are blowing air into the pool which to date have not been addressed. With the threat of a lien from *** *** Co LLC (he finally paid), *** *** *** (we paid) and the fact that debris hasn't been removed so we can convert our aerobics septic system to a drip system as required by Comal County, I feel we have been very patient through this whole process
Regards,

We will be hauling off the extra dirt one day next weekI will go over the other minor issues with him when I am on site

Complaint: [redacted]
I am rejecting this response because:Once again this response is rejected until the following previous mentioned items are complete to homeowners satisfaction or Mr. [redacted] pays $3,000 so homeowners can complete his project.1. Removal of excavated material  (Picture attached)2. Replace defective Spa Blower Motor3. Replace water hose nozzle4. Pay homeowner $380.81 for [redacted] invoice5. Figure out why water return lines are blowing air into the pool.  If it's the seals on the equipment as Mr. [redacted] stated by text, fix it!

Complaint: [redacted]
I am rejecting this response because: I have not received an e-mail from Mr [redacted] and asked that he please post a copy to the Revdex.com website for my review. If Mr [redacted] would review previous attachments, one of his addendums states he would remove debris for $2120.00. I also want reimbursement of the LP gas plumbing($380.81), the replacement of spa blower motor which is defective, fix air blowing in return line to pool and payment for missing water nozzle.

I have emailed Rodney [redacted] and told him I will be there on March 23 to take care of all issues. Please understand I will be spending over $3000 to satisfy the client and keep my good standing with the Revdex.com. Also I am not in agreement with the client. My contract clearly states excavated material to remain on site.  However I will resolve the issue at my expense. [redacted]

although I don't agree with Mr [redacted] I will do what ever it takes to make him satisfied[redacted]

Complaint: [redacted]
I am rejecting this response because:Once Mr. [redacted] completes his contractual obligations and reimburses out of pocket expenses this complaint will be changed to ACCEPTED.We look forward to communication with Mr. [redacted] contacting us to resolve these issues.

After receiving Mr M[redacted]'s notice that his pool was seeping water slightly from the above ground raised pool wall I hired American Leak Detection to check the pool. Please see attached. The report stated that there was no plumbing leaks and that there were small hairline cracks in the plaster....

Rather than repair the leaks I went to the full extent of a total pool replaster. This ensured a cosmetically sound look in the pool costing me over $3000 rather than just hundreds had I patched the plaster. In short we went far beyond normal warranty requirements for the client. Regarding the statement that says I told him to go find someone else  . ABSOLUTLY FALSE. I WOULD NEVER, I HAVE NEVER,  IN MY LIFE MADE SUCH A STATEMENT TO A CLIENT. I consider this complaint untrue, unreasonable and absolutely unnecessary as a simple honest phone call to me and I will assist in the matter!!!!.  I have sent a message to the client stating I will be happy to consider assisting in the matter. I hope to hear back from him soon n order to put this to rest. Regards, Brian Q[redacted]

Complaint: [redacted]
I am rejecting this response because:
Again
this response is rejected until the following previous mentioned items are
complete to homeowners satisfaction or Mr. [redacted] pays $3,000 so homeowners
can complete his project.
1. Removal
of excavated material (also known as dirt or debris) see previous attachment
2. Replace
defective Spa Blower Motor
3. Replace
water hose nozzle
4. Pay
homeowner $380.81 for [redacted] invoice
5. Figure out why water return lines are blowing
air into the pool. Ten months has now passed for this 30 day project.  Patience is wearing thin and we would like a resolution soon.  We are ready to move forward in getting our drip system completed as required by Comal County.  How much longer can Mr. [redacted] use his stall tactics.
Regards,
[redacted]y [redacted]

The truth is there is no $ 2100 allowance in the contract for debris removal. The contract states all material to be left on site $2100 has been paid so far for removal. He is very close on the estimate for the remaining material. He just does not want to pay itin an effort to resolve the issue...

I have offered to PAY for the removal of debris however I asked that wait until I have extra time and money.his other 2 complaints are warrantee issues that have bee turned in to the manufacturer. His complaint about a Hose nozzle is entirely indicative of these complaints.  Not really dealing with a homeowner with any compassion or true understanding

I'm working on a time frame to remove the dirt. I will let you know soon
